What is the canon of family law? By canon, I mean the ways of thinking about family law that are widely shared by legal scholars and especially by legal authorities, like legislators and judges. The existing literature on canons, which has long centered on the literary canon and has recently turned to the constitutional law canon, has most commonly understood a canon to be a set of foundational texts that exemplify, guide, and constitute a discipline. Who Survived The Titanic? A Logistic Regression Analysis, Lonnie K. Stevans, David Gleicher
Lonnie K. Stevans
A logistic regression analysis of an extensive data set on the Titanic passengers is presented which tests the likelihood that a Titanic passenger survived the accident--based upon passenger characteristics. The main finding is that underneath the strong overt preference afforded in the rescue by the authorities to women and children over men, there was a complex class determination of survival rates among men, on the one hand, and women and children, on the other. It is an open question whether the prohibition on employment discrimination in the Americans with Disabilities Act (ADA) protects plaintiffs who have not attempted to mitigate the effect of their disability on their ability to work. Suppose, for example, that a job applicant has severely impaired vision because of a corneal disease. He can have corneal transplant surgery that his doctors recommend and expect will allow him to see much more clearly, but he does not want to have the surgery because of the complications sometimes associated with the operation and the possibility that the surgery will not work. Marginality and subordination have been important themes in India's human and social sciences for almost a hundred years. Aloka Parasher-Sen's edited volume is a useful intervention in the literature on caste in the "intermediate and immediate past" (p. 3). This is the long stretch of South Asian premodernity frequently ignored by historians, thanks to presentist commitments that tend to overwhelm their scholarship ideologically or lop-sided archival and linguistic skills that tend to constrain it intellectually. BACKGROUND: Accidental poisoning is one of the leading causes of injury in the United States, second only to motor vehicle accidents. According to the Centers for Disease Control and Prevention, the rates of accidental poisoning mortality have been increasing in the past fourteen years nationally. In Texas, mortality rates from accidental poisoning have mirrored national trends, increasing linearly from 1981 to 2001. The purpose of this study was to determine if there are spatiotemporal clusters of accidental poisoning mortality among Texas counties, and if so, whether there are variations in clustering and risk according to gender and race/ethnicity. This paper examines heterogeneity and income inequality among Hispanic Americans. Two processes that influence Hispanic heterogeneity include acculturation and labor market discrimination because of skin shade/phenotype. I focus on Hispanics because of their variation in phenotype, color, nativity, and language usage, and also because of their recent large-scale integration into a society that has been historically characterized by bi-polar racial categories that are putatively based on phenotype. This process provides a natural experiment for appraising the relative importance of acculturation, discrimination, and income inequality. I use data from two periods, 1979 and 1989, to determine the stability of identity formation …

This study examines how the use of sex in magazine advertising varies across eight different countries – Singapore, Australia, India, South Africa, France, Germany/Austria, Brazil and the U.S. Eight magazines were collected from each country. We examined the incidence of sex in advertising and its various components in the 3,201 ads found in this assortment of magazines. Significant differences between countries were found for use of attractive models, nudity and types of sex appeal. While it is difficult to draw firm conclusions, we believe that the results support the notion that sex in advertising is driven by its novelty value …

Why is it that so many laws perpetually fall short of their intended goals? Why haven’t humanity’s greatest minds managed to solve basic social ills? This article amasses considerable evidence suggesting that (a) law is inherently incapable of producing major social change because legal restrictions unsettle social equilibria and generate counteractions and (b) the subconscious purpose behind many laws is the promotion of social solidarity for its own sake. The author concludes that laws and the politics that forge them are essentially religious practices that have little basis in rational analysis. Thus can be explained both the perpetual failure of …

BACKGROUND: Giardia lamblia is the most frequently identified human intestinal parasite in Canada with prevalence estimates of 4-10%. However, infection rates vary by geographical area and localized 'pockets' of high or low infection rates are thought to exist. Water-borne transmission is one of the major routes of infection. Sources of contamination of drinking water include humans, domestic and wild animals. A previous study in southern Ontario, Canada, indicated a bivariate association between giardiasis rates and livestock density and/or manure use on agricultural land; however these variables were not significant when the variable 'rural' was added to the model. Like few other topics in the academic study of medieval literature, the search for the possible parallels between philosophical and literary texts reveals the not always peaceful coexistence among the three basic approaches to the study of medieval literature and culture: While hard-core medieval philologists would not accept any claims for a “literary nominalism” unless direct textual dependence can be demonstrated, scholars in medieval studies and the comparative study of medieval literature have shown themselves more accepting of investigations which diagnose a certain nominalistic Zeitgeist, mentality, or milieu especially in late medieval culture; and scholars preferring presentist/postmodern approaches have wholeheartedly …

A global gender equality regime has emerged, identifiable by its norms, principles, legal instruments and compliance mechanisms. I suggest that neoliberal theories of international regimes provide insights into the identification of this regime and the conditions for its emergence. They acknowledge the role of transnational networks, international institutions and epistemic communities of experts in shaping state choices. Global women’s networks, together with multilateral and bilateral development organizations, have been instrumental in shaping these global norms on gender equality by engaging in a learning process – framing issues, influencing negotiations by the information they provide and monitoring progress. The focus of Communes’ action has been on the development of small-scale infrastructure, whose financing absorbed all CSF resources in 2002 and 2003. In both years, over 60% went to rural transport projects (roads, small bridges and culverts). In 2003 the second most important category of projects (absorbing 16.3% of the CSF resources) included the construction and rehabilitation of canals and other irrigation structures. These two categories of investments, on which three quarters of the CSF resources were spent, reveal the strong local preference for economic infrastructures. This paper uses NFHS-2 (1998-99) data to explore certain linkages between literacy status of a couple (husband and wife) with outcomes like household standard of living index (SLI) and others having implications on women and child health. An attempt has also been made to link the proximate criterion in literacy in the couple domain with outcome variables such as SLI, instances of sickness among women from specific diseases as asthma, TB, malaria and jaundice; linkages with indicators like under-nutrition in women have also been analysed.
