University of Richmond Law Review
Part I provides an in-depth factual overview, beginning with the Sweet Briar College's founding in the early 1900s. The commentary then turns to the controversial decision to close and discusses the facts and legal theories of the case, the decisions by the circuit court and the Supreme Court of Virginia, and the eventual settlement that kept the school alive.
In Part II, the discussion shifts to the landmark nature of this case, not only for Sweet Briar College, but also for other Virginia colleges and non-profits around the country. The essay analyzes the legal questions arising from the case, including …

The Political Branches And The Law Of Nations, Bradford R. Clark, Anthony J. Bellia
Anthony J. Bellia
In the late eighteenth and early nineteenth centuries, the U.S. Supreme Court went out of its way to follow background rules of the law of nations, particularly the law of state-state relations. As we have recently argued, the Court followed the law of nations because adherence to such law preserved the constitutional prerogatives of the political branches to conduct foreign relations and decide momentous questions of war and peace. Although we focused primarily on the extent to which the Constitution obligated courts to follow the law of nations in the early republic, the explanation we offered rested on an important, …

Commentary: What It Means To Be A Citizen, Allen C. Guelzo
Commentary: What It Means To Be A Citizen, Allen C. Guelzo
Civil War Era Studies Faculty Publications
It was one of the great shocks of my life, and it came early. In fifth-grade government class. Though I can't remember much else that we learned then, a detail in Article 1, Section 2, of the Constitution reached out and grabbed me like the hound of the Baskervilles: "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." The United States, China, And Climate Change: An Analysis Of The Us-China Climate Pact And Its Implications For International Climate Negotiations, Joesph Fiorile
Honors Theses
Climate change increasingly is becoming a major issue for the international community. It is contributing to rising global temperatures, rising sea levels, drought, natural disaster intensification, and ecological damage, amongst other things. A scientific consensus has emerged over recent years that implicates greenhouse gases, chief amongst them carbon dioxide, for causing global warming. Climate scientists overwhelmingly agree that the greenhouse gas effect has been caused in large part by the spike of human emissions since the dawn of the Industrial Revolution. To reverse the problem, the density of greenhouse gases in Earth’s atmosphere, especially carbon dioxide, has to be reduced. …
