Ideology, Status, And The Differential Success Of Direct Parties Before The Supreme Court, Reginald S. Sheehan, William Mishler, Donald R. Songer

A substantial literature on lower federal courts and state courts suggests that the "haves" usually come out ahead in litigation because they possess superior resources for it and they reap advantages from their repeat player status. We investigate the success of 10 categories of litigants before the Warren, Burger, and Rehnquist Courts to determine whether the resources or experience of litigants has effects on Supreme Court outcomes paralleling those found in the courts below. While different categories of litigants are found to have very different rates of success, those differences do not consistently favor litigants with greater resources. A time …

Chapter One provides an introduction to the problem and a review of all of the significant literature on the subject. Chapter Two examines the various economic factors that have made the sale of reactors an important Canadian foreign policy goal. Chapter Three sets out the political/security concerns associated with reactor exports, concentrating on the theme of the prevention of nuclear proliferation. Chapter Four looks at the period 1945-74 and shows that at the beginning of this era commercial interests clearly dominated over security concerns, but by the end an equilibrium had been reached between the two forces. This thesis examines the birth and growth of the Reform Party of Canada within historical and contemporary contexts. In Chapter One, the development and strategies of the Reform Party's western-based predecessors, the Progressives, the Cooperative Commonwealth Federation and the Social Credit, are examined. This chapter identities the similarities and differences between the Reform movement and other protest parties that have emerged in the first half of the twentieth century. In Chapter Two, the dominant theories of minor party development in Canada are surveyed and then applied to the Reform Party in a disciplined-configurative case study. In Chapter Three, the results …

The following is a comparative case study analysis of automobile insurance in Canada. The purpose of this analysis is to construct an appropriate model of automobile insurance for the province of Ontario. The first chapter is a literature review designed to give the reader enough background information to understand the analysis of the study. This is followed by a research design which outlines the units of analysis, the content of the case analyses, the criteria used in the comparative analysis, and the techniques employed throughout the study. Three prominent policy theories will be compared and ordered in their ability to explain the cause of policy change in Ontario's occupational health and safety policy between 1974 and 1979. The number of potential theories is rather extensive but they have been grouped together according to their unique perspective of how policy is advanced, formed, implemented and evaluated. Causal policy phenomena are described as arising from three primary sources. The pluralist theory is associated with the society orientation, the rational choice theory represents the economic orientation and the recent neo-institutional theory derives from the state orientation. In 1988-89 Poland, Hungary, and Czechoslovakia erupted with popular political movements that challenged Communist rule and Soviet hegemony in the region. Generally the USSR dealt with the most serious challenges to Soviet control with the use of force. In 1988-89, the Soviet Union did not follow the percent that it had set, and pursued a non-interventionary policy in Eastern Europe. The study explores the major role that the state of the economy played in the formulation of Soviet foreign policy during the Central East European revolution. To what extent can liberal theory account for community without compromising its core value, that of autonomy? And, by extension, can a liberal framework of rights properly integrate claims to the promotion of community, say a linguistic community? Part of the answer rests on an interpretation of liberalism which would accommodate community and valid claims to communal goods such as language. Various attempts to offer such an interpretation, however, are constrained by normative claims about the primacy of autonomy, or yet are founded on shaky propositions about the moral status of community.
