In this paper I compare and contrast Natorp’s and Husserl’s philosophies as to their programmatic and systematic profiles. I will begin by giving an assessment of their relationship and mutual influence, something that many scholars believe had been done exhaustively in Kern’s initial study of 1964 on the relation between Husserl and Kant and the neo-Kantians. Indeed, this topic – in general, the relation between phenomenology and „critical“ philosophy – deserves a new look now that more material has appeared in the Husserliana, forcefully demonstrating the „transcendental Husserl“ and the Kantian influence on his phenomenology, and given the overall growing …

About a year ago, the Supreme Court in United States v. Booker declared a new standard for the appellate review of federal sentences-reasonableness. Justice Breyer, writing for the Court, asserted reassuringly that the reasonableness standard is not really new at all because judges had been applying it for years to review sentences for crimes lacking specific guidelines, sentences imposed after probation revocation, and, at least until 2003, sentences based upon departures from the recommended guideline range. Like most new legal standards that take shape case-by-case through the appellate process, reasonableness review is developing incrementally, creeping more clearly into view with …

Anchoring, Information, Expertise, And Negotiation: New Insights From Meta-Analysis, Chris Guthrie, Dan Orr

In this article, we conduct a meta-analysis of studies of simulated negotiations to explore the impact of an initial "anchor," typically an opening demand or offer, on negotiation outcomes. We find that anchoring has a significant impact on the deals that negotiators reach. We also explore whether negotiator experience and the information environment mitigate the influence of anchoring. We conclude by offering prescriptive advice, both "offensive" and "defensive," to negotiators.

When does a statute grant powers to the President as opposed to other officials? Prominent theories of presidential power argue or assume that any statute granting authority to an executive officer also implicitly confers that authority upon the President. This Article challenges that statutory construction. It argues that the President has statutory authority to direct the administration of the laws only under statutes which grant to the President in name. Congress's enduring practice of granting power to executive officers subject to express conditions of presidential control supports a strong negative inference that the President has no directive authority when a …

Both medicine and the law devote considerable concern to drawing lines, that is, to classifying and making distinctions. In medicine, such line-drawing occurs when a person is designated healthy or ill, normal or disordered. In the law, such line-drawing determines who does and does not bear legal responsibility for a given situation. This Article reviews the demarcation drawn by psychiatry and the courts between disfavored personality and mental illness, a dichotomy not based upon empirical science and therefore, wholly susceptible to social construction and implementation. While society may pathologize noxious personalities, thus making them disabilities, it is loath to extend …

Rapid advances in communication technology over the past decade have resulted in the previously unimaginable ability to seamlessly exchange ideas and data on a global basis. Nonetheless, despite the undeniable progress that has been made, access to information is ironically becoming progressively more. This is due in large part to the fact that resources which belong in the public domain are increasingly being transformed into private property. The carefully balanced provisions of copyright law are gradually becoming displaced by contractual, technological, and legislative constraints that allow for the tight control of access to and use of the materials in question. …

What is “transnational” criminal law? One possibility is foreign criminal law, meaning the scope and substance of what is deemed criminal behavior in other lands and the theories that ostensibly justify punishing for such behavior, indeed deeming it criminal in the first place. Another is foreign criminal procedure, the “how” of foreign criminal law’s “what” and “why”: the rules and practices of investigating crime, prosecuting suspected criminals, and adjudicating criminal cases in other lands or systems. Scholars agree that the American prosecutor possesses a great amount of discretion (see Albonetti, 1987; Kersetter, 1990; Thomas & Fitch, 1976). Scholars also agree that such discretion has the potential to result in discrimination in the form of unwarranted disparity (Walker, Spohn, & DeLone, 2000). American prosecutors use their discretion to make initial charging decisions, to seek the death penalty, and to negotiate plea agreements.

Effects Of Geometric Characteristics Of Rural Two-Lane Roads On Safety, Samuel Labi

The study investigated the safety effects of geometric and other roadway characteristics of rural two-lane roads by collecting and analyzing data and developing crash prediction models, crash reduction factors (CRFs), and cost-effectiveness ratios (CERs). On the basis of these results, and the existing inventory of roads and their geometric deficiencies, physical and monetary needs assessments were carried out under alternative budgeting and crash costing scenarios for the rural two-lane state highway network. Constructed Wetlands For The Remediation Of Blast Furnace Slag Leachates, M. K. Banks, A. Paul Schwab, James E. Alleman, James Gregory Hunter, Jason C. Hickey

A study was conducted at a site adjacent to I-65 site near Hobart, IN. The pilot scale study was designed to evaluate the use of a subsurface constructed wetland to treat leachate from the slag-based embankment. The constructed wetland proved to be effective in reducing a number of the leachate constituents that impact surface water quality, including pH, TDS, salinity, and sulfate. The system worked best under low flow conditions and extended retention times between surges of leachate into the wetland. The zero flow restriction of the system was met and resulted in elevated concentrations of salts and metals in …
