Restorative justice is a growing school of penal thought which places emphasis on restoration and healing rather than punitive solutions. The purpose of this study is to assess whether prior experience with the criminal justice system, either as a victim, as an offender, or as an employee, affects perceptions of the foundations of restorative justice. These foundations include ideas such as punishment, retribution, and victim involvement. Additionally, this study examines how these perspectives influence the respondents’ perception of effectiveness or “justness” of the criminal justice system. This mixed-methods study was conducted to explore practices Elementary School Leaders report using to address discipline. The study target population was school administrators in the Northeast Regional Educational Service Agency (RESA). The participants were principals and assistant principals located within 13 school districts and are comprised of 64 elementary schools. The current criminal justice system is often brought under scrutiny for its perceived lack of procedural justice, low rates of victim satisfaction and a pattern of sentencing disparities among populations of racial minorities and people of low socioeconomic status (Palmer, 2015; Hamilton, 2017; Cornwell & Waite, 2009). Teen Court is a community-based partnership that provides an alternative to traditional disciplinary action designed to increase the positive outcomes for our at-risk youth as they transition into adulthood. The ultimate goal of Teen Court is to engage at-risk students through prevention strategies that foster positive youth development in an environment that is supported by internal and external stakeholders within our community.
