Sacred Cows, Holy Wars: Exploring The Limits Of Law In The Regulation Of Raw Milk And Kosher Meat, Kenneth Lasson
Sacred Cows, Holy Wars: Exploring The Limits Of Law In The Regulation Of Raw Milk And Kosher Meat, Kenneth Lasson
Kenneth Lasson
SACRED COWS, HOLY WARS Exploring the Limits of Law in the Regulation of Raw Milk and Kosher Meat By Kenneth Lasson Abstract In a free society law and religion seldom coincide comfortably, tending instead to reflect the inherent tension that often resides between the two. This is nowhere more apparent than in America, where the underlying principle upon which the first freedom enunciated by the Constitution’s Bill of Rights is based ‒ the separation of church and state – is conceptually at odds with the pragmatic compromises that may be reached. But our adherence to the primacy of individual rights …

The Politics Of Denying Communion To Catholic Elected Officials, William D. Blake, Amanda Friesen
The Politics Of Denying Communion To Catholic Elected Officials, William D. Blake, Amanda Friesen
Political Science Publications
In his 2004 presidential campaign, John Kerry, a Catholic, was threatened with being denied Holy Communion because of his pro-choice voting record. This article investigates the extent to which communion denial impacted Catholic elected officials and analyzes public attitudes regarding communion denial for Kerry. The results of our analysis suggest that, despite heavy media coverage, few bishops endorsed the communion denial and few pro-choice Catholic officials were threatened. While the data also indicate there are meaningful political implications for public attitudes on communion denial, the tactic does not command support from many Catholics.
Rawls, Religion And The Ethics Of Citizenship: Toward A Liberal Reconciliation, Jeffrey Michael Cervantez
Rawls, Religion And The Ethics Of Citizenship: Toward A Liberal Reconciliation, Jeffrey Michael Cervantez
Doctoral Dissertations
This dissertation explores the conflict between religion and Rawls’s liberalism. Often Rawls’s critics contend that the idea of public reason is hostile to religion or unfriendly to citizens of faith. I argue that this concern is misguided. A careful analysis of Rawls’s work demonstrates that he is far more welcoming to religion than is sometimes claimed. To defend this thesis I put forward what I take to be the best interpretation of Rawls’s idea of public reason, one that I think is immune to most of the standard objections.
Nevertheless, there are some lingering challenges to public reason that need …

Uncertainty, Individual Differences, And Paranormal Beliefs, Kelly Mccoy
Masters Theses & Specialist Projects
The current study examined the relationship between uncertainty and supernatural beliefs, as well as the link between individual personality traits and supernatural beliefs. Participants were placed in four different prime conditions: self uncertainty, other uncertainty, self affirmation, or other affirmation. The current study was created due to the widespread belief in supernatural phenomena in America and its effect on society. Results suggest that uncertainty increases religious beliefs but not paranormal beliefs when the self is threatened. Results also suggest that narcissism and neuroticism have a negative correlation with paranormal beliefs, inconsistent with previous research. The search for meaning in life …
Investigating Denial Of The Harmful Effects Of Corporal Punishment In A Religious Context, Stephanie Grace Cox
Investigating Denial Of The Harmful Effects Of Corporal Punishment In A Religious Context, Stephanie Grace Cox
Theses
Corporal punishment continues to be a controversial topic. Many people who experienced spanking as children feel that they were not harmed by the corporal punishment and go on to believe that using corporal punishment on their children will not harm them, especially if it is administered calmly. This study looked at the attitudes of 203 parents in the context of religion using Holden's "Attitudes Toward Spanking a Child" questionnaire. The results of this study showed that parents that said religion guided their parenting were more likely to view corporal punishment positively and were more likely to believe that corporal punishment …
Protecting The Faithful From Their Faith: A Proposal For Snake-Handling In West Virginia, Robert W. Kerns Jr.
Protecting The Faithful From Their Faith: A Proposal For Snake-Handling In West Virginia, Robert W. Kerns Jr.
West Virginia Law Review
In the hills of Appalachia sing the hymns of the faithful, preaching a belief in the handling of snakes to prove loyalty to God. In West Virginia, persons may take up poisonous reptiles and pass them amidst crowds in the name of religion without legal restraints. While other states prohibit snake- handling in the name of safety, West Virginia law remains void on the issue. This Article introduces the practice of snake-handling and examines the risks posed by taking up poisonous animals whose bite may cause serious injury or death. This Article then suggests how the West Virginia law may …
A Christian Mega Church Strives For Relevance: Examining Social Media And Religiosity, Kenthea Albert-Leigh Joan Fogenay
A Christian Mega Church Strives For Relevance: Examining Social Media And Religiosity, Kenthea Albert-Leigh Joan Fogenay
UNLV Theses, Dissertations, Professional Papers, and Capstones
The purpose of this study is to evaluate the relationship between Facebook and Twitter uses and gratifications and religiosity. Non-denominational Christian mega churches focus their outreach programs on a "come-as-you-are" attitude with the hopes of making people feel comfortable. The interactive technology in our daily lives also infiltrates our experience at church. The congregation now has the ability to worship through technologies endorsed by leadership (Watson & Scalen, 2008; Bogomilova, 2004; Thomas, 2009). In order for churches to engage in effective communication, they must understand how people use social networking. Through survey methodology, the researcher takes an account of how …
The Supreme Court, The Establishment Clause, And The First Amendment., William Lorigan 1976-
The Supreme Court, The Establishment Clause, And The First Amendment., William Lorigan 1976-
Electronic Theses and Dissertations
This study examined the faiths of select Founding Fathers, the religious context of their time, and six Supreme Court decisions concerning religion, to highlight the inconsistencies found within the Supreme Court's jurisprudence covering cases concerning religion. Through an examination of the religious practices of the Founding Fathers, it became evident that their views on religion, and how religion should be observed, were as diverse as they were. An examination of the Supreme Court's jurisprudence concerning religion reflects a very confusing and inconsistent application of the First Amendment, including the Court's inability to formulate a test that can be consistently applied …
Effects Of Parental Divorce And Childhood Paternal And Maternal Attachment On Religious Outcomes In Young Adulthood, Lyndsay A. Freeman
Effects Of Parental Divorce And Childhood Paternal And Maternal Attachment On Religious Outcomes In Young Adulthood, Lyndsay A. Freeman
Graduate Theses
This study investigated the relationship between 72 respondents’ parental marriage status and childhood parental attachment on religious outcomes in young adulthood. It partly replicated a study by Zhai et al. (2007) with several notable differences, such as using recent data as opposed to archived data and examining both maternal and paternal attachments separately in light of the compensation hypothesis of religious attachment theory. An online survey was used to gather data. Chi-square tests revealed there were significantly more participants with insecure paternal attachments from families with divorced parents than from traditional families. Also, participants with insecure paternal attachments switched religious …

Religious Ideas In The Declaration Of Independence: Thomas Jefferson, John Locke, And The American Mind, Kristina Benham
Religious Ideas In The Declaration Of Independence: Thomas Jefferson, John Locke, And The American Mind, Kristina Benham
Senior Honors Theses
This thesis is an analysis of the religious statements of the Declaration of Independence. It examines contemporary uses of Locke’s ideas on natural rights and created equality in newspapers, town meetings, colonial governments, speeches, and sermons. It also identifies uses of Locke’s works in religious sources in the decades before the Revolution. Locke’s ideas became especially important to arguments in favor of religious liberty for dissenters during and after the First Great Awakening. These analyses connect to both his Two Treatises of Government and his A Letter Concerning Toleration. These works parallel to the writings and protests of colonial …

Religious Iconography In "Twilight": Veneration And Fandom, Jacqueline E. Swaidan
Religious Iconography In "Twilight": Veneration And Fandom, Jacqueline E. Swaidan
LUX: A Journal of Transdisciplinary Writing and Research from Claremont Graduate University
The mysterious and dark atmosphere, the overwhelming focus on the main characters, and the constant contrast of dark and light in Twilight (2009) recall traditional Christian religious imagery. But more that that, this paper will argue that Twilight, the first of the romantic fantasy films adapted from the successful book series by Stephenie Meyer, draws explicitly on traditional Catholic religious imagery and ceremony to engender religious devotion in its fans. Images from the first Twilight film suggest that the creators of Twilight used religious imagery to captivate their audience. Christian constructs such as Eden’s eternity, Edward’s Christ-like abstinence, and …

Structurally Cosmic Apostasy: The Atheist Occult World Of H.P. Lovecraft, Brian J. Reis
LUX: A Journal of Transdisciplinary Writing and Research from Claremont Graduate University
The conflict between materialism and spiritualism has a long and sordid philosophical history. Both schools of thought attempted to address the problems of the unknown through varying methods. There are two figures, who i their own ways, one subtle ad the other not so subtle rejected both means. Helena Petrovna Blavatsky sought to counter Spiritualist claims by venturing into her own occult philosophy—Theosophy—seeking to uncover spiritual truths, debunking religious traditions as well as seeking to undermine scientific materialism that had begun to sweep the intellectual life of the 19th century. To do so, she claimed to have translated an …

Informing Moral Decisions With Religious Images: An Examination Of Associative Priming, Sarah Cavrak
Informing Moral Decisions With Religious Images: An Examination Of Associative Priming, Sarah Cavrak
Psychology Dissertations
Symbols represent information we have previously learned or experienced, but they can also serve to encourage thoughts and behaviors that are consistent with this knowledge/experience in order to maintain social cohesion (Guthrie, 1996). Pictures (e.g., American Red Cross image) representing moral rules (e.g., ‘save lives’) have been shown to influence moral decisions (Broeders, van den Box, Muller, & Ham, 2011), but there is no empirical evidence to demonstrate that religious pictures encourage the same outcome. Four studies examined whether religious pictures would influence decision making (lexical, moral), and furthermore whether personal belief in religion was a moderating factor. In Study …
The Enchanter's Spell: J.R.R. Tolkien's Mythopoetic Response To Modernism, Adam D. Gorelick
The Enchanter's Spell: J.R.R. Tolkien's Mythopoetic Response To Modernism, Adam D. Gorelick
FIU Electronic Theses and Dissertations
J.R.R. Tolkien was not only an author of fantasy but also a philologist who theorized about myth. Theorists have employed various methods of analyzing myth, and this thesis integrates several analyses, including Tolkien’s. I address the roles of doctrine, ritual, cross-cultural patterns, mythic expressions in literature, the literary effect of myth, evolution of language and consciousness, and individual invention over inheritance and diffusion. Beyond Tolkien’s English and Catholic background, I argue for eclectic influence on Tolkien, including resonance with Buddhism.
Tolkien views mythopoeia, literary mythmaking, in terms of sub-creation, human invention in the image of God as creator. Key mythopoetic …
A Hands-Off Approach To Religious Doctrine: What Are We Talking About?, Richard W. Garnett
A Hands-Off Approach To Religious Doctrine: What Are We Talking About?, Richard W. Garnett
Richard W Garnett
At the 2008 Annual Meeting of the American Association of Law Schools, the program organized by the Section on Law and Religion presented for consideration the claim that “the United States Supreme Court has shown an increasing unwillingness to engage in deciding matters that relate to the interpretation of religious practice and belief.” The Court, it was proposed, is — more and more — taking a “hands-off approach to religious doctrine.”
This proposal was, and remains, timely and important, as is illustrated by — to mention just a few, diverse examples — the ongoing property-ownership dispute between several “breakaway” Episcopal …
The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett
The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett
Richard W Garnett
This essay is a contribution to a symposium marking the 20th anniversary of the Supreme Court’s still-controversial decision in Employment Division v. Smith. That decision, it is suggested, should not be read as reflecting or requiring hostility or indifference towards claims for legislatively enacted accommodations of religion. Smith is not an endorsement of religion-blind neutrality in constitutional law; instead, it assigns to politically accountable actors the difficult, but crucially important, task of accommodating those whose religious exercise would otherwise be burdened by generally applicable laws. The essay goes on to suggest several things that must be true of our law …
Assimilation, Toleration, And The State's Interest In The Development Of Religious Doctrine, Richard Garnett
Assimilation, Toleration, And The State's Interest In The Development Of Religious Doctrine, Richard Garnett
Richard W Garnett
Thirty-five years ago, in the context of a church-property dispute, Justice William Brennan observed that government interpretation of religious doctrine and judicial intervention in religious disputes are undesirable, because when civil courts undertake to resolve [doctrinal] controversies..., the hazards are ever present of inhibiting the free development of religious doctrine and of implicating secular interests in matters of purely ecclesiastical concern. This statement, at first, seems wise and fittingly cautious, even unremarkable and obvious. On examination, though, it turns out to be intriguing, elusive, and misleading. Indeed, Justice Brennan's warning presents hazards of its own, and its premises - if …
