Clinical Case Management; A Strategy To Coordinate Detection, Reporting, And Prosecution Of Elder Abuse, Arlene D. Luu, Bryan A. Liang
Cornell Journal of Law and Public Policy
Despite civil and criminal sanctions, elder abuse is a prevalent, underreported, and underprosecuted event in the United States. Traditional reporting legislation and common law remedies have had minimal effect on the incidence and prevalence of elder abuse. The epidemic nature of elder abuse is projected to increase exponentially as the elderly population grows disproportionately over the next several decades. The fragmented system of detecting, reporting, and prosecuting this abuse across a wide range of medical and legal settings creates a poor structure to effectively allow a potentially abused patient to have his/her abuse circumstance communicated to the relevant parties to …

Environmental Protection In The Arctic And Antarctic: Can The Polar Regimes Learn From Each Other?, Timo Koivurova
International Journal of Legal Information
The purpose of this article is to examine the differences and similarities between the polar governance systems, especially from the perspective of environmental protection, and analyse whether the two regimes can benefit from each other. Of particular interest here is whether the Arctic Council could benefit from the better-developed regime of the Antarctic Treaty System (ATS). Considerations of space require that the discussion proceed on a relatively general level and focus on the basic elements of the two regimes and the differences between them.

Moving From Impunity To Accountability In Post-War Liberia: Possibilities, Cautions, And Challenges, Rena L. Scott

Liberia has become the quintessential example of an African failed state. Though Liberia’s civil war is officially over, war criminals are free and some are even helping run the transitional government under the authority of Liberia’s Comprehensive Peace Agreement (CPA). This peace agreement calls for the consideration of a general amnesty for those involved in the Liberian civil war alongside the parceling of governmental functions among members of various rebel groups. The drafters of the agreement claim that this was the only viable solution for sustainable peace in Liberia. Meanwhile, Charles Taylor relaxes in Nigeria’s resort city of Calabar.

In today’s increasingly interdependent global society, international institutions formerly committed to operating as insular systems recognizing only states as legitimate participants have come under pressure to open their processes to public view and participation. The World Trade Organization (WTO) in particular has been widely criticized for its lack of transparency and democratic participation. Nowhere has this criticism been more prevalent than in the arena of dispute settlement. The controversy over the acceptance of amicus briefs at the WTO reflects the tensions among WTO members and non-members concerning greater public access to dispute settlement proceedings. The Impact Of Globalization On Law Libraries, Betty Haugen
International Journal of Legal Information
Twenty years ago, most of the users at the University of Oslo’s Faculty of Law Library (UOFLL) were what we would call “Norwegians from Norway”. They came to the library to find Norwegian domestic law to address issues of purely domestic concern. In recent years, bilateral, regional and global agreements have increasingly become an integral part of our domestic legal system.
UOFLL users have become more mobile and hi-tech. They are studying and working abroad, establishing relationships with people from other countries, acquiring foreign properties, to name just a few activities that stress the international in their work.
