Facing The Ghost Of Cruikshank In Constitutional Law, Martha T. Mccluskey

For a symposium on Teaching Ferguson, this essay considers how the standard introductory constitutional law course evades the history of legal struggle against institutionalized anti-black violence. The traditional course emphasizes the drama of anti-majoritarian judicial expansion of substantive rights. Looming over the doctrines of equal protection and due process, the ghost of Lochner warns of dangers of judicial leadership in substantive constitutional change. This standard narrative tends to lower expectations for constitutional justice, emphasizing the virtues of judicial modesty and formalism. By supplementing the ghost of Lochner with the ghost of comparably infamous and influential case, United States v. Cruikshank …

The religious lives of young adults have generally been investigated by examining what young people believe and their self-reported religious practices. Far less is known about young adults’ organizational involvement and its impact on religious identities and ideas about religious commitment. Using data from site visit observations of religious congregations and organizations, and individual and focus group interviews with college-age black and white Christians, we find differences in how black and white students talk about their religious involvement; and with how they are incorporated into the lives of their congregations. White students tended to offer “organizational biographies” chronicling the contours …

This work reviews an important shortcoming of the dominant public international paradigm and the recent methodical responses to that edifice. Specifically, this article argues that issues of race have not been significantly addressed in international law discourse. In particular, this Article notes that in the theoretical discourse some writers have discussed race, but the thrust of the discourse marginalizes the importance of race. This article discusses a dairy advertising campaign featuring skeptic Derren Brown. I explore the various health claims made in the ads as well as a report Brown featured on his website that claimed consumption of cow’s milk is linked to longevity. I discuss how dairy consumption is largely linked to race and ethnicity. It is a practice enjoyed primarily by European whites as most nonwhites are lactose intolerant. Lactose intolerance is a normal biological process associated with weaning, but it is medicalized and made deviant because it is not part of the white experience. I also mention comments made by …

Lack of diversity in the ranks as well as a failure to resonate with disadvantaged groups and other anti-oppression movements has been cited as one important barrier to the American Nonhuman Animal rights movement’s success (Kymlicka and Donaldson 2013). It is possible that social movements are actively inhibiting diversity in the ranks and audience by producing literature that reflects a narrow activist identity. Matthew Desmond's Evicted: Poverty and Profit in the American City is a triumphant work that provides the missing socio-legal data needed to prove why America should recognize housing as a human right. Desmond's masterful study of the effect of evictions on Milwaukee's urban poor in the wake of the 2008 U.S. housing crisis humanizes the evicted, and their landlords, through rich and detailed ethnographies. His intimate portrayals teach Evicted's readers about the agonizingly difficult choices that low-income, unsubsidized tenants must make in the private rental market. A large body of empirical research documents the adverse mental health consequences of workplace bullying. However, less is known about gender and race differences in the processes that link workplace bullying and poor mental health. In the current study, we use structural equation modeling of survey data from the 2010 Health and Retirement Study (N = 2292) and draw on stress process theory to examine coworker support as a buffering mechanism against workplace bullying, and gender and race differences in the relationships between bullying and psychological distress. In recent years, a growing social consensus has emerged around the aspiration of a “post-racial” America: one where race is no longer a fault line for social strife or, perhaps, a morally significant trait whatsoever. This ambition, however, lies in tension with the most basic constitutional principle governing our treatment of race in the public sphere: that of “strict scrutiny.” Post-racialism seeks to diminish the salience of race to near-negligibility. The strict scrutiny of racial classifications, by contrast, significantly enhances the salience of race by treating it differently from virtually every other personal attribute or characteristic - including hair or …
