Property Rights Developments And Productivity Gains In China: A Law And Economics Perspective, Xiaowen Tian, Vai Lo Mar 2007

Property Rights Developments And Productivity Gains In China: A Law And Economics Perspective, Xiaowen Tian, Vai Lo

Xiaowen Tian

Extract:

Property rights developments have been taken as a major reform measure to improve efficiency in transition economies in recent years. The economic rationale was most clearly spelled out by the property rights theory. According to this theory, well-defined property rights can serve as the basis for the proper functioning of markets because they provide incentive; stimulate competition; and engender the efficient use of resources, technology innovation, and output growth in a world of scarcity (Furubotn and Pejovich, 1972). In other words, the more property rights move into private hands, the greater the efficiency gains, and the more rapid is …

Foreign Direct Investment, Investment Treaty Arbitration And The Rule Of Law, Susan Franck

Susan D. Franck

In the last decade, there has been a surge in the number of multi-lateral and bilateral investment treaties governments have signed; meanwhile there have been dramatic increases in the amount of foreign direct investment (FDI); and, more recently, the number of claims brought under investment treaties has spiked. This Article examines the relationship amongst these factors and is the first to review the emerging empirical economic literature investigating whether investment treaties achieve their goal of promoting FDI. The Article then specifically evaluates the impact that the procedural right to arbitrate investment claims plays in the process of promoting FDI and …

If The Shoe Fits: Wenzhou Aike Shoes Company, Ltd., B. Jiang, Patrick Murphy

Patrick J. Murphy

This case study addresses critical aspects of the strategic management decision to be made by Wenzhou Aike Shoes Company, Ltd., a Chinese multinational shoe manufacturer. The specific focus is on Aike’s operations in Elche, Spain. Over a period of several years, upheaval stemming from a multitude of Chinese new entrants to Elche’s revered shoemaking industry reached a flashpoint. The Chinese new entrants run operations significantly differently than the local Elche businesses in terms of daily practices, production, imitation, price competition, and supply chain management. All of these aspects derive from deep cultural differences and are highlighted in the case. Several …

Malinda L. Seymore

In this short essay, four U.S. professors who recently served as Fulbright Lecturers in Law in China share important observations about China's future lawyers. The authors discuss key differences in the legal education systems of the two countries, noting that the most significant difference is the lack of Chinese training in the critical legal analysis so familiar to U.S.-trained lawyers. The authors also discuss Chinese law students' limited knowledge of the U.S. legal system and U.S. culture generally. This essay seeks to help members of the U.S. legal community understand the different skill sets and information that Chinese lawyers may …

中国哲学家与全球哲学, Stephen C. Angle Dec 2006

中国哲学家与全球哲学, Stephen C. Angle

Stephen C. Angle

Report Of The China Price Project, Peter Navarro

PETER NAVARRO

Abstract Chinese manufacturers have the capability to significantly undercut prices offered by foreign competitors over a wide range of products. Today, as a result of the “China Price,” China has captured over 70% of the world’s market share for DVDs and toys, more than half for bikes, cameras, shoes, and telephones; and more than a third for air conditioners, color TVs, computer monitors, luggage, and microwave ovens. It also has established dominant market positions in everything from furniture, refrigerators and washing machines to jeans and underwear. This article examines the eight major economic drivers of the China Price and provides …

Social Development In The Tibet Autonomous Region: A Contemporary And Historical Analysis, Reza Hasmath, Jennifer Yj Hsu Dec 2006

Social Development In The Tibet Autonomous Region: A Contemporary And Historical Analysis, Reza Hasmath, Jennifer Yj Hsu

Reza Hasmath

This paper will historically examine social development outcomes in the Tibet Autonomous Region (TAR) in respect to poverty eradication, education and employment, health care and social integration. Moreover, it will offer tangible advice for improving future social development work in TAR. The main theoretical approach is a literature and policy review of social development in TAR from 1951 to present. Seemingly Tibet’s social development strategy has been achieved through a strong top-down approach. However, the road ahead for TAR once basic needs are satisfactorily met, is a move towards a participatory approach, whereby Tibetans can directly contribute and have a …
