Entrenched In Context: Perceptions Regarding Intimate Partner Violence And Viable Interventions Among Undergraduate Students, Julio Montanez Dec 2015

Entrenched In Context: Perceptions Regarding Intimate Partner Violence And Viable Interventions Among Undergraduate Students, Julio Montanez

HIM 1990-2015

Many policies and programs have relevance to intimate partner violence (IPV), such as no-drop policies, firearm-related policies, mandatory reporting, mandatory arrest, and others. IPV affects persons from a multitude of demographics and statuses. Dating violence has its mark on college campuses. The present research studies both attitudes toward IPV and attitudes toward interventions that pertain to IPV. Attitudes toward IPV have been found to relate to a number of explanatory variables: attributions, socioeconomic status, age, class standing, race/ethnicity, religion/spirituality, attitudes toward gender, violence in the family of origin, and previous IPV histories. Perceptions of IPV interventions have been found to …

Identity As A Sexual Minority In The Workplace: A Look At Personality And Contextual Factors, Samuel Resende Dec 2015

Identity As A Sexual Minority In The Workplace: A Look At Personality And Contextual Factors, Samuel Resende

HIM 1990-2015

Sexual identity in the workplace is an exploratory topic in an age when sexuality is becoming a topic of discussion. However, protection of sexual minorities (Lesbians, Gays, and Bisexuals) is not universal despite evidence that heterosexist climates are disadvantageous for employers. In this study, I examined if sexual minorities who perceive their place of employment to be relatively free of heterosexism would be more satisfied with their jobs, perceive more organizational fit, and report less work stress. In addition, I sought to determine if selected personality variables would mediate the relations among critical study variables. The personality variables were internalized …

The Influence Of Gun Control Legislation On Rampage Shootings, Andrew D. Manor Dec 2015

The Influence Of Gun Control Legislation On Rampage Shootings, Andrew D. Manor

HIM 1990-2015

The United States has experienced several mass shootings in the past few years. It has been averaging one shooting every week in 2015, and something must be done about it. This problem appears to be limited to the United States since several other nations have been able to minimize, and almost eliminate the number of mass shootings. By taking an analysis of the gun laws of the United States with those of Australia and Canada it can be concluded that some aspects of strict gun control can reduce the number of mass shootings. Further, the United States should look at …

A Comparative Analysis Of The Usa Patriot Act Of 2001 To The Usa Freedom Act Of 2015: Balancing Security With Liberty, Richard L. Russo Dec 2015

A Comparative Analysis Of The Usa Patriot Act Of 2001 To The Usa Freedom Act Of 2015: Balancing Security With Liberty, Richard L. Russo

HIM 1990-2015

Freedom and safety are two ideals that American citizens value greatly; however, the balance between privacy and security determines whether or not both can be achieved in a reasonable manner. Security and privacy are not mutually exclusive; however, they tend to exhibit an inverse correlation with regards to maintaining individual liberties. Security and privacy are highly beneficial, but when one is given too much weight, the other most often suffers. When the United States citizens are given too much privacy through regulations, the citizens risk their well-being by not allowing the government the ability to prevent dangerous activities being done …

The Death Penalty Debate: A Critical Examination Of The Moral Justifications For Capital Punishment, Whitley Mann May 2015

The Death Penalty Debate: A Critical Examination Of The Moral Justifications For Capital Punishment, Whitley Mann

HIM 1990-2015

Capital punishment is a forceful moral issue that is frequently overlooked. This is possibly due to the reverence many have toward the rule of law or a passive acceptance of the status quo. In this thesis I will begin with a discussion of context to the topic of the death penalty in order to address potential biases. Then I examine not only the ethical merit of the death penalty but the foundational justifications for a system of criminal justice to show that the special relationship between the state and its citizens does not lend itself to or allow for the …

Domestic Violence Shelter Policies Across The State Of Florida, Kyra Nickell May 2015

Domestic Violence Shelter Policies Across The State Of Florida, Kyra Nickell

HIM 1990-2015

Domestic violence shelters can vary greatly in the services available to victims and their families. The funding shelters receive can impact the shelter’s ability to provide specialized services. Since the availability of services might vary from shelter to shelter, victims can have different experiences based on their location. This cross-sectional study contacted representatives from nine shelters in the State of Florida and asked the representatives nine questions about the services which are available at their respective shelter. The findings from this research show that these nine shelters offer a greater number of services than the study expected. However, there is …

Democracy On Trial: Examining Argentina's Response To The 1994 Terrorist Attack On The Amia Jewish Community Center In Buenos Aires, Amy Crawford

HIM 1990-2015

On July 18, 1994, the Asociación Mutual Israelita Argentina (AMIA), the Jewish Community Center in Buenos Aires, was bombed in what has been called the worst terrorist attack on Argentina in history. The bombing killed an estimated 86 people and wounded over 200. The Argentine government began a judicial investigation and vowed to bring the perpetrators to justice. Twenty years later, the case remains unresolved. The investigation has been marked by inefficiency and allegations of corruption. The recent, suspicious death of the lead prosecutor of the case has further called into question the legitimacy of Argentina’s government and justice system. …

Deciphering Holland's Code, Dennis D. Turner Jan 2015

Deciphering Holland's Code, Dennis D. Turner

HIM 1990-2015

The Party Exercise found on countless career guidance websites and popularized by the best-selling, job-hunting book What Color Is Your Parachute (Bolles, 2015) purports to provide an estimate of an individual's Holland's code. This study examines whether this commonly used Party Exercise accurately predicts an individual's Holland's code (Holland, 1997). Undergraduate students (N=473) completed The Party Exercise and then the Self- Directed Search (Holland & Messer, 2013). The results of this study do not support the use of this popular “Party Exercise” as a valid estimate of an individual's Holland code.

The C.S.I. Effect: Exploration Of Its Influence On Perception Of Criminal Behavior, Alexandra Mcconnell Dec 2014

The C.S.I. Effect: Exploration Of Its Influence On Perception Of Criminal Behavior, Alexandra Mcconnell

HIM 1990-2015

This study explores the C.S.I. effect in relation to its influence on criminal activity. Expansive research exists concerning the C.S.I. Effect, but very little pertains to the influence it has on individuals' perception of crime and their ability to get away with it. The study explores whether heavy viewers of crime show dramas such as Law & Order and C.S.I. display increased confidence in their ability to commit and get away with a crime. Essentially, this study explores whether these crime television shows are not only entertainment, but also may serve as guides on how to commit crimes. Participants in …

Stand Your Ground Law: How Can A Ucf Student's Fear Of Crime Affect Their Opinion Of The Law And What Variables Affect The Student's Level Of Fear Of Crime?, Kelly Duckworth

HIM 1990-2015

A person's level of fear of crime or even their perceived fear of crime can affect how they view the Stand Your Ground Law and whether it is seen as beneficial or harmful to the general public. I begin with a discussion of the Stand Your Ground Law. Next, I report on research that examines the fear of crime and how it may shape opinions on the law as well as an individual’s level of fear. My research explores the relationship of these variables using survey data. I examine the attitudes of college students regarding their fear of crime to …

Zero Tolerance For Some: The Role Of Race In Zero Tolerance Exclusionary Discipline, Meghan Bejarano May 2014

Zero Tolerance For Some: The Role Of Race In Zero Tolerance Exclusionary Discipline, Meghan Bejarano

HIM 1990-2015

Within the last few decades, zero tolerance policies and exclusionary discipline have become the standard way in which schools manage student behavior. These policies, namely suspension and expulsion have been shown to have negative impacts on the lives of students who are punished with them. Educationally, the removal of students from the classroom hurts their chances of achieving academic success. Furthermore, these policies have been linked with an increase in the presence of law enforcement on school campuses, which results in the arrest of students, burdening them with expensive and serious legal battles. This research examines whether nonwhite students are …

Domestic Violence: The Need For Integrated And Specialized Courts In The Ninth Judical Circuit Of Orange And Osceola County, Florida, Rose Caldero

HIM 1990-2015

Over the last 30 years, the justice system has increased attention toward domestic violence. In many states, the emphasis has emerged to a specialization, separate dockets and specially trained judges (Center for Court Innovation 2009). Domestic violence courts have evolved, however the Ninth Circuit Court in Orange and Osceola County has yet to adopt this concept. At present, the Osceola County Courthouse utilizes the Unified Family Court (UFC), an integrated comprehensive approach which handles all cases simultaneously addressing the families involved in disputes, as well as the adults and the children of domestic violence. The Orange County Courthouse on the …

Conceptions Of Justice: A Sampling Of Student Perspectives, Matt Landon May 2014

Conceptions Of Justice: A Sampling Of Student Perspectives, Matt Landon

HIM 1990-2015

Although the literature in the field of criminal justice and philosophy is full of ideas of what constitutes "justice," little to nothing has been done to see where the average individual's opinion falls in relation to these ideas. This paper analyzes a cross-sectional convenience sample of students at UCF to determine their preference of six models of justice: utilitarianism, contractarianism, fairness, retributivism, moralism, and libertarianism. Correlating demographic factors are also discussed.

Dangerous Opinions: Perception Of Violent Video Games On Jury Decision Making, Brock Jacobi May 2014

Dangerous Opinions: Perception Of Violent Video Games On Jury Decision Making, Brock Jacobi

HIM 1990-2015

The purpose of the study was to examine whether a potential juror would give harsher sentences to defendants based only on the manipulation of the defendant's personal hobby. This was investigated by manipulating the hobby through a hypothetical manslaughter scenario in a vignette. Participants were asked to answer questions pertaining to the defendant's guilt and potential sentencing. Results indicate that participants' sex, participants' authoritarianism, and defendant's hobby were significant factors. Significant interactions were found pertaining to whether the defendant should receive counseling across sex by violence and sex by avocation. These results are evidence that the use of jurors in …

Social Work Student Perceptions Of Labor Trafficking, Margaret Mulhern May 2014

Social Work Student Perceptions Of Labor Trafficking, Margaret Mulhern

HIM 1990-2015

Human Trafficking in Florida is a growing issue that affects individuals and communities on a micro, mezzo, and macro level. Although legislative efforts and changes in agency policies have raised awareness about this problem, limited awareness and research examines awareness of labor trafficking as one form of human trafficking. This exploratory-descriptive study used a convenience sampling technique to explore the perceptions of 45 Bachelors (BSW) and Masters (MSW) level social work students on the prevalence and nature of labor trafficking. The findings from the research show students have a general idea of labor trafficking and believe in equal access to …

Alien Tort Statute: A Discussion And Analysis Of The History, Evolution, And Future, Shane Yodlowski May 2014

Alien Tort Statute: A Discussion And Analysis Of The History, Evolution, And Future, Shane Yodlowski

HIM 1990-2015

The Alien Tort Statute is a short, thirty-two word section of the United States Code enacted in 1789 as part of the Judiciary Act. The Alien Tort Statute, or ATS, has an uncertain and controversial beginning and remains controversial in current jurisprudence. The ATS reads as follows: “The district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the law of nations or a treaty of the United States." It is my intent for this thesis to be an academic discussion of the mysterious history, intent, and court cases …

Sexual Offender Treatment: A Paradigm Analysis Of Academic Journals, Vijay Chillar May 2014

Sexual Offender Treatment: A Paradigm Analysis Of Academic Journals, Vijay Chillar

HIM 1990-2015

Many criminologists and psychologists have theorized the possible causes behind an individual who engages in sex offenses; some of which will be reviewed. Through this paradigm analysis, I hope to identify how each discipline addresses the causes of sex offending and what treatments they offer in response to their theories. Additionally, this thesis will examine the Good Lives, Relapse Prevention, and the Risks, Need, Responsivity (RNR) models of treatment. The main objective of this thesis is to address the different facets of sex offending, so that the importance of finding an effective treatment model can be understood. By raising awareness …

An Overview And Examination Of The Prevention And Punishment Of White Collar Crimes, Tyler Bartels May 2014

An Overview And Examination Of The Prevention And Punishment Of White Collar Crimes, Tyler Bartels

HIM 1990-2015

White-collar crime is explained from an economist’s perspective. Economic models typically begin by assuming individuals behave rationally. By extension, economic models of crime suggest that white-collar criminals may be acting more rationally than a casual observer may assume. This thesis will identify the benefits and drawbacks of different regulations and laws by exploring several case studies of white-collar events.

Brave New World Reloaded: Advocating For Basic Constitutional Search Protections To Apply To Cell Phones From Eavesdropping And Tracking By Government And Corporate Entities, Mark Berrios-Ayala

HIM 1990-2015

Imagine a world where someone’s personal information is constantly compromised, where federal government entities AKA Big Brother always knows what anyone is Googling, who an individual is texting, and their emoticons on Twitter. Government entities have been doing this for years; they never cared if they were breaking the law or their moral compass of human dignity. Every day the Federal government blatantly siphons data with programs from the original ECHELON to the new series like PRISM and Xkeyscore so they can keep their tabs on issues that are none of their business; namely, the personal lives of millions. Our …

Tragedies like Columbine then Virginia Tech and most recently the Sandy Hook Elementary shooting in Connecticut. This research focuses on student's perception of safety and the issues with violence on campus. The question is how the students, faculty, and staff will react if an incident like this occurs on the University of Central Florida campus. The Plight Of Foreign National Women In The United Kingdom: Coercion And Trafficking As Factors Of Imprisonment, Sarah Lokey

HIM 1990-2015

Within the United Kingdom (UK) prisons exists Foreign National women (FNW), a unique demographic of women who are non-UK citizens who have committed crimes within the UK. It is important to delve deeper into the issue before judgment is made, however, it seems as though in most circumstances, most citizens are not willing or perhaps even unknowledgeable that such a population within prison exists. Therefore, it is important to educate others about the issues that FNW in prison face. This research focuses on the issues such as lack of special services for the women such as translation and family contacts, …

Mental Illness In The Prison System: Exploring The Issues And Possible Solutions, Melinda Pacecca May 2013

Mental Illness In The Prison System: Exploring The Issues And Possible Solutions, Melinda Pacecca

HIM 1990-2015

The purpose of this research was to explore the issue of mental health in the prison system. A large portion of the prison population is mentally ill. The prison environment poses special challenges to these individuals. Treating mental illness in a prison environment can be difficult as there are many factors that must be considered in deciding the best way to handle mentally ill offenders. Mental health courts show promise in dealing with these issues, but methods vary quite significantly from region to region. A literature review was conducted to provide an overview of the types of mental illnesses seen …

Does Knowledge Predict Fear: Prior Knowledge Of Mass School Shootings And Students Fear Of Crime On A College Campus, Emily Rosenbaum May 2013

Does Knowledge Predict Fear: Prior Knowledge Of Mass School Shootings And Students Fear Of Crime On A College Campus, Emily Rosenbaum

HIM 1990-2015

On April 16, 2007, 32 students and faculty were killed on the Virginia Polytechnic Institute and State University campus, making this incident the deadliest mass school shooting in United States history. Other school shootings, such as the infamous Columbine High School shootings and the more recent Northern Illinois State shootings, have become popular topics in today's social media (Kaminski et al, 2010; Reese 2009). Due to these events, schools and universities have become interested in the safety of their students as well as the students overall feelings towards crime while on their campus. New research studies have taken an interest …

Experiences With Social Services Among Homeless Lgbtq Young Adults, Fallon Kadel Aug 2012

Experiences With Social Services Among Homeless Lgbtq Young Adults, Fallon Kadel

HIM 1990-2015

My findings imply that homeless LGBTQ young adults are very limited in where they can go to find LGBTQ-accepting services. Even though all the shelters that were interviewed claimed they did not discriminate against LGBTQ persons, they do not provide and are not affiliated with services or programs that are considered to be LGBTQ- accepting. Based on the research, shelters would rather have clients conform to their pre-existing structure rather than the shelters conforming to the specific needs of the clients.; The goal of this research is to explore what programs and services are being provided at various homeless shelters …

Has The Pendulum Swung Too Far? A Legal Evaluation Of Florida's Child Abuse And Neglect Registry, Julianna Debler Aug 2012

Has The Pendulum Swung Too Far? A Legal Evaluation Of Florida's Child Abuse And Neglect Registry, Julianna Debler

HIM 1990-2015

Over the past several years, increasing public emphasis on preventing child maltreatment has resulted in substantial changes to Florida's child abuse and neglect central registry. Many of these recent changes, aimed at preventing child maltreatment, have resulted in over one million false, unsubstantiated, and inconclusive reports of child abuse and neglect within the last decade. While the information held in reports may be useful for identifying and preventing potential child abuse or neglect, due process concerns have been raised with regards to the process of placing a person's name in a report without providing a hearing for challenging or removing …

Constitutionality Of Drug Possession As A Strict Liability Crime An Analysis Of Florida's Drug Statute, Davis Watson Aug 2012

Constitutionality Of Drug Possession As A Strict Liability Crime An Analysis Of Florida's Drug Statute, Davis Watson

HIM 1990-2015

The United States has a drug issue that is perpetually problematic. Efforts are being made on every level of government to reduce drug use and deter current and potential future users. Some of these efforts however are putting citizen's rights at risk in a manner that threatens the United States Constitution that hails over both the state and federal governments. My thesis will examine Florida's avant-garde approach to simplifying drug convictions through unprecedented legislation that has already been ruled unconstitutional on its face by the United States District Court for the Middle District of Florida. The decade long struggle will …

Preserving The Right To A Fair Trial An Examination Of The Prejudicial Value Of Visual And Auditory Evidence In The Context Of A Criminal Case, Emily Edwards May 2012

Preserving The Right To A Fair Trial An Examination Of The Prejudicial Value Of Visual And Auditory Evidence In The Context Of A Criminal Case, Emily Edwards

HIM 1990-2015

Federal Rule of Evidence 403 requires evidence's probative value to substantially outweigh its prejudicial value for the evidence to be admitted. To date, courts have opinioned that photographic evidence holds low prejudicial impact and rarely render court proceedings unfair (Futch v. Dugger, 1989). The present study sought to empirically investigate this issue. In a 2 (Auditory Present/Auditory Absent) x 3 (Graphic Photo/Neutral Photo/No Photo) factorial design, 300 participants reviewed case materials from a recent murder case and provided information concerning their verdict decision. Emotional state data was also collected prior to and following review of the case materials via the …

Medicate To Execute Constitutional And Ethical Considerations, Adam Schultz May 2012

Medicate To Execute Constitutional And Ethical Considerations, Adam Schultz

HIM 1990-2015

The United States Supreme Court has not yet examined several aspects of the death penalty. One aspect is the ability for the state to forcefully medicate an incompetent inmate, which may result in the inmate appearing competent for execution. While the Supreme Court' ruled that it is unconstitutional to execute an inmate who is incompetent, inmates who would have had their executions vacated due to mental illness are executed because the state can put them on an involuntary medication regimen. According to many experts, involuntary medication regimens mask the affects of their illness instead of providing a cure. Experts often …

An Examination Of The History And Effect Of American Sex Offense Laws And Offender Registration, David Shabat-Love May 2012

An Examination Of The History And Effect Of American Sex Offense Laws And Offender Registration, David Shabat-Love

HIM 1990-2015

America's Sex Offense statutes and cases are some of the most controversial sections of modern law, both for the extreme sensitivity of their subject matter as well as the scope and application of those laws. This thesis is an analysis and overview of both the objective and subjective issues posed by the current state of those very laws: the subjective portion explored the development of current laws and the diverse attendant legal issues such as over-broadness and excessive or misdirected effect as compared to the Legislative and public intent which directly led to the development of these laws. Additionally a …
