Since colonial times, character education has played a kaleidoscopic role in American schools. Seventeenth and eighteenth century Puritan curriculum was synonymous with an exceedingly rigid and religious moral code. Nineteenth century policy makers adopted a Pan-Protestant, and then a generalized Christian philosophy of character education, as they pursued a common school system. As twentieth century American society grew increasingly pluralistic, the religious basis of character education succumbed to a more secular framework. Predictably, this century has seen character education be demoted to just one of many competing items on the national education agenda. The first area of discussion is the structure of each government system. This analysis not only sets the legal framework for later analysis, but demonstrates how both Israel and Iran have brought religion into the very fabric of their legal institutions.The second area of analysis in Part II focuses on the principles of sovereignty and constitutional interpretation utilized by each State. Familiarity with these concepts is necessary in order to learn which religious principles, if any, are incorporated into each nation's general legal environment. This Article scrutinizes the constitutionality of the intent of the Defense of Marriage Act [DOMA]. According to the text of the Act, DOMA's purposes are "to define and protect the institution of marriage," where marriage is defined to exclude same-sex partners. To be constitutionally valid under the Establishment Clause, this notion that heterosexual marriage requires "protection" from gay and lesbian persons must spring from a secular and not religious source. This Article posits that DOMA has crossed this forbidden line between the secular and the religious. The publication of the Book of Mormon brought forward the first of many comparisons between the restorational work of the Prophet Joseph Smith and his surrounding environment, including Freemasonry. One point of comparison has been the lambskin apparel mentioned in 3 Nephi 4:7. A possible connection exists between this item of apparel and ritual clothing that was worn in ancient Israel, Egypt, and Mesoamerica. I suggest a possible reason for the use of this item of clothing among the secret combinations in the Book of Mormon and discuss the lambskin apron used in Freemasonic ritual.

A Jewish custom of blessing God after eating one’s fill at a meal is reflected in passing in Amulek’s household and when the resurrected Christ blesses the sacrament for the Nephites and thereafter instructs them to pray. They “gave glory to Jesus” on this occasion.

The case of City of Boerne v. Flores marked an important day in the history of the Constitution. The decision of the United States Supreme Court invalidated the Religious Freedom Restoration Act as applied to a local Texas zoning ordinance. The ordinance created a historical preservation area in an attempt to curb a church from expanding its buildings. The Supreme Court held that the Freedom Restoration Act went beyond Congress’s power because of the Act’s broad coverage and potential to intrude on laws regardless of context. If religion is an innate aspect of the human experience, it should not be surprising that Alcoholics Anonymous (A.A.), a widely known and arguably religious support group for problem drinkers, has become a common and effective means of combating alcoholism. Also, it should not be surprising that probation officers, parole officers, judges, bar overseers, wardens, and myriad others exercising state authority routinely push individuals toward A.A. Arguably, however, official referral of problem drinkers to A.A. violates current interpretations of the Establishment Clause because of the quasi-religious nature of the program.

Does Protestant Fundamentalism Produce Traditional Views?: The Impact Of Religious Commitment Affiliation On Gender Role Beliefs And Political Ideology, Melissa Myers

Student Work

This research looks at the relationship between religious commitment/affiliation and traditional beliefs. Data from the 1993 General Social Survey is used to test hypotheses linking religious commitment and religious affiliation to traditional gender role beliefs and conservative political views. Findings show statistical significance but weak substantive support for the idea that fundamentalists hold more traditional gender role beliefs and political ideology. Future research linking these attitudes to the actual behaviors of men and women in fundamentalist religions is proposed.

In keeping with their religious traditions as devout Protestants, Bruce and Nancy Young regularly gave to their church in New Hope, Minnesota. From February 1991 to February 1992, the Youngs tithed $13,450 to their church.' Unfortunately-due to financial difficulties--the Youngs filed for Chapter 7 bankruptcy in February 1992. Because the Youngs tithed the $13,450 while insolvent, the bankruptcy trustee for their estate initiated a proceeding to void the transfers and return the contributions to the estate.

Sacred trees, representing the power of life to grow from the underworld realm of the dead, are a common motif in the art and literature of the ancient Maya of Mesoamerica. Such trees are similar in concept to the tree of life described in the Book of Mormon, as well as to the mythic traditions of many other contemporary world cultures. Hieroglyphic inscriptions and sixteenth-century highland Maya texts describe a great world tree that was erected at the dawn of the present age to stand as the axis point of the cosmos. In this thesis, the author discusses the extent to which the government can afford to give accommodation within the limits of the Establishment Clause. In Chapter II, the author reviews the theory of the permissible accommodation referred to in the Supreme Court of the United States. In Chapter III, the author examines scholarly debates on the accommodation. Then, the author discusses German and Japanese law of the accommodation in Chapter IV. Few, if any, American Indian individuals are more widely known in the United States than the Lakota holy man, Black Elk (1863-1950). His story, particularly as presented by John Neihardt in Black Elk Speaks, has been required reading for legions of students taking classes in literature, religion, anthropology, and American Indian Studies. Beginning with Wojtyla's doctoral dissertation presented at the Pontifical University of St. Thomas Aquinas on the Catholic mystic St. John of the Cross and continuing through the most recent best seller, Crossing the Threshold of Hope, Christian personalism has pervaded Wojtyla's writings, encyclicals, and public utterances. The little that has been written about expressions of religious experience in the field of Composition Studies focuses on the many ways religious belief places its adherents at a disadvantage in writing classrooms. We discuss in our journals and staffrooms only those religious conservatives who are most expressive of their beliefs. Many others sit in silence during discussions that may reveal anything of their beliefs, fearing to offend teachers and peers or to expose themselves to offenses from others. Preparing The Way Of The Lord: Three Case Studies Of Ministerial Preconditioning In Congregations Before The Great Awakening, 1675-1750, Douglas Kevin Fidler

This study demonstrates that ministerial predecessors in three northern New England communities actually preconditioned community reactions to the Great Awakening during the years preceding the revival itself. "Preconditioning" is not the ordinary "influence" of pastors within their churches and professional circles suggested in other works. This kind of influence might cause parishioners to consider various behavioral alternatives when confronted by spiritual circumstances. Preconditioned congregations would already have established paradigms for responding to spiritual stimulus. While individual parishioners might act in ways consistent with their own personalities, psychological needs, and spiritual sensitivities, congregations as a whole would apply a predetermined set …

Jürgen Habermas's discourse theory of law poignantly sets forth the modern legitimation crisis of law. Relying on Max Weber's social theory and sociology of law, he argues that the rationalization of society has eliminated religious and metaphysical justifications for law and has differentiated law from politics and morality. Law must now be legitimated based on its legality. The legal positivists (including Weber, H.L.A. Hart, John Austin) and John Finnis attempt to define legality merely in terms of procedural requirements. Habermas, however, demonstrates the circularity of this definition of legality.
