Recent disputes over whether older people should pay more for health insurance, or receive lower priority for transplantable organs, highlight broader disagreements regarding the legality of using age-based criteria in health care. These debates will likely intensify given the changing age structure of the American population and the turmoil surrounding the financing of American health care. This Article provides a comprehensive examination of the legality and normative desirability of age-based criteria. In the Article, I defend a distributive justice approach to age-based criteria. Algorithms are created by and used by humans in software programs and in everyday tasks. They are composed of input data, a series of steps, and output. When it comes to computer algorithms, we often see the results of algorithms but we don't see the processing steps or the input data that has determined the output. It is important to be aware that all these components are subject to mistakes and biases - the input data as well as the processing steps.For this reason, we should seek transparency in the algorithms that are put to use and which affect our …

Sexual Assault And Health: Understanding The Interplay Of Trauma-Related Appraisals And Physical Health Outcomes, Kerry Lyn Gagnon

Women who have been sexually assaulted are at risk for negative mental and physical health outcomes; however, limited research has tested how psychological responses to sexual assault may influence physical health. The present study tested a longitudinal model examining the association between posttrauma appraisals and physical health problems. Drawn from a larger study, the sample included 156 ethnically diverse women who had been sexually assaulted within the last year. The study used cross-lagged panel models to test for reciprocal relationships between posttrauma appraisals and physical health problems over time. This dissertation explores the process and examines the outcomes of youth participating in a positive youth development adventure-based intervention Challenge By Choice (CBC) with outcomes of youth receiving treatment as usual in a residential and day treatment program. This dissertation aims to build on the growing body of literature on outcomes associated with PYD theoretical models and AET approaches. Specifically, the proposed dissertation asks: Is there a difference in externalizing behavioral outcomes for youth who participate in CBC as compared to peers of similar age/behavioral baseline who receive only treatment as usual?

The growing presence of electronic technology in the health service professions is redefining the boundaries of counseling services. Commonly referred to as telehealth, utilization of electronic communication strategies to expand connectedness has opened new frontiers in behavioral health through applications ranging from digital phones, interactive video sessions, to virtual supervision. Substantial research suggests that telehealth is generally equal in effectiveness to traditional forms of treatment, especially for those individuals struggling with substance abuse problems. This doctoral research praxis project discusses the status of Black males in education, provides explanations on the educational disparities that exist for Black male students, and defines possible strategies to remedy the persistent and chronic problem of Black male underachievement in schools. Racism is viewed as one of the factors that contributes to the dilemma of Black male students’ underachievement in school. To better understand the educational disparities, Jones’s conceptual framework, three levels of racism: “A Gardener’s Tale,” was discussed to deconstruct the ways racism may possibly occur within the educational system. Restorative Justice is a practice that incorporates harmed parties and the greater community in resolving harm or conflict, the ultimate goal of restorative justice being to make things right. This practice has been used increasingly in student conduct processes on college campuses across the United States. This doctoral research paper serves to evaluate the restorative justice program housed at the University of Denver, which has been using this process since 2012. Traumatic brain injury (TBI) is a serious public health issue. The incidence of TBI is much higher in the incarcerated population than in the general population, making this a uniquely vulnerable population. Methods: This study looks at data from the Jail Based Behavioral Health Services (JBBS) to examine recidivism rates among inmates participating in supportive programming. It also uses data from a state brain injury program to examine the impact of case management on community engagement in the justice-involved population with a history of brain injury. This dissertation is an autoethnographic poetic illness narrative based on the author's year-long ordeal with unrelenting undertreated chronic pain. The project is grounded in the epistemological tradition of Black Feminist Thought and presented in alignment with the emergent methodological paradigm of critical arts-based inquiry. The purpose of the project is for the author to develop and articulate a radical reflexive praxis within the paradigm of critical arts-based inquiry while demonstrating the value of lived experience as a source of knowledge and poetry as a method of inquiry in revealing subjugated truths about the experiences of marginalized people. Adolescent Protective Factors Related To Resilience: Issues Of Academic Self-Efficacy, Parental Involvement, And Special Education Status, Bethdalie Cruz

The predictive value of three constructs was examined in this study in order to explain adolescent self-reported protective factors associated with resilience while moderating for the effects of sex and race. The three constructs included Academic Self-efficacy, Maternal Parental Involvement, and Special Education Identification Status. Participants included 54 adolescents in diverse public middle and high schools, ages 11 to 18. Twenty of these participants were identified as receiving special education services while 34 did not. Results indicated that adolescent perceptions of Academic Self-efficacy significantly predicted protective factors associated with resilience while Special Education Identification Status and Maternal Parental Involvement did …

America's war on drugs is a failed experiment that has caused more damage than it will ever prevent. From its original design to its contemporary manifestations, the war on drugs is a conflict that remains firmly rooted in white supremacy. In contemporary Western societies, the rhetoric of both political leaders and mass-mediated narratives becomes the raw material of subjective reality. Some scholars argue that communities of color have been historically considered criminal by law enforcement (Fanon, 1963/2004; Gordon, 1996; Sharpley-Whiting, 1999), and Parenti (2003) and Kendi (2016) traced the history of modern policing to slave patrols. Wynter (2003) illuminated the racial logics undergirding our society - including policing - to the overlay of monotheism and its fixity with racial constructions of human as historically rooted in slavery and colonization. Thus, policing, too, carries a racialized dimension (Gamal, 2016) that creates or amplifies trauma and mental illness (Westcott, 2015). The Fourth Amendment protects against unreasonable “searches and seizures,” but in the digital age of stingray devices and IP tracking, what constitutes a search or seizure? The Supreme Court has held that the threshold question depends on and reflects the “reasonable expectations” of ordinary members of the public concerning their own privacy. For example, the police now exploit the “third party” doctrine to access data held by email and cell phone providers, without securing a warrant, on the Supreme Court’s intuition that the public has no expectation of privacy in that information. This article examines how men'sprofessional sports leagues treat domestic violence committed by players. Over the past twenty years, but particularly over the last five, the public has criticized, and the media has shone a spotlight on, the big leagues' ignoring of the issue. Many call for parity between how the criminal justice system treats the issue of domestic violence and how the leagues should treat it, arguing for a zero-tolerance approach.
