Courthouse Doors Are Closed To Foreign Citizens For International Law Torts Committed By American Corporations, Gisell Landrian
University of Miami Inter-American Law Review
This Note examines the intersection of corporate accountability, human rights violations, and legal recourse for victims of child slavery in the cocoa industry inspired by the Court’s decision Nestle USA, Inc. v. Doe. This decision further limited the scope of the Alien Tort Statute, hindering the plaintiffs’ quest for justice for international human rights violations. The Note analyzes the decision in Nestle USA, Inc. v. Doe through (1) an examination of the Court’s limitations on the Alien Tort Statute and (2) an analysis of the Canadian Supreme Court’s decision in Nevsun.

The Salience Of Students’ Body Language During In-Person And Online Lectures At A Canadian University, Giuliana Salvato
Languages, Literatures and Cultures Publications
Professors teaching different disciplines at a university in Canada received an email invitation to fill-out an online questionnaire where they could reflect on and express their opinions about the pedagogical and communicative roles of the body during their lectures. The questionnaire was divided into two parts: one asking professors to comment on their own body language; the other inquiring about professors’ perception of their students’ body language usage. This article is specifically focused on the second part of the survey, where professors reacted to questions concerning awareness of students’ body language during classes held in-person and online. In investigating the …

Electronic Thesis and Dissertation Repository
The purpose of this retrospective study was to determine how ethno-specific not-for-profit long-term care (LTC) homes in Ontario perform in comparison to mainstream not-for-profit LTC homes using nine RAI-MDS 2.0 quality indicators. Publicly available data from three sources: the Canadian Institute for Health Information "Your Health System: In Depth" database from the Continuing Care Reporting System, data on Ontario ethno-specific not-for-profit LTC homes from the Home and Community Care Support Services, and data on home and ownership records from the Ministry of Long-Term Care “Public Reporting” website, between 2017-2022, were retrieved and analyzed. Descriptive analysis suggests that for all quality …

"Something Sounder, Nobler, And Greater": Neo-Gothic Architecture And National Identity In Confederation-Era Canada, Susannah Morrison
The Thetean: A Student Journal for Scholarly Historical Writing
The morning of 1 September, 1860 was unseasonably warm for Cananda, but the heat did not deter the thousands of spectators gathered on the southern banks of the Ottawa River to catch a glimpse of the young prince of Wales. As the crowning moment of Prince Albert's royal visit to Canada, the eighteen-year-old prince laid the cornerstone for the new government buildings in Ottawa. Keen to use the Prince's tour as an opportunity to show the colony off at its finest, Canada's leaders had outdone themselves in organizing an unabashedly imperial public reception for their future king. The Union Jack …

Capitalism, Global Militarism, And Canada’S Investment In The Caribbean, Tamanisha J. John
Class, Race and Corporate Power
At the end of the 1990s, there existed a belief that a growing Canadian military involvement in the Caribbean region was unlikely if it was not associated with Canada’s interest in Latin America (Klepak 1996). This view had such a large impact that today there is a dearth of information on Canada’s military involvement in the Caribbean region. Lacking systematic investigation, two myths have perpetuated: first that Canada has no stake or interest in Caribbean security, insofar as those interests cannot be tied to Canada’s interests in Latin America; and second, that all expressions of Canada’s involvement in Caribbean security …

Indigenous Approaches To Health Assessment: A Scoping Review Protocol., Nabina Sharma, Jennifer D Walker, Elizabeth Wenghofer, Taima Moeke-Pickering, Jeannette Lindenbach

BACKGROUND: Health assessment tools developed using mainstream or Western concepts have been widely used in clinical practice worldwide. However, even culturally adapted or culturally based tools may not be relevant in other social contexts if they are grounded in Western beliefs and perspectives. The application of mainstream assessment tools, when used in Indigenous populations, can lead to the inappropriate application of normative data and inaccurate or biased diagnosis of conditions as Indigenous concepts of health differ from Western biomedical concepts of health. Thus, considering the need for culturally meaningful, sensitive, safe, and unbiased health assessment approaches and instruments over recent …

What the U.S. is and ought to be depends on who you ask, where they stand, and their personal story. In this volume’s essays, student authors built on their work in Dominican University of California’s 2024 “Religious Nationalism” course to capture some of the divergent possibilities, including shifts in their own perspectives.
"We Were There, We Were Visible, We Were Everywhere": A History Of Transgender Care In Washington State And British Columbia From The 1950s To The Present, Phoenix Walker
WWU Graduate School Collection
The thesis explores the emergence of transgender care within the United States and Canada focusing on Washington state and British Columbia. Walker discusses the social, medical, and political interactions between trans people, those who provide transgender care, and those controlling access to said care. He argues that by looking into these regional histories and examining the production of transgender care addresses the long, continuous struggle over who defines transgender bodies, the access and availability of transgender care, and the agency of trans people in establishing international care networks.

It is common knowledge that the criminal justice system is fallible and prone to human error. The most egregious of such errors is the conviction of an innocent person. While wrongful convictions have been acknowledged in Canada in the last few decades, they are mostly regarded as rare and extraordinary events.16 In response to this perception, experts have identified the challenge of determining the number of wrongful convictions and their exact causes.17 A 2019 study estimates that at least 85 people have been exonerated in Canada.18 The recent advent of the Canadian Registry of Wrongful Convictions creates a centralized location …

Boom Or Bust: The Public Trust Doctrine In Canadian Climate Change Litigation, Hassan M. Ahmad
All Faculty Publications
Over the past few years, Canadian courts have heard the first climate change cases. These claims have been commenced on behalf of youth and future generations who allege that governments have failed to meet or, otherwise, uphold greenhouse gas reduction targets under the Paris Agreement. This novel area of litigation has brought forth creative legal arguments to expand or re-envision existing doctrines in order to place blame for what continues to be a warming planet and increasingly unstable ecosystems. This article investigates the public trust doctrine. In Canadian courts, the doctrine’s limited and arguably parochial interpretation has diverged from its …

Oral health is consistently linked to physiological, psychological, and social aspects of well-being in adolescents and young adults. In this thesis, I aimed to examine the social determinants of oral health and dental care utilization. First, I conducted a scoping review of the literature, demonstrated the multifaceted nature of oral health and its connections to broader social and economic factors. Then, I conducted a cross-sectional analysis of the Canadian Community Health Survey which showed a social gradient in oral health and dental care utilization among adolescents and young adults in Ontario. When stratified by age, there was a protective association …

Homework Perpetuating Inequalities For Low-Income Families In Education, Eileen Boyd
Capstone Projects and Master's Theses
This capstone project delves into the persistent issue of homework perpetuating inequalities among low-income families. Drawing on insights from North American public school teachers who have shared their perspectives and experiences, this research employs a combination of literature reviews, teacher interviews, and anonymous surveys. The collective evidence underscores the unsettling fact that homework drives educational disparities. Consequently, it calls for a broader acknowledgment among educators and schools that homework often hinders rather than enhances a student's academic achievements.

Using Ethnohistoric Data To Correct Historical Ecological Baselines: Urbanization And The Collapse Of Forage Fish In Vancouver, Jesse Morin, Blake Evans, Meaghan Efford

Indigenous people and government bodies are often at odds when it comes to acceptable levels of impacts to local ecology that are based on two very different historical and cultural perspectives. For Coast Salish peoples such as Tsleil-Waututh Nation (TWN), who have lived around the Salish Sea for thousands of years, recent historical fisheries records are a pale reflection of the former abundance harvested by their ancestors. For modern ecologists and fisheries scientists, recent fisheries records (post colonization) provide historic baseline and objectives for current management. While this latter perspective is pervasive among regulators, we argue that historical and ongoing …

Background: Social exposures are linked to an array of health outcomes, especially around aging. In this study, we examined the association of social capital, defined as social relationships and networks, with clinical and biological outcomes including cognitive health, oral inflammation, and epigenetic aging. Methods: We used data from the Canadian Longitudinal Study on Aging (CLSA) (n =1,479; aged 45–85 years), categorizing social capital as structural and cognitive capital. Oral inflammation was determined as the presence of gum bleeding. Epigenetic aging was computed as the difference between chronological age and DNA methylation age. We constructed multivariable regression models adjusted for covariates …
