The growing recognition of the rights of nature is a blend of both modern conservation efforts and principles reflected in traditional Indigenous stewardship that should be an essential component of the discourse around environmental justice. This article provides an overview of the laws that invoke the rights of nature that Indigenous perspectives and practices regarding environmental preservation have influenced. Long In The Tooth: The Commodification Of Teeth, Land, And Character; Resistance To British Oral Culture In Nineteenth-Century Britain, Ireland, And The Americas 1770-1900, Emma B. Mincks

This dissertation is about teeth- rather, how they are portrayed in British colonial discourses of the late eighteenth and early nineteenth century and their development as a commodified material object associated with purity, lands, and visceral emotionality. What do teeth specifically, and orality more generally, mean to eighteenth and nineteenth-century readers in relation to the logics of white possession? How did objectified subjects react to and respond to the affective tension created by this objectification? Using dairy farm data, this dissertation investigates the environmental and health implications of concentrated animal feeding operations (CAFOs) in New Mexico. It seeks to answer three primary research questions: (1) the relationship between environmental justice indicators and proximity to dairy farms; (2) the overall health consequences of dairy air pollutants; and (3) the viability of implementing an anaerobic digester (AD) system as a potential solution to externality concerns while maintaining dairy farm economic sustainability.

From Austin To Santa Fe: Exploring The Prosecution Of Environmental Crimes Within Epa Region 6, Dr. Joshua Ozymy, Dr. Melissa Jarrell Ozymy

Criminal violations of environmental law are prosecuted by EPA and DOJ. Despite decades of such prosecutions, there has been relatively little analysis done towards understanding existing patterns in criminal prosecution of environmental crimes, especially on a regional basis. This article analyzes the 287 prosecutions which occurred in EPA Region 6 between 1983–2022, out of the 2,807 total environmental crimes prosecuted by all of EPA during that period. In the selected cases, defendants were cumulatively assessed with over $908 million in monetary penalties, 225 years of incarceration, and 1,032 years of probation. Las Cruces is the second largest city in New Mexico which has experienced exponential growth in the last three decades. The city has been cultivated by a rich history of Native populations, Spanish colonialism, and American democratic government. The culmination of these influences on Las Cruces had much influence on the Mesquite Historic District, the original townsite of Las Cruces. This area is home to many generational families and is adjacent to the downtown Main Street corridor. Abstract

The Intergovernmental Panel on Climate Change—the UN’s expert science panel—has repeatedly found that limiting climate change to prevent catastrophic harms will require at least some use of carbon capture and sequestration (CCS), and may entail substantial deployments of this technology. There is significant uncertainty, however, about the level of lifecycle greenhouse gas (GHG) reductions achievable in practice from varying CCS applications; some applications could even lead to net increases in emissions. In addition, a number of these applications create or maintain other harms, especially those related to fossil fuel extraction and use. For these reasons, many environmental justice advocates …

The COVID-19 pandemic, the ongoing reckoning with structural racism, and an emerging focus on justice in the clean energy transition have combined to spotlight utility disconnections and the related issues of energy access, affordability, and security. Recent empirical scholarship has demonstrated that electricity disconnections of lower-income people are relatively common, disproportionately affect people of color, and cause significant harm. This Article describes how a number of U.S. states are fashioning an emerging policy model that makes significant progress toward truly affordable and accessible electricity service for all. Estimating Potential Exposure From Abandoned Uranium Mine Sites Through Machine Learning Classification Of Animal Behavior: A Case Study In The Navajo Nation, Christopher Girlamo

Waste from Abandoned Uranium Mines (AUMs) has negatively impacted Indigenous communities for generations. To answer these concerns, this research collaborated with Navajo Nation community members in Cove, AZ and Red Valley, AZ in order to better predict the potential AUM waste exposure their flocks face. A GIS-Multi-Criteria Decision Analysis (GIS-MCDA) model quantified potential exposure to AUM waste. Animal behavior was classified based on GPS and accelerometer data utilizing a Hidden Markov Model (HMM). The results of both the GIS-MCDA and animal behavior classification modeling was combined into a cumulative exposure potential value for each animal. This study found that livestock …

In 2019, New Mexico Governor Michelle Lujan Grisham issued an executive order establishing a goal of cutting New Mexico greenhouse gas (GHG) emissions 45 percent by 2030.1 In parallel, the state legislature enacted the 2019 Energy Transition Act (ETA), which requires New Mexico utilities to decarbonize their electricity supply by 2045.2 In keeping with these actions, state agencies issued regulations to reduce GHG emissions from oil and gas and transportation sources and to implement the ETA.
