Crisis Of Conscience In Post-Roe America, Elizabeth Sepper
The Journal of Contemporary Legal Issues
This essay proceeds in four parts. Summarizing my previous writing, Part II explains that since Roe, the law has systematically favored refusing individuals and institutions. This asymmetry was unjustified, because “[c]onscience equally may compel a doctor or nurse to deliver a controversial treatment to a patient in need.” After Dobbs v. Jackson Women’s Health Organization, the asymmetry may deepen. In restrictive states, Part III contends, the crisis of conscience for willing providers will increase, even as rights to refusal expand. Part IV identifies several possible complications for the legal framework governing conscience in medicine. It suggests that as …

A Catholic university and local diocese partnered to address the shortage of teachers in Catholic schools and to train educators with skills to meet the needs of all learners. The Academy of Catholic Teaching (ACT) program is based on the three pillars of the University Consortium of Catholic Education: education, community, and spirituality. Based on a two-phase evaluation of the pilot program, stakeholders reported increased faith-based integration, coaching and mentoring support, and research-based, inclusive practices. This article is an analysis of the ACT End-of-Program Evaluation which identified six emergent themes: coaching, collaboration, community engagement, coursework, spiritual opportunities, and program improvements.

This collections contains records kept by Thomas Cosgrove during his 38 years working at the University of San Diego. Records are associated with his work in Student Affairs and include meeting minutes, memoranda, resources used for policy creation, and event planning materials. The primary event represented is New Student Orientation, which Cosgrove overhauled into a week of activities and events for incoming students. Also included are materials for the President's Advisory Council and the Strategic Long Range Plan, both in which Cosgrove was actively involved.

The Individuals with Disabilities Education Act (IDEA), which Congress enacted in 1975 with subsequent revisions, states that school districts are to provide a free and appropriate public education (FAPE) to all students with disabilities in the least restrictive environment. Public local education agencies (LEAs) including school districts have an obligation to identify, locate, and evaluate private school students suspected of having a disability—the "child find" process. Students enrolled by their parents in private schools are not entitled to a FAPE if they choose for their children to remain in private school after the children have been identified as having a …

The First Amendment's Religion Clauses: "Freedom Of Conscience" Versus Institutional Accommodation, Michael J. White

The phrase "freedom of conscience" is, of course, not to be found in the United States Constitution: the First Amendment says only that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." However, it seems probable that one, then-contemporary Protestant conception of freedom of conscience was presupposed in these two clauses. Evidence for this conjecture can be found not only in the debate and proposals concerning the Bill of Rights of the United States Constitution but also in the frequently more expansive language of early state constitutions.

Why The Federal Marriage Amendment Is Not Only Not Necessary, But A Bad Idea: A Response To Christopher Wolfe, Michael Perry
San Diego Law Review
The Federal Marriage Amendment does more than prevent same-sex couples from having marital status. In response to Professor Wolfe, this article contends that the Federal Marriage Amendment prevents state courts and state legislatures from choosing to grant marital status to same-sex couples. Gender complimentarity, the heart of Professor Wolfe's argument and the Federal Marriage Amendment's basis, is too controversial and problematic to bind future generations from allowing same-sex marriage. This Article looks at the conflict between religious authority and liberal politics from a point of view within the Catholic Church. It examines the grounds of the teaching authority asserted by the Church, the scope and strength of that authority, and the possibility that obedience to authority will create dilemmas for religiously committed public officials. For purposes of illustration it uses New York Governor Mario Cuomo's religious and political observations on the subject of abortion.
