Sex And Gender Segregation In Competitive Sport: Internal And External Normative Perspectives, Patrick S. Shin
Suffolk University Law School Faculty Works
What are the justifications for mandatory sex segregation in competitive sport, and what are the arguments against it? This article takes up these questions. I argue that justifications of sex segregation in sport should be sensitive to two distinct perspectives that can come into play. The “internal” perspective emphasizes considerations rooted in an ethos of athletic competition. The “external” perspective brings into focus broader social norms such as anti-discrimination principles and equality goals. Both perspectives support the general idea of separate men’s and women’s competitions, at least in elite levels of sports that reward physical strength and power. The perspectives …

Top Tens In 2017: Patent, Trademark, Copyright And Trade Secret Cases, Stephen M. Mcjohn

The Supreme Court loosened the grip of patentees on their products, holding that contractual restrictions on patented product are ineffective to preserve patent rights. The Court also loosened the grip of the Eastern District of Texas on patent cases, announcing a narrower standard that will send more cases to Delaware. The Federal Circuit cases piled up on applying the Alice standard to filter nonpatentable abstract ideas from patentable inventions. Meanwhile, even as the constitutionality of the Patent Trial and Appeals Board pends before the Supreme Court, hundreds of PTAB decisions on the validity of patents move onward to the Federal …

Characterizing Reflective Practice In Psychotherapists' Practice And Its Relationship With Experiential Avoidance, Alison R. Thomas

Reflective practice (RP) is an essential element of all professional work, including psychotherapy. However, RP can also cause feelings of anxiety and discomfort that may be barriers to engaging in RP. This research aimed to 1) describe the relationship between between RP and experiential avoidance in a sample of independent licensed and experiential psychotherapists, 2) explore among psychotherapists the previous finding among physicians that greater years of practice (YOP) and age predict lower levels of RP (Mamede & Schmidt, 2005), and 3) describe reported barriers to and supports of engaging in RP.
