“Mexico Has Spilt American Blood Upon American Soil!” The Role Of The Mexico-U.S. Border In The Promotion Of American Nationalism, 1821-1920, Jon M. Williams Phd

Sociology ETDs

International borders not only serve as the edge of a nation-state's sovereign territory, but they also aid in informing popular conceptions of its national identity. This study examines how the Mexico - U.S. border served as a spark for episodes of American nationalism from 1821-1920. In examining three historical periods whereby the border was forming, disrupted, or challenged, I demonstrate how borders serve as sources, both symbolically and physically for the expressions of American nationalism. I utilize inductive qualitative discourse analysis of American actors embedded along the border, in Mexico, or serving as political leaders, to sample some of the …

Pro Se What?! Orders Of Protection, Credible Threats To Physical Safety, And Restricting Access To Firearms, Amy J. Feagans

New Mexico Law Review

Orders of protection provide survivors of domestic abuse a level of security by limiting contact between the parties. In 2019, the New Mexico legislature amended the Family Violence Protection Act (FVPA) to provide additional protections through orders of protection by requiring the respondent to relinquish their firearms to law enforcement where the court finds there is a “credible threat to the physical safety” of the petitioner. In 2023, the New Mexico Supreme Court clarified the required showing for obtaining an order of protection and held that the court must find prior domestic abuse. But the “credible threat” standard required for …

All Cases Great And Small: Fufilling The Nmcra's Promise Of Attorney Fees, Isaac M. Green, Seth E. Montgomery May 2024

All Cases Great And Small: Fufilling The Nmcra's Promise Of Attorney Fees, Isaac M. Green, Seth E. Montgomery

New Mexico Law Review

Section 5 of the New Mexico Civil Rights Act (NMCRA) permits a court to award “reasonable” attorney fees to a “prevailing plaintiff.” In this way Section 5 parallels its federal analog, 42 U.S.C. § 1988, which similarly allows a “prevailing party” to recover “reasonable” attorney fees in federal civil rights suits. But despite this language in the federal statute, a string of U.S. Supreme Court decisions have circumscribed the availability of attorney fees in suits brought under § 1983. This restriction on attorney fees has led to what Professor Joanna Schwartz calls the biggest obstacle to civil rights litigation in …

The Hemodynamically Significant Patent Ductus Arteriosus And Bronchopulmonary Dysplasia, Abby Fyfe, Jon Love, Sofia Markee Apr 2024

The Hemodynamically Significant Patent Ductus Arteriosus And Bronchopulmonary Dysplasia, Abby Fyfe, Jon Love, Sofia Markee

2024 Pediatric Research Forum Session

Background: The patent ductus arteriosus (PDA) is a common complication of prematurity that affects the majority of extremely preterm infants. In epidemiological studies, babies with a persistent PDA had increased rates of interventricular hemorrhage, bronchopulmonary dysplasia (BPD), necrotizing enterocolitis, and cerebral palsy. However, numerous clinical trials have demonstrated no improvement in outcomes with medical treatment of the PDA. However, the reliability of these studies has been called into question becaues the majority use size alone to determine hemodynamic significance of the ductus and did not include babies at the youngest gestational ages. It has been theorized that using a more …

Neutrosophic Sets and Systems

This paper presents a neutrosophic inference model for bioinformatics. The model is used to develop a system for accurate comparisons of human nucleic acids, where the new nucleic acid is compared to a database of old nucleic acids. The comparisons are analyzed in terms of accuracy, certainty, uncertainty, neutrality, and bias. The proposed system achieves good results and provides a reliable standard for future comparisons. It highlights the potential of neutrosophic inference models in bioinformatics applications. Data mining and bioinformatics play a crucial role in computational biology, with applications in scientific research and industrial development. Biological analysts rely on specialized …

Child Labor, Informality, And Poverty: Leveraging Logistic Regression, Indeterminate Likert Scales, And Similarity Measures For Insightful Analysis In Ecuador, Arnaldo Vergara-Romero, Guido Macas-Acosta, Fidel Márquez-Sánchez, Orlando Arencibia-Montero

Neutrosophic Sets and Systems

The paper presents a comprehensive analysis of child labor in Ecuador, employing advanced statistical tools like logistic regression, neutrosophic Likert scales, and similarity measures to deepen the understanding of this social issue. The integration of these methodologies allows for a nuanced assessment of the various socio-economic factors contributing to child labor. By capturing the uncertainty in human responses, the research highlights the complex interplay between poverty, household income, education levels, and labor types on the incidence of child labor. Key findings suggest that rural location, the age of the child, and the informal nature of the head of the household's …

Analyzing The Income-Education Nexus In Ecuador: A Neutrosophic Statistical Approach, Guido Macas-Acosta, Juan-Antonio Jimber-Del-Río, Fidel Márquez-Sánchez, Arnaldo Vergara-Romero

Neutrosophic Sets and Systems

This study examines the relationship between education and entrepreneur income in Ecuador, a prototypical small economy grappling with employment challenges. Utilizing quantile regression and neutrosophic statistical methods, the research uncovers varied impacts of education on earnings across different income levels. The findings reveal a decrease in indeterminacy as individuals ascend income quintiles, indicating that higher education levels yield more predictable and substantial economic returns at the upper end of the income spectrum. These insights are vital for policymakers to develop targeted educational interventions. The study’s methodological novelty lies in its adoption of neutrosophic statistics, which embraces the indeterminacy intrinsic to …

Brain & Behavioral Health Research Day

This is an original study that investigates correlates of traumatic brain injury (TBI; i.e., severity, total number of TBIs, age at first TBI) and psychopathic traits (i.e., antisocial or interpersonal qualities) in justice-involved adult males who were incarcerated at the time of their participation. Our results show higher levels of psychopathic traits in individuals with TBI versus those without, which suggests a greater need to target TBI in the treatment of justice-involved populations.

Brain & Behavioral Health Research Day

In this study, young college students in New Mexico, under 25yo, were asked for how they seek mental health care. It was found that those who first sought non-psychiatric help faced more delays in getting specialized treatment for their first signs of psychosis. Trust issues and fear of being judged were common barriers to seeking care, unaffected by ethnicity or gender, suggesting a need for better psychiatric care access and support systems.

Neutrosophic Sets and Systems

This paper is an in-depth study that starts from a preliminary one, where we surveyed 141 ranchers from the town of Coto-Coto in Peru to obtain as much information as possible about the relationship between two economic variables, Activity Cost and Financial Management. Furthermore, we study the correlation of the first one of them with three other economic vari ables. To do this, we process the survey data using logical operators with the support of the plithogenic statistics theory. These results given in the form of plithogenic values are logically aggregated and were converted to crisp values and studied through …

Don't Swab Me!: Limitations Of The Genetic Information Privacy Act In The Modern Genetic Testing Landscape, Ibrahim Al-Gahmi Feb 2024

Don't Swab Me!: Limitations Of The Genetic Information Privacy Act In The Modern Genetic Testing Landscape, Ibrahim Al-Gahmi

New Mexico Law Review

In an age where consumers can easily obtain genetic tests by simply sending a saliva or cheek swab sample through the mail and learn more than ever about their DNA and its genetic makeup, it is imperative that measures are established to provide consumers with both control and protection to the privacy of their submitted biological sample and analyzed genetic data. Currently, the landscape of genetic testing, and the resulting genetic information, is regulated by one law in New Mexico. The Genetic Information Privacy Act (NM-GIPA or Act), enacted in 1998, provides general prohibitions on the collection of genetic information …

The Water Under The Bridge Is Darkening—An Analysis Of Copyright Law And The Prevalence Of Copyright Trolls, Daniel Berenger-Russell Feb 2024

The Water Under The Bridge Is Darkening—An Analysis Of Copyright Law And The Prevalence Of Copyright Trolls, Daniel Berenger-Russell

New Mexico Law Review

In this time of modern technology and booming social media, the growth in intellectual property protection is no surprise. It logically follows that with more robust intellectual property protection there exists a greater chance of infringement. The likelihood of innocently infringing on a person’s registered copyright is at an all-time high. Due to the increased likelihood of innocent infringement, “copyright trolls” have emerged and developed unethical business tactics to prey off “innocent infringement.” Just like fairytale trolls who hide under bridges hoping to pester bystanders, copyright trolls also seek to burden peoples’ days. Not only do copyright trolls prey off …

The Myth Of Anonymity: De-Identified Data As Legal Fiction, Elodie Currier Stoffel Feb 2024

The Myth Of Anonymity: De-Identified Data As Legal Fiction, Elodie Currier Stoffel

New Mexico Law Review

The unregulated collection, processing, and sale of consumer data has led to a plethora of social and legal issues. As regulators attempt to catch up with the “move fast and break things” ethos of tech innovation, “de-identified” or “anonymized” data has remained broadly unprotected. However, computer science literature shows us that “de-identified” data is a legal fiction. This Article examines the source of the de-identification fiction, analyzes the definitions in new state laws which attempt to close the loophole, tracks potential harms, and proposes a legislative solution which aims to ameliorate some of the legal fictions’ negative impacts. Part I …
