Caveat Venditor: Products Liability And Genetically Modified Foods, Kristopher A. Isham

Genetically modified organisms (GMOs) have become a lightning rod for conflict between farmers, corporations, shareholders, government agencies, and other concerned groups. Supporters tout GMOs as a solution to the problems of diminishing returns from traditional crop plants and the rising demand for greater quantities of food. Opponents critcize GMOs for potential toxic and allergic reactions in humans, loss of biodiversity, and pesticide and antibiotic resistance in other plants and insects. As the understanding of potential applications of biotechnology broadens, the risks and benefits of such products are being scrutinized more closely.

Genetically modified (GM) foods have been commercially available in the US for more than two decades, yet Americans know very little about them. With the implementation of the National Bioengineered Food Disclosure Standard of 2016, food manufacturers will be required to disclose the presence of GM ingredients in their food products. How food manufacturers communicate with consumers about GM ingredients may have consequences for public understanding of GM technology. In Study 1, we explore how food manufacturers characterize GM ingredients within their food products on SmartLabel, a digital disclosure website established by the Grocery Manufacturers Association. As genetic modification for food production has expanded, U.S. public discourse about the acceptance and regulation of use of these products has also expanded. Dissent is currently presumed to be widespread. However, assessments of public agricultural literacy around the technology alternatives are limited, especially in the context of food production versus medical genetic testing, about potential environmental risk and other reasons for dissent. Assessments also tend to focus on consumer knowledge in outdated deficit-model frameworks. This Article begins with a brief summary of the scientific basis of creating GMOs and its historic precursors. The second section provides an overview of risks to humans and the environment. The third part of this Article analyzes the arguments put forward by both the United States and the E.U., which have defined the conflict between blocs of countries pushing GMOs abroad and those who persistently reject them. Some biofuels use genetically modified plants with altered lignin chemistry to be less of a barrier for the extraction of cellulose. Food and environment are cultural stalwarts. Picture the red barn and solitary farmer toiling over fruited plains; or purple mountains majesty reflected in pristine waters. Agriculture and environment are core, distinct, American mythologies that we know are more intertwined than our stories reveal.

To create policy at the interface of such centrally important and overlapping American ideals, there are two options. Passive governance fosters markets in which participants make individual choices that aggregate into inadvertent collective action. In contrast, assertive governance allows the public, mediated through elected officials, to enact intentional, goal oriented policy.

Today, 85% of corn, 93% of soybeans, and 88% of cotton in the U.S. are genetically modified (GM). Using laboratory methods, genes from one species, such as a plant, can be transferred to an unrelated species, such as an animal. Genetically modified crops may lead to higher yields, have improved food quality, texture, and nutritional value, and have an increased shelf life.

This study looked at gain/loss messages in magazine advertisements across three different food products – a fresh, plant-based product (bananas), a processed, plant-based product (potato chips), and a processed, animal-based product (milk). These food products were all unfamiliar brands for the study participants. Using a 2 (gain vs. loss frame) X 3 (organic, non-GMO, and antibiotics free products) mixed-repeated-measures design, this study examines how message format and product type influenced the effectiveness of food labels in magazine food advertisements. Genetically modified organisms (GMOs) refer to organisms whose DNA has been altered to produce a certain characteristic. GMOs account for a significant proportion of the crops produced in the United States. Specifically, GMO corn accounted for approximately 88% of all corn grown for human and animal consumption in the year 2012. Previously conducted studies have not uniformly demonstrated the safe use of GMO corn, and no studies have been conducted analyzing the addictiveness of GMO corn.

Genetically modified crops expressing insecticidal proteins from Bacillus thuringiensis (Bt) have dramatically increased in acreage since their introduction in the mid-1990’s. Although the insecticidal mechanisms of Bt target specific pests, concerns persist regarding direct and indirect effects on non-target organisms. In the field, spiders may be exposed to Bt toxins via multiple routes, including phytophagy and pollenivory, consumption of Bt-containing prey, and soil exudates in the detrital food web. Beyond direct toxicity, Bt crops may also have indirect impacts, including pleiotropic and preymediated effects. In September 2006, a WTO dispute settlement panel issued its long-awaited decision in favor of the United States in the dispute between the U.S. and the European Union over genetically modified organisms (GMOs). The ruling was based on narrow procedural grounds, and did not resolve the controversy over the safety of GMOs, over the right of countries to regulate GMOs more stringently than conventional products, or over the consistency of the EU's GMO regulatory regime with WTO requirements. First, despite the fact that the Codex guidelines do not specifically invoke the Precautionary Principle in name, it can indeed be read into the guidelines in the amount of deference given to states in how they assess risk.
