The work discusses how the British East India Company came to the subcontinent for the purpose of trade in 1604 and how it slowly and gradually started interfering in the local justice system by acquiring revenue collection of 38 villages in 1717 near Calcutta. In 1765 the Company was granted revenue collection as well as customs of three provinces. The Company also acquired the administration of justice in the areas under its control and the role of Muslim qadis and judges was over. Over one million defendants pass through the criminal justice system every year, yet we almost never hear from them. From the first Miranda warnings, through trial or guilty plea, and finally at sentencing, most defendants remain silent. They are spoken for by their lawyers or not at all. The criminal system treats this pervasive silencing as protective, a victory for defendants. This Article argues that this silencing is also a massive democratic and human failure. Our democracy prizes individual speech as the main antidote to governmental tyranny, yet it silences the millions of poor, socially disadvantaged individuals who directly face …

Good science that identifies what causes homelessness, sound evaluations which document that certain programs will never work, and even evidence that promising solutions deserve broad replication, are often disregarded. Such wanton indifference for science would constitute malpractice in the field of medicine, but it sometimes passes as acceptable policy in the field of social welfare. Child sexual abuse (CSA) involving sexual contact between an adult (usually male) and a child has been reported by 20% of women and 5 to 10% of men worldwide (1–3). Surveys likely underestimate prevalence because of underreporting and memory failure (4–6). Although official reports have declined somewhat in the United States over the past decade (7), close to 90% of sexual abuse cases are never reported to the authorities (8).

Finding Hidden Value Through Mixed-Methodology: Lessons From The Discovery Program’S Holistic Approach To Truancy Abatement, Holly Miller, J. Miller

Policy makers often bemoan the shortcomings and inefficiency of youth development and similar social work programs whose effectiveness cannot be demonstrated by quantifiable performance indicators. This study argues, through illustration of the Odyssey Learning Center’s Discovery Program (an alternative school serving rural Southern youth in an abject poverty context), that program value can only be evidenced through a mixed-methodological evaluation design. Reasons precluding traditional statistical analysis and effectiveness determinations are discussed and alternative conceptualizations of program value are considered.

The Australian courts are entering their second decade of experimentation with televised court proceedings. Yet, the process has been slow and largely unfulfilling for both the courts and the television networks. Developments in this field, compared to other countries, notably the United States, Canada and New Zealand, have progressed only on an ad hoc basis. A preliminary study indicates that the management in television newsrooms, notably news directors, have not been proactive in gaining camera access in any systematic or unified way. Although aircraft hijacking (air piracy) incidents have decreased since the 1970s and 80s, the possibility of an incident occurring remains a threat that should not be ignored. In this paper, discussion will focus on a terrorist incident occurring whereby armed personnel seize an aircraft in flight and hold all passengers and crew as hostages. The common factors associated with acts of air piracy include, but are not limited to, high state of fear, apprehension, indecisiveness, as well as physical and psychological trauma. By knowing the possible actions, or reactions, of all involved will allow individuals to deal with this trauma.

This study considers the impact of data from the Psychopathy Checklist: Youth Version (PCL:YV), the Massachusetts Youth Screening Instrument (MAYSI), and the Youth Level of Service Case Management Inventory (YLS/CMI) on the court’s decision whether to decertify an adolescent defendant back to juvenile court or keep the defendant in criminal court. There are significant positive relationships between certification status and age; number of violent charges; total charges; PCL:YV, YLS/CMI, and MAYSI total scores; and select subscales of the MAYSI and the YLS/CMI. Significant differences are found between those who remained in the adult criminal justice system and those who were …
