A Comparison Of Academic Performance Measures Of Hsta Participants With Non-Hsta Participants: Is It Possible To Narrow The African American-White Achievement Gap?, Sherron Mckendall, Alan Mckendall, Ann Chester

Historically, African American and other underserved students encounter academic challenges in pursuit of a college degree—one of which is their performance on standardized tests. This paper analyzes College Grade Point Averages (CGPAs), ACT Composite (ACTC), and SAT Total (SATT) scores of students who participated in the Health Sciences and Technology Academy (HSTA), an out-of-school-time (OST) program, and Non-HSTA (NHSTA) students attending West Virginia University. Traditionally, OST programs provide academic enrichment to underserved youth to increase their chances for post-secondary entry and success. Two-Way Factorial ANOVA determined if HSTA participants performed better on academic measures than their NHSTA counterparts. The ANOVAs …

Unbundling The “Big Deal”: One Library’S Experience In Rising To The Occasion, Susan J. Arnold, Traci J. Mays

Background:
Budgetary constraints at West Virginia University (WVU) in combination with the impending expiration/renewal of “big deal” contracts forced the WVU Collections Advisory Committee (CAC) to implement the unbundling of three major journal packages. Wiley was the first package unbundled in 2017, followed by Elsevier Science Direct and Springer packages in 2018-19.
Methods:
The CAC determined criteria to use to consider whether or not to keep specific journal titles, including total uses, cost per use, and number of papers published and references used from each title by WVU faculty members over a 3-year period. Journals were ranked for each of …

The Wheeling Area has experienced significant economic volatility over the past several years, with the region’s economy swinging back to strong growth in 2018 thanks to surging natural gas production and massive levels of pipeline construction activity. The New River Gorge Area enjoyed its second calendar year of growth in 2018 but despite recent growth in coal production and construction activity, the region’s economy continues to struggle in some ways with the lingering effects of a deep economic downturn that occurred between 2012 and 2016. In this report, we present a detailed discussion of the New River Gorge Area’s recent economic performance along with our forecast for the likely path of economic activity over the next five years.

The Eastern Panhandle (EPH) has been West Virginia’s strongest economic region for much of the past decade. Numerous economic indicators point to broad strength in the area’s economy and the region’s performance tends to stack up well against national-level economic measures. In this report, we present a detailed discussion of the current state of the EPH economy along with our forecast for the likely path of economic activity over the next five years.

West Virginia registered its strongest year of economic growth in more than a decade during 2018, marking the state’s second year of recovery after a protracted economic downturn that lasted for much of the period between 2012 and 2016. The energy sector has driven most of West Virginia’s economic rebound, particularly the abundance of natural gas pipeline construction activity occurring throughout the state. North Central West Virginia Economic Outlook: 2020-2024, Brian Lego, John Deskins

North Central West Virginia has remained one of the state’s healthiest economic regions and continued to post solid job growth over the past couple of years. Even with some recent job losses by at one of the area’s largest employers and protracted stoppages to natural gas pipeline projects, the area has recorded solid gains in income and employment and all four of the region’s counties have shown varying degrees of improvement across a range of labor market indicators. Extreme weather events, which are occurring with increasing frequency as a result of climate change, threaten the reliability and resilience of the nation's electricity grid. Increased flooding due to intense rainfall, hurricane damage fueled in part by a warmer atmosphere and warmer, higher seas, and widespread wildfires caused by extended drought conditions constitute potential hazards for utility infrastructure and delivery of essential electricity service. As a possible adaptation strategy, increased deployment of distributed energy resources (DERs), which are small-scale generating resources located near-and connected to-a load being served with or without grid interconnection, can improve the resilience of the electric …

Hard Cases Make Bad Law: Extraterritorial Application Of The United States Constitution, Brendan O. Beutell

The Constitution’s extraterritorial scope does not arise often in litigation. Two recent decisions broached the issue. Both arrived at opposite conclusions. And these decisions share a common thread: They confuse more than they clarify while begetting novel questions of law. Does the Constitution protect noncitizens abroad? If so, how? If not, why not? This Note addresses each of these questions in turn. Ultimately, this Note concludes that the Constitution does not have any extraterritorial application whatsoever to noncitizens abroad.

Criminal Law’S Folk Psychological Dilemma: Resolving Neuroscientific And Philosophical Challenges To The Voluntary Act Requirement, Branden D. Jung Esq.

Criminal law has adopted the folk psychological view of human agency. Under this view, voluntary action exists and mental states, such as intentions, goals, and desires, have a causal relationship with bodily movement. However, new advances in neuroscience have begun to challenge this model and have lent empirical support to the idea that mental states may not play a causal role in bodily movement. This has profound implications for the voluntary act element of actus reus because the requirement presupposes the folk psychological view of agency.
