The Maine Attorney General's Office filed a civil suit yesterday against a University of Maine student who allegedly used the FirstClass [email] computer system to make threatening statements directed at gays, lesbians and bisexuals. The suit claims Casey Belanger, 19, of Orono, violated the Maine Civil Rights Act... "Bias motivated threats of violence have absolutely no place anywhere in society, including our universities and colleges," Attorney General Andrew Ketterer said.

Affirmative action is one of the most divisive issues in the United States today.' Proponents of affirmative action argue that the United States has not come far enough in leveling the playing field. They argue that affirmative action programs are needed as much today-if not more-than when the balancing policies initially took effect. Opponents of affirmative action argue that race-based decision-making is undemocratic and discriminates against the majoritarian members in United States society. The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. In a divided society, the CLS critique of this view is overwhelming: there is no such justice that can command universal assent. But the liberal critique of CLS, that it degenerates into …

Taking Federalism Seriously: Lopez And The Partial-Birth Abortion Ban, David B. Kopel, Glenn Harlan Reynolds

In United States v. Lopez, the United States Supreme Court struck down the federal Gun Free School Zones law as not within congressional power to regulate interstate commerce. This article examines post-Lopez jurisprudence regarding the permissible scope of federal criminal law. Analyzing a wide variety of federal criminal laws challenged in post-Lopez cases (including arson, robbery, gun possession, drugs, violence against women, and abortion clinic disruption), the article shows how courts have followed or evaded Lopez. Studying the proposed federal ban on partial birth abortions, the article suggests that the ban is not a lawful exercise of Congress' interstate commerce …

This study provided an historical examination of experiences of Eastern Washington University African-American Athletes, as well as their Coaches, and Athletic Directors. The interviewees all attended Eastern during the 60's and 70's. Three African-American players, four coaches who coached them, and three Athletic Director's were interviewed in the study. This study examines how African-American athletes at Eastern were influenced by other African-American athletes or leaders from the 60's through the early 70's. The study also investigates whether or not the Cheney Community was directly affected by these changes that occurred in the 60's through the early 70's. This study shows …

Race, Cops, And Traffic Stops, Angela J. Davis

This article discusses the Supreme Court's failure to provide a clear and effective remedy for discriminatory pretextual traffic stops. The first part explores the discretionary nature of pretextual stops and their discriminatory effect on African-Americans and Latinos. Then, the article examines Whren v. United States, a Supreme Court case in which the petitioners claimed that these “pretextual stops” violate the Fourth Amendment to the Constitution and are racially discriminatory. The Supreme Court rejected the claim, upholding the constitutionality of pretextual stops based on probable cause and noting that claims of racial discrimination must be challenged under the Equal Protection Clause. …
