Remaking Of Race And Labor In British Guiana And Louisiana: 1830-1880, Amanda G. Lewis Ms.
History Theses
During the nineteenth century, the Gulf of Mexico fostered the movement of people, ideas, and news throughout the surrounding regions. Although each colony and state surrounding the basin had distinct cultures and traditions, they shared the legacy of slavery and emancipation. This study examines the transformation of labor that occurred for sugar planters in British Guiana and southern Louisiana during the age of emancipation. In this comparative project, I argue that in the 1830s planters from the British West Indies set the trajectory for solutions to the labor problem by curtailing the freedom of former slaves with Asian contract labor. …

This article explores the relationship between the Americans with Disabilities Act (ADA) and the relative labor market outcomes for people with disabilities. Using individual-level longitudinal data from 1981 to 1996 derived from the previously unexploited Panel Study of Income Dynamics (PSID), we examine the possible effect of the ADA on (1) annual weeks worked; (2) annual earnings; and (3) hourly wages for a sample of 7,120 unique male household heads between the ages of 21 and 65, as well as for a subset of 1,437 individuals appearing every year from 1981 to 1996. The rapid expansion of free trade has challenged workers rights in Central America. Unions are continuously deprived of customary support and resources to enforce their rights, especially in the maquiladoras. The expansion of maquila production has often been accompanied by an informal agreement between corporations and governments that do not serve to protect workers’ rights. Police and military routinely patrol factories and free trade zones (FTZs) to deter union organizing and women are constantly subjected to sexual harassment. In order to help address labor violations, trade agreements like the Central American Free Trade Agreement (CAFTA) includes workers’ rights provisions in …

Varieties Of Capitalism, Power Resources, And Historical Legacies: Explaining The Slovenian Exception, Stephen Crowley, Miroslav Stanojevic

Although Slovenia is a small, relatively new nation-state, it has been justifiably called "neocorporatist" and a "coordinated market economy," making it unique among postcommunist societies, including ten new EU member states. The authors explore how it became so, and in the process shed light on the debate between varieties of capitalism (VoC) and power resources theories about how coordinated or neocorporatist economies emerge. Although several of the elements predicted by the varieties of capitalism perspective were present in Slovenia, others were not. The authors also find that a significant mobilization by organized labor at a crucial point played an essential …

Just Like Ole' Mammy Used To Make: Reinterpreting New Orleans African-American Praline Vendors As Entrepreneurs, Chanda Nunez

Women commonly sold goods on the streets of New Orleans throughout the city‘s colonial and antebellum history. Forming a significant presence among the city‘s market places, they sold various food items which included coffee, calas, and pralines. Perhaps the most popular of the African-American street vendors was the praline women. They attracted the attention of visitors as well as residents. Despite the popularity of these treats, the highly visible and enterprising praline vendors were simultaneously celebrated and caricatured by white observers who depicted them as mammy figures not only in store advertisements and logos, but also in everyday annotations.

This Article argues that society must critically examine the types of labor we require our inmates to perform and prohibit the imposition of slavery, even when the enslaved is an inmate. Part II focuses on the text and history of Section 1 of the Thirteenth Amendment11 and argues that the Amendment’s exception allowing forced inmate labor is not as broad as it first appears. Part III examines the Eighth Amendment and how the imposition of slave status on inmates should be considered cruel and unusual punishment. Lastly, Part IV applies these concepts to the history and operation of one such …

The Effect Of Economic Freedom On Workers' Remittances To Labor Sending Countries, Lloyd Banwart

I test the determinants of workers’ remittances, with a focus on how economic freedom in the labor sending country affects the level of remittance inflows the country receives. I use an unbalanced panel data set between years 2000 and 2006. I find a positive and statistically significant relationship between economic freedom and the percentage of GDP from remittances. I show that the effect of economic freedom is dependent upon the level of economic development in the labor sending country (measured by real GDP per capita); as GDP per capita increases, the marginal effect of economic freedom on remittances decreases steadily.

This study compiled the largest research sample on the gender gap in compensation at the 200 largest law firms by combining two large databases to examine the compensation disparities between men and women partners. The analysis elucidates the question of whether the difference is because women are less productive than men partners or because they are women. The Am Law 100 and 200 studies include gross revenue, profits, number of equity and non-equity partners, and the total number of lawyers at each firm. Labor migration is increasing in scale and diversity and is characterized by a new feminization. Despite these transformations, a common theme remains unchanged: immigrant workers are employed in low-skilled jobs. This study of labor migration from Russia to Norway analyzes the establishment of a new migration process, who was involved in this migration, and why this migration from Russia to Norway became dominated by women. It also discusses the situation of the Russian workers in the Norwegian labor market. Analyses of the recruitment processes show how gender, sexuality, age, marital status, education, and motherhood construct women as suitable migrants and …

The Supreme Court has yet to adopt and apply a standard for assessing labor rights claims under the involuntary servitude clause. This article suggests that one may be found in the leading decision of Pollock v. Williams (1944), which contains the Court’s most thorough discussion of the interpretive issues. Under Pollock, a claimed right should be protected if it is necessary to provide workers with the “power below” and employers the “incentive above” to prevent “a harsh overlordship or unwholesome conditions of work.” Although this is not the only conceivable standard, it does fit well with the text, history, and …

The enclosed article examines the collective bargaining negotiations between the National Basketball Association (NBA) and the National Basketball Player's Association (NBPA), whose current collective bargaining agreement (CBA) expires at the end of the present season. The article first details the NBA’s labor history, highlighting past CBA negotiations. Next, the article supplies an understanding of what is at stake in the parties’ negotiations. The article then analyzes the merits of union decertification, in order to circumvent the Nonstatutory Labor Exemption, and antitrust litigation as a NBPA bargaining tactic. Problem solving and innovation are important in many contexts, including academic research, policy-making, product development, and entrepreneurship. Broadly speaking, innovators come in two varieties: specialists and generalists. Specialists are people who have a deep knowledge of a very narrow subject area. Generalists are people whose knowledge ranges across multiple subject areas. In this paper, I examine the role of skill specialization in collaboration network structure, and individual position in the collaborative community. This paper is about three things, as examined over the course of the 1970s: the changes in the state and dependability of work, the pressures of masculinity as felt by heterosexual white men over the age of 20 in the working and middle classes, and what occurred because of the relationship between work and that masculinity. This Article confronts the thorny questions that arise in attempting to apply traditional employment and labor law to “crowdsourcing,” an emerging online labor model unlike any that has existed to this point. Crowdsourcing refers to the process of taking tasks that would normally be delegated to an employee and distributing them to a large pool of online workers, the “crowd,” in the form of an open call.

The governance regime of the public corporation in America, while tending to promote the concentration of economic and social power in company leadership, often encourages that leadership to advance the interests of their company’s short-term shareholders. The result is a board of directors beholden, if to anything at all, to short-term stock prices. This prioritization often comes at the expense of the corporation’s long-term sustainability and to its other constituents: its work force, creditors, and community. Are Mbas And Master's Degrees Worth It? A Discussion Of Wages, Job Security And Business Cycles, Claire Foley

Since the 1970s, recessions have become more frequent and severe, causing major changes to the labor market and the importance of education. This study focuses on the problems for employees with master's degrees and MBAs, and asks three questions: 1) Do employees with graduate degrees have higher earnings than bachelor's degree recipients, 2) Do they experience greater job security as a result of their additional education, and 3) Is graduate school a way to avoid unemployment during a recession? Ordinal logistic regression analysis is conducted and finds that master's degrees and MBAs experience very different outcomes, with much higher returns …

This dissertation explores the rhetorical fragments in three case studies of the American Labor Movement constituting movement members in solidarity. Using Kenneth Burke's discussion of rhetorical substance, this project explores the possibilities for developing deep and broad forms of solidarity within the American Labor Movement. Rhetorical fragments of the Industrial Workers of the World, the United Farm Workers, and contingent faculty unionization efforts are explored.
I argue Burke's ideas of substance and identification provide a powerful lens through which we can examine the solidary practices of social movements. Through the examination of the case studies mentioned, I demonstrate that solidarity …

If laws cease to work as they should or as intended, legislators and scholars propose new laws to replace or amend them. This paper posits an alternative—offering regulated parties the opportunity to contractually bind themselves to behave ethically. The perfect test-case for this proposal is labor law, because (1) labor law has not been amended for decades, (2) proposals to amend it have failed for political reasons, and are focused on union election win rates, and less on the election process itself, (3) it is an area of law already statutorily regulating parties' reciprocal contractual obligations, and (4) moral means …

The Chinese invasion of Tibet, and the Dalai Lama’s subsequent decision to flee in 1959, resulted in the mass influx of Tibetan refugees into India that continues today. It has become clear to the Indian government, as well as to the Tibetan community in exile, that repatriation is unlikely in the near future. Consequently, an evaluation of India’s protection of, and assistance for Tibetan refugees is necessary to ensure their treatment is in accordance with international standards. Unfortunately, such an assessment shows that there is a lack of proper protections and services; this ought to be of particular concern to …

It has become apparent that there are serious deficiencies in the American model of production. Our model of corporate governance has recently come under intense scrutiny in the academic literature and the popular press. There are increasing concerns that American corporations are too focused on short-run profits and stock prices, at the expense of long-term strategies and investments that would benefit the long-run value of the firm, employees, and the American economy at large.
