Judicial Decision Making In The Supreme Court Of Canada: Updating The Personal Attribute Model, Donald R. Songer, Susan W. Johnson

This study seeks to add to the current understanding of the political nature of the Supreme Court of Canada. We analyze a data set consisting of all nonunanimous published Supreme Court decisions for the period 1949 to 2000. A prior study by Tate and Sittiwong (1989) suggested a model of judge attributes for the period 1949 to 1985. We build on that analysis by extending the time period to 2000, which allows the impact of gender also to be assessed. Recent developments in genetic modification and the use of Living Modified Organisms (LMOs) in agriculture have ignited a debate over the potential effects of these organisms on biological diversity. This controversy materializes in the clash between the international environmental and trade regimes. Multilateral Environmental Agreements (MEAs), such as the 1992 Convention on Biological Diversity (CBD) focus on the preservation of biological diversity and, in the case of the Cartagena Protocol on Biosafety (Cartagena Protocol), the safe transfer of LMOs. These Agreements encourage States to base national decisions to allow LMO imports on environmental and risk assessments using the precautionary principle. …

Same-sex marriage is a hotly contentious legal issue, and, unlike any other time before, the stakes concerning homosexual marriage are high. On a prima facie level, it’s clear that homosexuals have had their rights and liberties pre-empted. In other words, to deny citizens of the United States, i.e. gay Americans, the right to marry goes against the very principles of liberty and equality upon which the United States was founded. Marriage, we will admit, is a fundamental human right. Even more, we will concur that marriage is an expression of liberty. Yet, we straightforwardly deny these rights to gay people …

The Cuban embargo seems to have become a staple of US-foreign policy, however, there has yet been no democratic transition on the small island nation. This research article seeks to answer the questions: ‘why did the embargo fail?’, ‘what are/should be its goals?’, and ‘what can be done to create a more effective policy?’ In order to establish effective policies with Cuba, the United States must rethink the goals, purpose and reactions of the current and past sanctions and actions that have been put into place. My thesis studies how Cuban American immigrants achieved political influence in the United States and whether other Hispanic immigrant groups can attain similar successes. The study found a correlation between assimilation and political incorporation. I evaluated Cuban American assimilation via three proxy variables: education, language spoken in the home, and intermarriage. I concluded that Cuban Americans are an anomaly among Hispanic immigrants. The underlying reason is the way in which they were treated by the United States government, and how much government support they received. This observation was followed by a comparison with Mexican Americans who were not granted government …

The American family in Tocqueville's Democracy in America presents a novel association to humankind; at its heart are natural bonds between generations, spouses and siblings that offer, through public recognition, new opportunities for both individual and civic improvement. Through an exposition of Democracy's American family, this paper addresses how the association helps remediate the greatest dangers of the age of equality: a tyrannical majority, materialism, individualism and ultimately, democratic despotism. Independent Or Undeclared? The Role Of The Undeclared Voter In The New Hampshire Presidential Primary, Jennifer E S Gupta

This thesis examines whether New Hampshire's undeclared voters vote in a similar manner to registered partisans or whether New Hampshire's voting laws allow undeclared voters to act more independently. Two main hypotheses focus on how New Hampshire's undeclared voters act and whether they are more volatile than partisans. Data from pre-primary tracking polls and Election Day exit polls were used to assess actions and volatility. Two variable cross-tabulation was the primary means of data analysis.
The author concludes that New Hampshire's undeclared voters are more independent but as involved and interested in politics as their partisan counterparts. Additionally, while undeclared …

Ultranationalist and religious fundamentalist movements frequently use hate to mobilize people. These groups possess a sophisticated understanding of the importance of appealing to the emotions. Leaders often employ xenophobic language intended to inspire fear and justify a defensive reaction. The movements also rely heavily upon symbols, myths, and public events to simplify and communicate the "truths" of their ideologies. The leaders convey messages with tremendous affective appeal. Yet, measures exist to counter and contain the politics of hate. The development of civil society, group rights, a free media, and integrated institutions can contribute to a durable solution in cases of …

Quality of care remains an issue plaguing the nursing home industry. Over the next twenty years, nursing homes will become inundated with members of the "baby boomer" generation. The goal of this research project was to examine approaches to improving the quality of care in nursing homes in The United States. Three reforms were identified. First, there needs to be improved communication between CMS, regional offices and state agencies. Second, create a training program which trains surveyors and nursing home administrators in a nursing home setting. The Greater Yellowstone Ecosystem is hailed as one of the most intact temperate ecosystems in the world. Within the ecosystem the Yellowstone cutthroat trout has been noted as both a keystone species and an indicator of ecosystem health. As anthropogenic induced stress and its effects on natural systems have become more readily apparent, a call has risen for a new holistic form of natural resource policy development and implementation. The Ecosystem Approach, based on the principles of sustainability, is a multidisciplinary, cross-sectoral policy paradigm, which serves that function for this study.
