The American Corporation In The Twenty-First Century: Future Forms Of Structure And Governance, Azizah Y. Al-Hibri

This article focuses on corporate governance issues as they relate to the new technological developments and the issue of leapfrogging. I examine various theories about the new technologies and the changes in corporate governance that they may necessitate. I then assess and critique these theories in light of historical and other data. I suggest that our very concept of the corporation will be transformed by the Information Age. I also offer my own view as to the optimal forms of corporate governance that can equip American corporations with sufficient tools to win the accelerating competition anticipated for the next century. …

How Much Should Mind Matter? Mens Rea In Theft And Fraud Sentencing, James Gibson

This article discusses the U.S. Sentencing Commission’s vote to potentially revise the definition of loss. Anyone who has followed the Commission's deliberations on loss will see that the proposed definition attempts to address many of the contentious issues that have arisen in the case law and commentary. The issues that the proposed definition concentrates on, however, such as credits, interest, causation, and gain, tend to inform the inquiry into "actual loss" rather than "intended loss," even though the latter concept is integral to both definitions. Although neither the current nor the proposed definition provides much guidance for working with intended …

President Gerald Ford's Impact On United States Foreign Policy From 1974 To 1991, Robert David Clifton

To illustrate President Ford's impact on United States' foreign policy, this thesis looks at his early life, his Congressional career and his brief tenure as Vice President. From there, it focuses on the differences between Ford and President Nixon. The paper looks at their personalities, decision-making styles, and their styles of leadership. Next, it analyzes the major international events that took place during Ford's years in the White House. These events include the fall of South Vietnam and Cambodia, communist intervention in Angola and Ford's dealings with the Soviet Union and The Peoples' Republic of China. Congress Authorizes Appellate Study Panel, Carl W. Tobias

In mid-November, the first session of the 105th Congress passed a measure authorizing a national commission to study the federal appeals courts. On November 26, President Clinton signed the legislation. The Commission on Structural Alternatives for the Federal Courts of Appeals has a historic opportunity to analyze carefully the federal appellate system and make valuable suggestions for improvement, thereby charting the destiny of the intermediate appeals courts for the 21st century.

The welfare reform legislation passed by Congress last year makes significant changes in the social welfare system, followed this year by contrasting shifts in the. federal tax system's treatment of families with children. This article discusses how the. welfare and tax law changes affect overall child care policy and funding levels for work-related child care, and evaluates the newly enacted child tax credit and the existing child care tax credit in light of their combined effects on low income working families.

We present a recursive construction for difference sets which unifies the Hadamard, McFarland, and Spence parameter families and deals with all abelian groups known to contain such difference sets. The construction yields a new family of difference sets with parameters (v, k, λ,n)=(22d+4(22d+2−1)/3, 22d+1(22d+3+1)/3, 22d+1(22d+1+1)/3, 24d+2) for d⩾0. On The Answer-Arrangement Bias Of Professional Certification Examinations In Accounting, Marshall A. Geiger, Mark M. Higgins

The test construction literature has emphasized the randomization of answers within multiple-choice items as a way to eliminate test construction bias. This study examines the answer placement bias of the multiple-choice portion of the 1987 - 1992 CIA, CMA, and CPA exams. The results indicate a consistent bias toward the "A" position in the CIA exam and against the "A" and "E" positions on the CMA exam. Also, all three exams were found to have significantly fewer correct answer runs (e.g., four "A's" in a row) than would be expected from the random placement of answers. A discussion of test …

It has been an excellent stretch in English for the Latin Arians of the fourth century. They have gotten heftier, more robust, more formidable. Daniel Williams' Ambrose of Milan and the End of the Nicene-Arian Conflicts challenges what he calls "the prevailing view" that they "posed little, if any, serious threat" to the Nicene faith of the western European churches from the 350s through the 380s. Neil McLynn's Ambrose of Milan: Church and Court in a Christian Capital insists that the Milanese Arians complicated Ambrose's career more than previous chroniclers of christological conflict and the biographers of the bishop ever …

Growing up in Hanover, Virginia, "surrounded by people who cast the world in vibrant and poetic colors," Sw. Anand Prahlad "fell in love with proverbs at an early age" (ix). This lifelong love affair has resulted in a rich collection of African American proverbs that expanded as Prahlad went through college and graduate school, and did postgraduate research. All the while, he was sharpening his critical skills and developing the theoretical framework to establish a model for use in examining the varied components of proverbial speech in the African American community, proceeding on the assumption that in order to understand …

In this paper, we will examine the backward shift operator Lƒ = (ƒ – ƒ(0))/z on certain Banach spaces of analytic functions on the open unit disk D. In particular, for a (closed) subspace M for which LM ⊂ M, we wish to determine the spectrum, the point spectrum, and the approximate point spectrum of L|M. In order to do this, we will use the concept of "pseudocontinuation" of functions across the unit circle ∏.
