Despite the legal profession's historical resistance to technological advances, the burgeoning world of cyberspace is bringing change to the practice of law. As laypeople flock to the Internet to seek help with their legal problems, lawyers are going online to provide such assistance. Yet, these exchanges are occurring without close consideration of whether they create attorney-client relationships-the source of weighty ethical and legal obligations. In many cases, lawyers seek to avoid the consequences of such relationships merely by disclaiming their existence. Observable Outcomes And Performance Effects Of The Application Of Theory Of Constraints To Organizational Management, Martha Lair Sale

Doctoral Dissertations

The objectives of the study were to empirically examine the relationships among the three elements of the Theory of Constraints (TOC), a number of observable outcomes expected to be associated with application of TOC, and business unit performance. Measures were developed for each of the elements of TOC and a number of observable outcomes (OUTCOMES) expected to be associated with practice of TOC. TOC is defined as consisting of scheduling logistics (LOGISTICS), the Thinking Process (THINKING), and non-traditional performance measures (MEASURES). A previously developed and widely used measure of business unit performance (PERFORMANCE) was employed.

The Virginia Institute of Marine Science (VIMS) has conducted a trawl survey dating back to 1955. Over the years methods and objectives have varied according to funding sources and state and/or federal mandates.· The present thmst of the program is to provide juvenile indices of relative abundance for recreationally, commercially, and ecologically important fish and invertebrates. These measures of juvenile abundance are widely used as a key element in the management of the Atlantic States' coastal fishery resources. Recent changes in federal telecommunications legislation have underscored the importance of an up-to-date and effective telecommunications-use policy in business organizations. With the proliferation of the Internet, intranets, and email as commonplace business tools, the potential for misuse and subsequent liability has become an increasing concern. Even though the recent Supreme Court decision struck down the obscenity provisions of the Communications Decency Act (CDA), it left intact legislation that effectively mandates development of a sound telecommunications-use policy. In addition to potential liability for systems misuse, organizations have also had to address issues of individual employee privacy within the new systems.

Classroom management is still one of the top-rated concerns of general educators and public school administrators, even though there exist a number of empirically supported interventions that improve classroom behavior. The current research, consisting of two studies, examined the effectiveness, feasibility, and acceptability of one of these interventions, a classwide peer-assisted, self-management program. Using a multiple baseline design across classes, the first study investigated the effects of the Peer-Assisted Learning (PAL) Game on appropriate classroom behavior of three classes of seventh-grade language arts students and of 10 target at-risk students. Erikson's theory of identity development and Marcia's model of identity statuses serve as a framework for this examination of the relationship between women's identity status and employment. The hypotheses of the study were that women with an achieved identity status would be more likely to obtain and retain employment and that interventions would increase their scores on identity-related subscales.

Phase I of this study examined the relationship between identity development and employment among 203 women receiving public assistance. Subjects provided employment and public assistance histories and were categorized into three preferred cognitive styles according to responses to the Berzonsky Cognitive …

Why The Law Hates Speculators: Regulation And Private Ordering In The Market For Otc Derivatives, Lynn A. Stout

Duke Law Journal

A wide variety of statutory and common law doctrines in American law evidence hostility towards speculation. Conventional economic theory, however, generally views speculation as an efficient form of trading that shifts risk to those who can bear it most easily and improves the accuracy of market prices. This Article reconciles the apparent conflict between legal tradition and economic theory by explaining why some forms of speculative trading may be inefficient. It presents a heterogeneous expectations model of speculative trading that offers important insights into antispeculation laws in general, and the ongoing debate concerning over-the-counter (OTC) derivatives in particular. Modeling The Msx Parasite In Eastern Oyster (Crassostrea Virginica) Populations. Ii. Salinity Effects, Michelle C. Paraso, Susan E. Ford, Eric N. Powell, Eileen E. Hofmann, John M. Klinck

An oyster population model coupled with a model for Haplosporidium nelsoni, the causative agent of the oyster disease MSX, was used with salinity time-series constructed from Delaware River flow measurements to study environmentally-induced variations in the annual cycle of this disease in Delaware Bay oyster populations. Model simulations for the lower Bay (high salinity) sire reproduced the annual cycle observed in lower Delaware Bay. Simulations at both upper Bay (low salinity) and lower Bay sites produced prevalences and intensities that were consistent with field observations. At all sites, low freshwater discharge resulted in increased disease levels, whereas high freshwater …

This Water Resources Management Plan describes the water resources of Arches and Canyonlands National Parks and the issues affecting them. This plan provides detailed descriptions of the hydrologic environment in both parks, discussion of management issues developed in two scoping sessions, and management directives in the form of project statements. Typically, a Water Resources Management Plan is preceded by a scoping meeting held at the park. Seven hundred seventeen cattle, over the age of six months in the South Marmara Region (Bursa, Balıkesir and Çanakkale) were tested for the presence of Bovine Leukemia Virus (BLV)-antibody with ELISA.Blood and milk samples were taken from 362 and 355 cattle, respectively. Totally, sixty-nine cattle (9.62%) were found to be carriers of antibodies against BLV-gp 51 antigen.The BLV infection rate was found to be 13.25% and 5.91% in the sera and milk samples tested, respectively. The infection rate were determined to be 14.19 % in Bursa and 3.52 % in Balıkesir, but BLV seropositive cattle were not found in Çanakkale. …
