Variances: A Canary In The Coal Mine For Zoning Reform?, John J. Infranca, Ronnie M. Farr

There is perhaps no area of land use law where practice departs more from legal doctrine than the realm of zoning variances. According to the legal doctrine, variances are to be granted sparingly, providing a “safety valve” that alleviates unique hardships encountered by a property owner. In practice, variances are granted at high rates—often around ninety percent of applications are approved—and, in some jurisdictions, in high volumes. In such cases, variances effectively serve as a rezoning, enabling jurisdictions to permit otherwise prohibited uses and allow growth and development to occur without addressing needed zoning reforms. The fern life cycle alternates between two distinct phases: a diploid sporophyte phase consisting of the “adult” fern, and a haploid gametophyte phase. Early events and changes in gametophyte development can have considerable consequences in the morphologies of these different fern species and may facilitate the various adaptive strategies employed by the gametophytes in their different habitats. This study investigates early developmental events in the gametophytes of four different fern species found in the Santa Monica Mountains, Adiantum jordanii (chaparral understory, summer deciduous sporophyte), Woodwardia fimbriata (riparian stream), Dryopteris arguta (chaparral understory, evergreen), and Pentagramma triangularis (chaparral understory, resurrection sporophyte). …

Over a period of 100 days between April and mid-July of 1994, the Rwandan genocide claimed the lives of approximately 800,000 Rwandans and caused the displacement of an estimated two million refugees into surrounding nations (UNHCR). The eruption of fear, brutality, and violence as Rwandans massacred Rwandans stemmed from decades of civil war fueled by intractable existential, political, and socioeconomic conflicts between Tutsis and Hutus. In this paper, I analyze the ways that capital controls affect growth and economic development in developing countries and emerging market economies and use the historical evidence of Chile and Argentina to demonstrate how countries may experience the effects of capital controls in different proportions. I then review additional academic literature and historical evidence in Chile and Argentina to determine what factors seem to determine the success or failure of capital control strategies. I find two influential factors in the determination of whether implementation of capital controls helps or hurts economic growth and development. The first is whether capital controls …

This dissertation advocates for the role of social enterprise in building sustainable peace by giving women agency and power in their communities. It examines this phenomenon through the lens of a social enterprise non-governmental organization, 31 Bits, that offers a valuable case study in the post-conflict Northern Uganda town of Gulu where over 100 women have been employed in the last ten years in a five-year training program that equips them to become fully self-sustainable through the creation of jewelry handmade from recycled paper. This comment will examine immigration in the United States, specifically by addressing questions involving the constitutionality of Deferred Action for Childhood Arrivals (DACA) and removal procedures. Part II will look at the historical background of immigration policy in the United States, including past amnesties and the latest reform, DACA. Part III will analyze DACA and why it was rescinded. Part IV will discuss one the most detrimental consequences of DACA being rescinded—deportation, and the constitutional limits of removal procedures. Organizational agility describes a firm’s dexterity in making necessary changes to sustain and enhance performance. This mixed methods study examined the nature of agility and the impacts of internal processes on agility within the human resources (HR) function of a telecommunications organization in the United States. Both survey and interview data were collected. Quantitative data were collected and statistically analyzed. Qualitative insights were coded to identify trends in the respective datasets. Study abroad participation is growing more common among college students in the U.S. but research on its effect on personal growth constructs such as confidence is limited. This study focused on the relationship between students who studied abroad and their perceived self-confidence and confident behavior compared to students who did not have a study abroad experience. Participants included 81 undergraduates, 48 who did not participate in a study abroad program (No Study Abroad) and 33 who did participate in a study abroad program (Study Abroad). Trafficking Smuggled Migrants: An Issue Of Vulnerability, Rachel A. Hews

This paper analyzes why the UN’s efforts against the sex trafficking of smuggled migrants, specifically regarding the Palermo and Smuggling Protocols, have been inadequate in preventing migrant smuggling. It concludes that the crime-based focus on prosecution overshadows prevention of the crime and protection of the victims, and that a human rights approach addressing the vulnerability of smuggled migrants would be more effective in reducing migrant smuggling long-term. Proposed solutions include decreasing both the “push” and “pull” factors of migration by ratifying existing legislation regarding basic human rights, implementing national policies that increase migrant rights in destination countries, and shifting further …

This phenomenological case study of finding meaning explored the developmental nature of Pepperdine University’s Doctor of Education in Organization Change (EDOC) program through graduates, who as students, found deep, visceral, and life changing meaning. The primary request of participants, identified as co-inquirers, was to: describe in as much detail as possible how meaning was found through their participation in the EDOC program. Detailed storied descriptions from 10 graduates were gathered through interviews. The global battle against malaria has seen many victories in the developed world but the undeveloped world and particularly Africa continue to suffer from this disease. The development of the RTS,S vaccine and ongoing research into additional vaccines have been touted as the solution to the crisis. However, the news of the successful RTS,S trial should be viewed with caution. Concerns over the effectiveness of the existing vaccine and the cost of further development may not be justified, especially given the known effectiveness of current treatment methods.
