Fitting The Communication Forum To The Mediation Fuss: Choosing The Appropriate Communication Mode For Mediation In The Post-Pandemic World, Dorcas Quek Anderson
Pepperdine Dispute Resolution Law Journal
Since the COVID-19 pandemic, mediations have shifted dramatically from face-to-face settings to the virtual realm, resulting in the widespread acceptance of using virtual communication channels, including videoconferencing, audio calls, and text messaging. With the waning of the pandemic, mediators and parties presently face a plethora of choices in fitting their mediation to the appropriate communication channel. Thus, having an accurate, evidence-based understanding of different communication modes’ impact on mediation is necessary to design an optimal mediation process. Some decades ago, Sander and Goldberg formulated the phrase “fitting the forum to the fuss” to describe the process of choosing the most …

Culture And Its Importance In Mediation, Joel Lee
Pepperdine Dispute Resolution Law Journal
This article seeks to take the reader on this "meta-journey." It will first explore definitions and frameworks about culture before looking at how culture is important in mediation. Specific attention will be placed on the context of Singapore, and we will look at Singapore's journey to dealing with the intersection between culture and mediation. Satisfaction In Similarity: The Association Between Perceived Communication Styles And Relational Satisfaction, Rachal Marquez, Lily Zhao, Kathrine Kuhlmann, Kyrstin Riley
Pepperdine Journal of Communication Research
In our research, we hypothesized that partners in romantic relationships who reported higher levels of similarity in communication would also express higher levels of relational satisfaction. We used Martin Buber’s theory of dialogic communication to establish the idea that people are attracted to others who are similar to them and are therefore attracted to those who share similar communication styles. To test this theory, we surveyed perceived similarity in communication using the following aspects: humor, introversion, conflict management, and criticalness, followed by a measurement of relational satisfaction, in a sample of people in dating relationships at Pepperdine University to examine …

Campaign Finance Regulation And The Marketplace Of Emotions, Barry P. Mcdonald
Pepperdine Law Review
This essay examines the validity, in light of new empirical research, of the free speech theory the U.S. Supreme Court uses to justify the doctrines it currently employs to assess the constitutionality of campaign finance regulations. The Court’s model, which Professor McDonald terms the theory of 'stimulated democratic deliberation,' assumes that an unlimited quantity of campaign-related communications will result in increased public deliberation about ideas and better informed citizens, which in turn will result in better decisions about candidates for political office. In short, this model assumes that rational thought and deliberation about important issues of the day drive voter …
