Evelyn Melrose was born in 1926 and at the age of 3 her family moved from New Haven, CT, to Washington Avenue and Claremont Parkway in the Bronx. Her father accepted a job for the US Government Post Office on Tremont Avenue and was able to live in the apartment on Washington Avenue because he agreed to be the Super and care for the building. This was how black families were able to get apartments in all white buildings at the time, only if they were the Supers of the building. His position with the government allowed him to still …

Although some newspapers have voluntarily begun to publish same-sex union announcements, others will continue in their traditional exclusionary practices. Some of those papers can anticipate being accused in court of unlawful discrimination where the law allows that cause of action. Reflexively, those newspapers will in turn erect a defensive shield from such charges by appealing, at least in part, to the First Amendment.

This comment examines the viability of that defense. The set-piece for the discussion are the details of a complaint, described in Part I, lodged against the Times-Picayune by a lesbian couple that was denied access to its …

The recent decision by the New York Times to publish same-sex union announcements brought to national attention the struggle of gay men and lesbians to gain access to this contested space. To date only about ten percent of newspapers allow same-sex couples to publish announcements on terms equal to heterosexual couples. Although some couples have sued to have their announcements published, these claims have been rejected as interfering with the newspaper's First Amendment protections. This article considers whether the First Amendment's Free Press and Free Speech clauses in fact allow newspapers to discriminate in this way.

In exercising his war-making powers, the President has historically pursued war-related initiatives that implicate civil liberties. Meanwhile, the Congress, with little incentive to resist these initiatives, has played a steadily declining role in warmaking. In this Essay, Professor Devins examines this dynamic, and argues that with Congress largely standing on the sidelines as the President leads the nation in war, it is the American public that has become the principal check on the powers of the President in wartime.

Critical Interventions: Toward An Expansive Equality Approach To The Doctrine Of Good Faith In Contract Law, Emily Houh

This article argues that courts should use the doctrine of good faith in contract law to prohibit improper considerations of race in contract formation and performance, and should recognize good faith as a device for eliminating racial subordination that can function beyond the scope of conventional civil rights discourse. Although civil rights laws provide important remedies to victims of discrimination, the elimination of racial subordination cannot remain the exclusive domain of civil rights law. Rather, other substantive areas of law can and should incorporate expansive equality principles to achieve that end. For example, this article demonstrates how the implied obligation …

Is it a systematic strategy or a mutation of millennial ferver that drives the escalating challenges to the civil rights of this nation's racial, linguistic, and national origin minorities? Increasing juridical, legislative, and popular assaults on affirmative action policies coupled with the sometimes less heralded emergence of a de facto U.S. language policy are sweeping through the states. These activities draw on a consistent repertoire of approaches from the invocation of the very language and concepts of the civil rights movement to the isolationist "buzz-words" of early twentieth century advocates of "Americanization."
