A common contention among proponents of American ratification of the international Convention on the Rights of the Child (CRC) is that the ratification is necessary in order to protect children from paternal and governmental oppression. The opponents of ratification typically contend that it will lead toward a breach of US sovereignty while harming both family values and interests of children. The authors argue that the impact of CRC ratification upon American law will probably be much less radical than both antagonists and protagonists presume. After the Rain is Takashi Koizumi's feature film debut, made in 1999. Akira Kurosawa wrote the screenplay, and Takashi Koizumi attempted to make a film from Kurosawa's script, as he would have wished. The tribute quality of the film manifests itself most eminently when one puts After the Rain alongside Rashomon, Kurosawa's 1950 masterpiece. On the face of it, there is not much in common between the somber Rashomon and the delightful, lighthearted After the Rain. This essay presents literary representations dealing with the presence of law and adjudication in an ideal society. The rule of law is presented in the paper as capable of being premised on principles, rather than solely on code-like positivistic rules. The struggle for the rule of law, as the rule of legal principles, is at the core of the two Utupian stories presented here - the Hebrew legend "Alexander of Macedonia and the King of Kasia", and Agnon's story "With Righteousness Shall He Judge the Poor".

ברשימה זו אטען כי חשיבותו המרכזית של הבדיון אינה בקשר שבין מלאכת הספרות לשיפוט חומל או לצדק. בחלק הראשון של רשימה זאת, שיעסוק בטיב הקשר שבין תפישת האני ובין הבדיון הספרותי, אטען כי מהלך כזה, הוא חיוני למשפט. בחלק השני אדון באפשרות לייחס לקריאה ההשפעה מסוימת, תוך התייחסות לטענתה של נוסבאום בדבר הקשר שבין הקריאה לבין שיפוט הנערך מתוך עמדה של אמפטיה והערכה הוגנת ואוהדת של מצב הזולת. בחלק השלישי אדון בשאלת רישומם השונה של הרומן ושל הסיפור הקצר על תפישת האני, ובסוף-דבר אזכיר התפתחות תרבותיות המאיימות לכרסם בכוחם של הסיפור הקצר ושל הרןמן גם יחד.
