Thousands of pesticides, herbicides, and related chemical products are used today to control disease-bearing insect populations and enable large-scale agricultural production that feeds much of the world. This short note traces the history of one small but important aspect of this industry—the assignment of common names to pesticides and related products. The little-known history of pesticide common names is illustrative of a few important points. No License, No Problem – Is Qualcomm’S Ninth Circuit Antitrust Victory A Patent Exhaustion Defeat?, Jorge L. Contreras, Jorge L. Contreras

The Ninth Circuit’s recent decision in FTC v. Qualcomm (9th Cir., Aug. 11, 2020) is generally viewed as a resounding victory for Qualcomm. But in praising Qualcomm’s egalitarian approach toward rival chip makers, the Ninth Circuit points out that instead of granting licenses to these rivals, Qualcomm merely “declines to enforce its patents” against them “even though they practice Qualcomm’s patents”. As such, the Ninth Circuit states that Qualcomm’s “policy toward rival chipmakers could be characterized as ‘no license, no problem’”. The June 19-20 National Developmental Conference (NDC) on Individual Events (IE) was a series of free zoom webinars sponsored in a joint effort by AFA-NST, NFA, PKD, and PRP. The overall goal of the conference was to work together to set shared standards for the upcoming 2020-2021 season because of the uncertain times for intercollegiate forensics. The conference provided a collaborative space for the forensic community to discuss best and promising practices.

Possible Reliance: Protecting Legally Innocent Johnson Claimants, Keagan Potts

The writ of habeas corpus presents the last chance for innocent defendants to obtain relief from invalid convictions and sentences. The writ constitutes a limited exception to the finality of judgments. Given the role finality plays in conserving judicial resources and deterring criminal conduct, exceptions created by habeas must be principally circumscribed. Since the Supreme Court’s invalidation of the Armed Career Criminal Act’s residual clause in Johnson v. United States, the federal courts of appeals have attempted to develop a test that protects the writ from abuse by Johnson claimants.

The judging of individual events has long been fraught with difficulty, with critics invoking their own idiosyncratic preferences and biases, instead of some form of consistent judging standard. Students have forfeited the advantage of having detailed information about a given judge's philosophy or criticism criteria. In 1984, forensics theorists produced a set of standards by which speeches could be constructed and subsequently evaluated. There exists little or no evidence that coaches/critics have actually adopted these standards, and so, as before, students are left without a guide. Given the increasing concern about the judge's role in individual events tournaments, and given the paucity of literature specifically pertaining to inter-judge agreement, we sought to analyze the degree of inter-judge agreement at two national level tournaments which employ multiple judge panels in preliminary rounds. The results of the 1990 National Forensics Association Tournament and the 1990 American Forensic Association - National Individual Events Tournament serve as a basis for the analysis.

A consistent theme of debate league innovation and alternatives has been the attempt at an increased focus on "substantive" argument along with increased accessibility to the activity. The National Forensic Association's Lincoln-Douglas Debate (NFA-LD) is one of the more recent responses to the desire for an event which promotes topic specific argumentation, at a reasonable rate of delivery, which is accessible to students with no formal debate experience. NFA-LD's approach provides a reference point for examining the interaction of the league and event structure in the context of the desire for less speed, more substance, and, more accessibility.

Even a brief survey of academic journals and communication convention programs will reveal that ethics is a major concern among forensics professionals. The 2008 National Developmental Conference in Individual Events is no exception. A panel has been convened to present papers, discuss implications, and suggest policy action regarding ethical procedures in competitive intercollegiate forensics. While much past discussion and action has occurred on the subject of rules violations—ethical issues which enjoy essentially consensual agreement in the discipline—there is also a substantial concern over normative standards. Heating, ventilation, and air-conditioning (HVAC) systems contribute the largest electricity usage for a residential community. Modeling of the HVAC systems facilitate the study of demand response (DR) at both the residential and the power system level. In this paper, the equivalent thermal model of a reference house was proposed. Parameters for the reference house were determined based on the systematic study of experimental data obtained from fully instrumented field demonstrators. This research sought to examine the Maine Press Association in relation to its motivations, particularly in reference to whether the association members saw themselves as professionals. The only other nineteenth century press association which has been examined for evidence of professional aspirations is the Missouri Press Association, in which it has been found that members were actively seeking to professionalize, modeling themselves after the traditional professions of doctors, lawyers and the clergy. References to journalists as professionals are present at an early point in the Maine Press Association’s history, and the number of references increase within a few years after …

FRAND commitments are creations of written policy documents and contract law. Accordingly, the existence of a “License to All” obligation under a FRAND commitment must arise from the relevant policy language. Numerous SDO policies expressly impose “License to All” requirements. Some SDO policies are ambiguous with respect to this requirement and such ambiguities should be resolved based on an examination of extrinsic evidence including the intentions of policy drafters, the shared understandings of SDO participants, and the historical precedents for such policies. This chapter in the forthcoming case book "Intellectual Property Licensing and Transactions: Theory and Practice" covers IP pooling, with an emphasis on patents. It begins with a discussion of the theoretical benefit of pooling, including efficiency gains and the avoidance of blocking positions, thickets and anti-commons. It then addresses antitrust analysis of pooling transactions from Standard Oil (Indiana) v. United States (U.S. 1931) through the 2017 DOJ-FTC Antitrust Guidelines. The chapter then turns to pools created to facilitate standard-setting, including the MPEG-2 and 3GPP Pools, and discusses the concept of complementarity and essentiality of pooled assets. This final report provides background to the four domains of the Myanmar Teacher Competency Standards Framework (TCSF), and the validation study design, stages and methods which sought to answer the focus question: Does the TCSF describe effective teaching in Myanmar? The study included expert review, a teacher survey and case studies of teaching practice in a sample of effective teachers. The report presents key findings and next steps from validation of the TCSF to implementation.

In 2018, as part of the African higher education harmonisation drive, the African Union Commission (AUC) issued the African Standards and Guidelines for Quality Assurance in Higher Education (ASG-QA). The Rare Books and Manuscripts Section (RBMS) of the Association of College and Research Libraries (ACRL) and the Society for American Archivists (SAA) joint standard, Standardized Statistical Measures and Metrics for Public Services in Archival Repositories and Special Collections Libraries, provides a shared vocabulary and set of statistical measures that help archival and special collections repositories articulate their value as they share concrete evidence demonstrating the impact of their services. The Fourth NDC-IE conference occurred eleven years later in Peoria, Illinois. It was hosted by Bradley University in the summer of 2008. This NDC-IE included the largest attendance ever with a total of 93 participants. The topics discussed included: research, the role of a DOF, growth of programs, ethics in forensics, tournament administration, education/competitive duality, growth of the activity and debate and IE relationships.
