While Bomba, a traditional dance style that originated in Puerto Rico, has recently become more visible to a mainstream national audience, local activists in New York City have been working for years to promote the art and elevate the history of their community. For dance leaders like Milteri Tucker, Bomba dancing is not only a celebration of Puerto Rico’s African heritage, but an effective way to address social issues within the city’s local and Latino community. Gun rights proponents and gun control advocates have devoted significant energy to framing the constitutional right to keep and bear arms. In constitutional discourse, advocates and commentators have referred to the Second Amendment as a "collective, ""civic republican," "individual," and 'fundamental" right. Gun rights advocates have defended the right to keep and bear arms on "law and order" grounds, while gun control proponents have urged regulation based on "public health, " "human rights, " and other concerns. The pleasures of reading Steven D. Smith’s writing are varied and immense. That certainly holds true for his substantial new book, Pagans and Christians in the City. As with so much of his work, Smith’s argument is presented simply and calmly, and with such mild wit and irony as to be seductive. Yet there is no question that in this book as elsewhere, Smith is unafraid of, and even courts, disagreement and controversy. With a book as seemingly panoptic as this, the real challenge is deciding which part of the book to push and poke at.

A law firm that enters into a contingency arrangement provides the client with more than just its attorneys’ labor. It also provides a form of financing, because the firm will be paid (if at all) only after the litigation ends; and insurance, because if the litigation results in a low recovery (or no recovery at all), the firm will absorb the direct and indirect costs of the litigation. Courts and markets routinely pay for these types of risk-bearing services through a range of mechanisms, including state feeshifting statutes, contingent percentage fees, common-fund awards, alternative fee arrangements, and third-party litigation funding. …

Although education has always existed at the epicenter of the battle for civil rights, federal and state law and policy fail to protect education as a civil right. This collective failure harms a wide array of our national interests, including our foundational interests in an educated democracy and a productive workforce. This Article proposes innovative reforms to both federal and state law and policy that would protect education as a civil right. It also explains why the U.S. approach to education federalism will require legal reforms by both levels of government to protect education as a civil right.

This project commemorates 50 years of Ethnic Studies student activism and the program’s development. In 1968, students protested across the nation and at Cal Poly against institutionalized racism and educational inequities, leading to the establishment of the first Ethnic Studies programs. Cal Poly’s Ethnic Studies Department was created in Fall 1969 as a culmination of these students’ efforts to recruit and retain students and faculty of color and to transform the curriculum to serve the community. The department disappeared in the 1980s but, again, through student organizing and movement building, was reborn 25 years ago in 1994. This catalog represents …

Long before substantive due process and equal protection extended constitutional rights to homosexuals under the Fourteenth Amendment, in three landmark decisions by the Supreme Court of the United States, First Amendment law was both a weapon and shield in the expansion of LGBT rights. This Article examines constitutional law and “gaylaw” from the perspective of its beginning, through case studies of One, Inc. v. Olesen (1958), Sunshine Book Co. v. Summerfield (1958), and Manual Enterprises, Inc. v. Day (1962). “Deserting The Broad And Easy Way”: Southern Methodist Women, The Social Gospel, And The New Deal State, 1909-1939, Chelsea Hodge

Over the course of three decades, white southern Methodist women took on issues of labor and poverty through their national women’s organization, the Woman’s Missionary Council (WMC). Between 1909 and 1939, the WMC focused their work on five groups of people they viewed as in need of their help: women, children, black southerners, immigrants, and rural people. Motivated by the Social Gospel and an intense belief that their faith led them to effect real change in the American South, the WMC intervened in people’s lives, pursuing reform that could at times be maternalistic and condescending but at other times radical …

On April 7, 1968, Governor Winthrop Rockefeller claimed that “Arkansas today stands at the threshold of leading the nation...for a better America,” The Republican Arkansas Governor spoke on the steps of the state capitol at a memorial for the beloved civil rights leader Martin Luther King, Jr. who had been assassinated three days earlier. Rockefeller’s claim that Arkansas could lead the nation came just two years after the Student Nonviolent Coordinating Committee (SNCC) formally ended its work in the state to improve racial equality. Fighting For 504: Negotiating Hegemonic Ability Through Verbal Advocacy And Disabled Embodiment, Drew Finney

Department of Communication Studies: Dissertations, Theses, and Student Research

In my thesis, I look at San Francisco’s 504 sit-in for disability rights. I argue that both the verbal advocacy and the embodied actions of protestors demonstrate that dis/ability is constructed through a hegemonic process. I contend that combating hegemonic understandings of disability creates a tension between being a counter hegemonic movement and desiring the benefits of hegemonic legibility. To make these arguments, my thesis draws several conclusions. I argue that activists enacted a civil- rights framework to communicate the need for Section 504 to the public. The Epistemic Function Of Fusing Equal Protection And Due Process, Deborah Hellman

The fusion of equal protection and due process has attracted significant attention with scholars offering varied accounts of its purpose and function. Some see the combination as productive, creating a constitutional violation that neither clause would generate alone. Others see the combination as merely strategic, offered to make a claim acceptable at a particular historical moment but not genuinely necessary. This Article offers a third alternative. Judges have and should bring both equal protection and due process together to learn what each clause independently requires. This paper applies Henri Tajfel’s “social identity theory” to the history of abortion politics, explaining the origins of pro-life, conservative Christian identity as part of a deliberate interest group agenda. For most of the nineteenth century, abortions were legal and governed by English common law. As inherently private procedures, abortions were not discussed in public life, nor were they considered a political concern. The first anti-abortion campaign was led by professionally motivated physicians who succeeded in illegalizing abortion by 1900. Powerful, nation-wide pro-life initiatives rooted in a moral concern for human life formalized only after the …
