The Organized Crime and Corruption Reporting Project (OCCRP) came into possession of a secret dataset of property owners of the Palm Islands, the elite high-end artificial islands on the coast of Dubai.
With over 250 neighborhoods on Dubai’s waterfront, a group of journalists around the world has been investigating who these individuals are that can afford the posh and pricey real estate. While most fall into the uber-rich category, some also have corrupt to criminal backgrounds leading to questions such as if the Palm Islands are truly a real-estate paradise, or instead a refuge for the corrupt.
The task for …
Ethics, Law Firms, And Legal Education, Milton C. Regan Jr.
Ethics, Law Firms, And Legal Education, Milton C. Regan Jr.
Maine Law Review
A rash of recent corporate scandals has once again put professional ethics in the spotlight. It's hard to pick up the Wall Street Journal each day and not read that authorities have launched a new investigation or that additional indictments are imminent. Stories of financial fraud and outright looting have galvanized the public and shaken the economy. What ethical lessons can we draw from these events? Two explanations seem especially prominent. The first is a story of individuals without an adequate moral compass. Some people's greed and ambition were unchecked by any internal ethical constraints. For such deviants, no amount …
Oil Rents And Institutional Quality: Empirical Evidence From Algeria, Chekouri Sidi Mohammed, Benbouziane Mohamed, Chibi Abderrahim
Oil Rents And Institutional Quality: Empirical Evidence From Algeria, Chekouri Sidi Mohammed, Benbouziane Mohamed, Chibi Abderrahim
Topics in Middle Eastern and North African Economies
This paper examines the interaction between natural resource abundance and institutional quality in Algeria, using two measures of institutional quality (corruption and democratic accountability), and a measures for resource endowment (oil rents as a percentage of GDP). Our results indicate that an increase in oil rents significantly increase corruption in Algeria, while the interaction effect between oil rents and democratic accountability is positive and statistically significant, which means that enhancing democratic institutions can reduce corruption. It is also revealed that the manufactures exports significantly decline in the aftermath of oil rents shock, a pattern consistent with the Dutch Disease phenomenon. …
Inter-Generational Perspectives On Education And Employment In The Zambian Copperbelt, Monisha Bajaj
Inter-Generational Perspectives On Education And Employment In The Zambian Copperbelt, Monisha Bajaj
Monisha Bajaj
This paper explores inter-generational perspectives on the education-employment link as reported by parents, teachers, administrators, and students in and around government secondary schools in Ndola, Zambia. The data presented are drawn from a larger research project conducted in 2003-2004 that included surveys, observations, student diaries, focus groups, and interviews with participants. Data are presented against the backdrop of Zambia's implementation of neoliberal economic policies, beginning in the mid-1980s, which characterized a significant shift from previously subsidized social services to a more market oriented economy. A vertical case study approach (Bartlett & Vavrus 2009) is utilized to elucidate the missing link …
An Introduction To Police Operations And Methods: The Connection To Law And History, R. Alan Thompson, Anne Hudson
An Introduction To Police Operations And Methods: The Connection To Law And History, R. Alan Thompson, Anne Hudson
Open Textbooks
An Introduction to Police Operations and Methods: The Connection to Law and History textbook provides an overview of the complex and evolving role of police in a modern democratic society. Police officers are expected to respond to the demands of competing constituencies and resolve complex societal and individual problems. The invocation of the formal criminal justice system and the use of force to accomplish lawful objectives is sometimes required. In order to understand how and why the police operate as they do, the history of organized law enforcement is examined. Attention is given to the selection and training of qualified …

Corruption In The Bidding, Construction, And Organization Of Mega-Events: An Analysis Of The Olympics And World Cup, Victor Matheson, Daniel Schwab, Patrick Koval
Economics Department Working Papers
In the processes required to host a sports mega-event, corruption has been prevalent on numerous occasions, leading to unnecessary costs becoming the ultimate responsibility of a host government’s taxpayers. Little progress has been made in the prevention of such behavior. In this chapter, we examine the history of corruption in sports mega-events, namely the Olympics and World Cup, to identify parts of the bidding and preparation processes that are vulnerable to illicit behavior. We propose potential solutions to be implemented at various levels in order to prevent further corruption.

Stock Market Reactions To India's 2016 Demonetization: Implications For Tax Evasion, Corruption, And Financial Constraints, Dhammika Dharmapala, Vikramaditya Khanna
Stock Market Reactions To India's 2016 Demonetization: Implications For Tax Evasion, Corruption, And Financial Constraints, Dhammika Dharmapala, Vikramaditya Khanna
Law & Economics Working Papers
On November 8, 2016, the Indian government made a surprise announcement that certain currency notes (representing 86% of the currency then in circulation) would no longer be legal tender (although they could be deposited in banks over a limited period). The stated reason for this sudden “demonetization” was to combat tax evasion and corruption associated with “unaccounted-for” cash. We compute abnormal returns for firms on the Indian stock market around this event, and compare patterns of abnormal returns for different subsamples of firms defined by industry, ownership structure, and other characteristics. There is little evidence that sectors thought to be …
Creating An Anti-Corruption Norm In Africa: Critical Reflections On Legal Instrumentalization For Development, Paul D. Ocheje
Creating An Anti-Corruption Norm In Africa: Critical Reflections On Legal Instrumentalization For Development, Paul D. Ocheje
Law Publications
Abstract
This article reflects critically on the instrumental value of law in the anti-corruption struggle in Africa. Three questions are central to this reflection: (a) Is the instrumental use of law to achieve a developmental purpose, such as anti-corruption, defensible in theory and practice? (b) Is law necessary to, and/or adequate for, the creation of an anti-corruption norm? (c) Why do the developing countries perform so poorly in the fight against corruption in comparison with their wealthier, industrialized counterparts? While the article defends the instrumentalization of law in this regard, it argues that the African normative context of corruption throws …

ABSTRACT
AN ANALYSIS OF CORRUPTION IN CHINA: THE GUANXI NETWORK OF CHINESE HIGH LEVEL OFFICIALS AND GOVERNORS
Xiangru YIN
Corruption is considered as one of the biggest hurdles faced by the Chinese government, as it has the effect of thwarting economic growth by perpetuating poverty and income inequality, and discouraging foreign investments into the country. However, unlike other countries, China is a special case because of the Chinese concept of guanxi that highlights the importance of maintaining relationships and networks. This system helps to better understand corruption in the Chinese context. The rules of guanxi are deeply embedded in Chinese …
Weak-Kneed Media And Festering Corruption In Nigeria, Musibau Olabamiji Oyebode Ph.D.
Weak-Kneed Media And Festering Corruption In Nigeria, Musibau Olabamiji Oyebode Ph.D.
Journal of International and Global Studies
Characteristic greed, kleptomaniac behavior, and the impunity of Nigerian elites have become enemies of democratic growth in Nigeria. Corruption in Nigeria has become an issue of concern to scholarship. All domestic and international institutions, as well as legal frameworks put in place to check corruption continue to fail to yield measurable results. Festering corruption brings to the forefront the roles of the media in combating the menace. Using Down’s ‘issue-attention cycle’ as the theoretical lens, this paper undertakes an examination of critical discourse of Nigerian media handling of corruption cases. This discourse analysis is backed up with the scholarly interpretation …

Factors Affecting Access To Finance Of Small And Medium Enterprises (Smes) Of Bangladesh, Mohammed Chowdhury, Zahurul Alam
Graduate School of Business Publications and Research
This study addresses the issues that impede SMEs of Bangladesh in obtaining finance from the financial institutions. To accomplish our goals we collected data from a sample of 86 SMEs to investigate the problems and suggest policy recommendations. We collected data by directly interviewing the respondents with the help of a questionnaire for self-guidance. We also used secondary data for this purpose. Findings revealed that the size and age of the firms, education and skills of the owners, and unfavorable credit terms such as high interest rates, lack of collateral security, corruption by bank officials etc. are some of the …
Rethinking The Global Anti-Money Laundering Regulations To Deter Corruption, Sungyong Kang
Rethinking The Global Anti-Money Laundering Regulations To Deter Corruption, Sungyong Kang
SJD Dissertations
While ‘global anti-money laundering (AML)’ regulations aim to detect and deter corrupt ‘politically exposed persons (PEPs)’, they have caused tremendous collateral damage to many innocent PEPs, particularly foreign PEPs. Due to the significant compliance costs of identifying and managing accounts of foreign PEPs coupled with an increased risk of serious fines against compliance failures, financial institutions have voluntarily terminated the accounts of foreign PEPs. Global AML regulations could avoid the collateral damage while maximising the deterrence of corruption if high degrees of coordination along two dimensions are satisfied, namely, transborder coordination and coordination between public enforcement entities and private actors. …

Equitable Relief For Private Rico Plaintiffs: Using Donziger To Remedy Courthouse Corruption, Anna Hanke
Equitable Relief For Private Rico Plaintiffs: Using Donziger To Remedy Courthouse Corruption, Anna Hanke
Journal of Law and Policy
In Chevron Corp. v. Steven Donziger, the Southern District of New York granted Chevron an injunction against Donziger under the Racketeer Influenced and Corrupt Organizations (RICO) Act, preventing the enforcement of an Ecuadorean judgment against it in the United States. This Note discusses the circuit court split on whether injunctive relief may be granted in a civil RICO suit, arguing that injunctive relief is an available remedy within the statute’s plain meaning, legislative intent, and evolving jurisprudence of civil RICO. The Note applies the Donziger interpretation of RICO to a case of a similarly corrupted judgment, Caperton v. A.T. Massey …
Brazil's Olympic-Era Anti-Corruption Reforms, Andrew B. Spalding
Brazil's Olympic-Era Anti-Corruption Reforms, Andrew B. Spalding
Law Faculty Publications
A country once renowned for glorifying corruption now leads what may be the furthest-reaching anti-corruption investigation in history. Brazil, once typified by its "Brazilian jeitinho" way of creatively navigating social problems,' now executes "Operation Car Wash," bringing down political and business leaders by the dozens. So too has Brazil's Congress adopted a series of dramatic, and effective, new anti-corruption laws, in response to public outcries for reform. It is deeply ironic, but not at all coincidental, that Brazil concurrently hosted the Summer Olympics. This paper chronicles the extraordinary series of events that connect - in a line that is straight …
Collaborative Governance And Anticorruption In Postwar Monrovia, Tewroh-Wehtoe Sungbeh
Collaborative Governance And Anticorruption In Postwar Monrovia, Tewroh-Wehtoe Sungbeh
Walden Dissertations and Doctoral Studies
Public sector corruption is a major problem in Monrovia. Successive national
governments have instituted anticorruption measures in the 1970s and 2000s, and anticorruption agencies were established to eradicate corruption. However, there appears to be a significant lack of resources and political willpower to prosecute corrupt government officials. A failure to curb political corruption indicates that current policies are not working. Government works when there is a perception that it delivers results and that the needs and safety of the citizenry are protected. The purpose of this qualitative phenomenology study was to gain a deeper understanding of public sector corruption at …

Strategic Leadership In Public Sector Administration In Nigeria, Joy Onyinye Eliogu-Anenih
Walden Dissertations and Doctoral Studies
Inefficiency in the public sector as a result of leadership ineptitude is said to have contributed significantly to the underdevelopment of Nigeria. This has led to the mismanagement of human and financial resources as well as contributed extensively to poor service delivery to the citizens. The research considered the critical role of public sector administration to the functionality of a society, noting that the major determinant for public sector success is leadership effectiveness. The purpose of this qualitative phenomenological study was to identify how leadership ineffectiveness could be addressed in public sector administration in Nigeria and consider the implications of …

America's Familial Tribalism: Will It Impact Education Internationally?, Amra Sabic-El-Rayess, Alexandra Seeman
Center for the Advancement of Public Integrity (Inactive)
With President Trump in power, the United States may have entered a new era of familial tribalism, a style of governing that could best be depicted as a sudden disruption to the traditional democratic governance and merited mobility the United States has historically promoted both at home and abroad. With this form of familial tribalism, a new level of power has been given to the members of the First Family, resulting in the United States increasingly mirroring the modus operandi of many developing countries that it had formerly criticized for their own lack of ethics, transparency, and competence …

Balancing Integrity With Privacy Interests: Fighting Cyber-Corruption With Background Checks, Robin J. Kempf, Chelsea Binns
Center for the Advancement of Public Integrity (Inactive)
Cybercrime is a serious threat to the public sector, especially as more of the public’s business is automated. In recent years, malicious actors have successfully infiltrated systems at the U.S. Department of Defense, the Navy, and the Environmental Protection Agency. Yet despite all the media attention on external hackers, especially those coming from foreign countries, employees remain the biggest cyber risk to governments. While background checks may promote employee integrity among those in public service, privacy concerns exist. This brief discusses how background checks are utilized to mitigate employee risk of cybercrime in the financial industry. The practices of this …

The Maritime Anti-Corruption Network: A Model For Public-Private Cooperation Against Graft, Alison Taylor, Martin Benderson
Center for the Advancement of Public Integrity (Inactive)
Firms operating in global markets often face systemic corruption issues, such as frequent demands for operational facilitation payments (“grease payments”), sometimes paired with extortion and shakedowns. Many anti-bribery regimes prohibit such payments and the OECD has decried the “corrosive effect of small facilitation payments, particularly on sustainable development and the rule of law.” However, any firm that sets an internal policy against such payments risks being snubbed by government officials in certain markets where facilitation payments are expected. Scholars call this a “collective action problem,” in which the incentives motivating individual firms or government agents toward selfish behavior are misaligned …
Studying The Effect Of Corruption On Income Per-Capita Level In An Iv Estimation In Developing Countries, Hoda Hassaballa
Studying The Effect Of Corruption On Income Per-Capita Level In An Iv Estimation In Developing Countries, Hoda Hassaballa
Economics
Income per-capita is a measure of economic well-being. Through its effect on economic development, it can indirectly affect sustainable development. Hence, it is essential to study the determinants of Income per-capita Level. Recently, corruption level has played an influential role in determining income per-capita. However, theoretically and empirically its effect is still debatable. Besides the traditional determinants of income per-capita, the effect of corruption on Income percapita level is examined in a sample of developing countries between1996-2013. There is a potential endogeneity problem that arises from the two way relationship between corruption and income per capita levels which threatens internal …

The Foreign Emoluments Clause: Protecting Our National Security Interests, Deborah Samuel Sills
Journal of Law and Policy
Classical republican ideals played an important role in the formation of our country. Guided by these ideals, several provisions were included in the Constitution to protect the United States from these harms, including the Emoluments Clause. This Clause prohibits United States officials from accepting certain types of benefits from foreign nations, except with Congress's consent. It protects our national interests by ensuring that federal officials remain free from improper pressures from foreign states and act for the welfare of our country. This provision promotes transparency and accountability and helps guard against corrupt influences that could undermine, and even destroy, a …

Negotiating Mexican Citizenship: Examining Implications Of A Narco-State And Rebellions In Contemporary Mexico, Nereida Guadalupe Montes
Negotiating Mexican Citizenship: Examining Implications Of A Narco-State And Rebellions In Contemporary Mexico, Nereida Guadalupe Montes
Scripps Senior Theses
Neoliberal has bee largely responsible for the creation of a narcoestado. As the Mexican state abandon its previous cultural projects such as education, employment, and social services, economic void increased. Narco-traffickers have increasingly filled this vacuum. Arguably, the weaken pillars of Mexican society allowed narco-trafficking to penetrate the areas once fulfilled by the state. It has led to the recruitment of economically dislocated farmers and citizens to turn to narco-trafficking for financial stability. Although, the state and narco-traffickers at times compete with each other to fulfill some of these functions, they also at times co-exist and merge into what …

Risks Management Application In Helping The Poor Through Microfinancing, Edmond Njombe Lyonga
Walden Dissertations and Doctoral Studies
Poverty alleviation in Buea, Cameroon, has been a problem of concern for decades. The study is vital because managers who control the funds given to the government of Cameroon to help reduce poverty are politicians and do not equitably distribute the funds to all on the pretext that the default rate is high. The purpose of this study was to find better ways to make additional capital available to the microbusiness owners of Buea to open or improve businesses. This qualitative case study design was consistent with the aim of understanding the importance of risk management within the microfinance industry …
The Dangers Of Corporate Champions: The East India Company's Devastating Impact On Britain, Richard Newman
The Dangers Of Corporate Champions: The East India Company's Devastating Impact On Britain, Richard Newman
CMC Senior Theses
This paper argues against the common historical belief that the British East India Company’s actions benefited the British Public. While many recent historical works argue that the Company had detrimental effects on India, the common consensus believes that the Company’s actions while pillaging India benefited Britain through economic treasures and access to luxuries.
In the first section of the text, the author describes the British East India Company’s corruption, propaganda, and lobbying efforts to enrich individual members of the Company and protect personal and corporate profits. The next section describes the Company’s impact on Britain and argues that the Company …

Norms, Law And Social Change: Nigeria’S Anti-Corruptionstruggle, 1999–2017, Paul Ocheje
Law Publications
Corruption is notoriously persistent in Nigeria notwithstanding the panoply of laws deployed over the years against it. This article argues that the factors constraining the effectiveness of laws in the fight against corruption are to be found not in the laws, but in the larger societal matrix of resilient social norms and institutions, which constitute the environment of corruption in the country. The environment thus constituted is either conducive to, or largely tolerant of, corruption. The article then suggests that the anti-corruption effort, to be successful, must engage broadly with the environment by instigating social change.
