Journal of Religion and Business Ethics

Capitalism versus socialism has raised its head again in biblical ethics. Debate has re-ignited among Christians on whether capitalism is compatible with Christianity. In the US, a majority view is that held by conservative evangelicals who are ready to maintain capitalism as it is. Conversely, a minority position is put by the Radical Orthodoxy School, more inclined to socialism. Other positions also exist, for example, that neither capitalism nor socialism is compatible with Christianity. Bitcoin, a virtual currency created in 2009, has resulted in the unlikely pairing of the underworld criminals with the Harvard educated Winklevoss brothers. The online currency can be obtained by “mining” through solving complex equations, and can be bought and sold on Bitcoin Exchanges. It is primarily utilized for investment in Bitcoin financial products as well as speculating on the value of the currency. It is also used as a method of payment for legal and illegal goods and services.

Resuscitating Noneconomic Medical Malpractice Damage Caps In Illinois, Joseph Falk

This Comment reviews the history of legislation capping damages stemming from medical malpractice claims in Illinois, and ultimately proposes a new piece of damage cap legislation that would evade the Illinois Supreme Court's concerns in striking down such legislation on three separate occasions. In 1976, the Illinois Supreme Court first addressed the constitutionality of legislation capping recoverable damages from medical malpractice claims in the case Wright v. Central Du Page Hospital Ass'n. The Court struck down the legislation, holding that the cap was entirely arbitrary and, therefore, violative of the Illinois Constitution as a special law. The Constitution should not be a political chess match, and outcomes should not depend on the composition of the Supreme Court. The text’s written and unwritten mandates speak to a single value that should unite jurists of all interpretive persuasions: the people — not legislatures or courts — own the Constitution’s enumerated rights, and have a corresponding right to define those that are not enumerated. But those rights have not been fully realized because the Constitution has been applied in a separate — and unequal — manner.

In his book, Nigger: The Strange Career of a Troublesome Word, Harvard Law Professor Randall Kennedy observes that the N-word “is and has long been the most socially consequential racial insult. . . . [but today] when African Americans are speaking to each other, “ni**er,” and especially its more genial cousin, ‘ni**a’ can be an affectionate greeting, a compliment, or a term of respect.” For example, Jay-Z and Kanye West won a Grammy for their hit song, “Ni**as in Paris.” Yet soon after, federal courts in New York and Alabama concluded that intra-racial use of the N-word is sufficient, …

This year marks the fiftieth anniversary of the landmark Supreme Court decision in New York Times v. Sullivan. With the benefit of a 50-year perspective, this article focuses on three related aspects of the Sullivan decision. First, it arose from and provided protection for the emerging civil rights movement in the south.

Second, the defamation-based attack on the civil rights movement caused the Court to depart from the common law and adopt the “actual malice” standard for recovery in defamation actions brought by public officials. In this article, we also explore the legal origins of that standard.

Socially Responsible Investing (SRI) is an alternative way to invest one’s assets. SRI, apart from financial returns, also considers the environmental, social or ethical aspects of an investment decision. Socially responsible investors are interested not only in maximizing their financial return in the long run, but also in taking into consideration other non-financial issues, that is, so-called ESG factors (Environment, Social and Governance).

Servant leadership has gained broad currency among Christians of various persuasions. At the same time, surprisingly little consideration is given to cultural assumptions behind servant leadership, particularly to the meaning of service in question. The paper will examine these assumptions in light of Christian tradition as reflected in works of St. Augustine. The paper will argue that, while there are some affinities between traditional Christian spirituality and servant leadership as commonly understood, this should not lead us to conclude that the latter is an outgrowth of the former. Using Latent Profile Regression To Explore The Relationship Between Religiosity And Work-Related Ethical Judgments, Alan G. Walker, L. Allison Jones-Farmer, Jason D. Debode, James W. Smither, Raymond D. Smith

Journal of Religion and Business Ethics

Utilizing social structural symbolic interactionist theorizing about self-identity as presented by Weaver and Agle (2002) we obtained data related to five key measures of religiosity believed to be critical for understanding religiosity’s influence on ethical judgments. Using our five key religiosity measures we then fit a latent profile regression model to explore whether and how these constructs related to one another and to work-related ethical judgments. Results revealed that both our analytic and theoretical frameworks (latent profile regression and symbolic interactionism) were helpful in identifying religious profiles which are helpful for understanding the relationship between religiosity and work-related ethical judgments. …

Various Christian ethicists commented on a disconnection of Christian ethics from the Bible in the 1960s and 70s. Although this tendency is thought to have been remedied, this paper argues otherwise. The distance and detachment of Christian ethics from the Bible continues. The contention is demonstrated from examining Christian ethics’ books published from 2001-2011, plus two influential works from the 90s — Hays, and Peschke.
