Old Remedies In The Biotechnology Age: Moore V. Regents, Michelle J. Burke, Victoria M. Schmidt

RISK: Health, Safety & Environment (1990-2002)

The California Supreme Court, by excluding a potential remedy, has eliminated many concerns generated by a lower court decision resolving rights to the cell line derived from John Moore's spleen. Yet, the Supreme Court gave little attention to remedies that remain. The authors argue that a constructive trust, a remedy of considerable vintage and great flexibility, could be applied to achieve a just result in such circumstances without affecting the biotechnology world at large.

Criminal Liability For Misconduct In Scientific Research, Susan M. Kuzma Jan 1992

Criminal Liability For Misconduct In Scientific Research, Susan M. Kuzma

University of Michigan Journal of Law Reform

This Article will explore our society's attitude to prosecuting scientific misconduct, the need to consider prosecution in such cases, and the utility of current statutes available for prosecution. To assist the reader in understanding the issues, this Article will provide some background information about misconduct in scientific research and will include a discussion of some specific incidents. These background materials provide a context for my argument that criminal sanctions should be available to punish scientific misconduct. Finally, I propose a federal criminal statute designed specifically for prosecuting scientific misconduct.

An Exploratory Study Of Marketing Standardization By International Hotel Companies: Some Research Propositions, Ramesh Kanjuli Kurup

UNLV Retrospective Theses & Dissertations

This exploratory study examined marketing standardization in the hotel industry. As hotel companies continue the internationalization process, standardizing the marketing program could prove to be a viable strategy with appropriate benefits. Primary research served to evaluate these tentative propositions and then formulate them into final propositions for future investigation.

Historical Review Of The Accounting Treatment Of Research And Development Costs, Paul Edward Nix, David E. Nix

Accounting Historians Journal

This study reviews the literature and the practice of accounting for research and development (R&D) costs from the first reference in 1917 to the current treatment. The conceptual treatment of R&D is compared to current financial accounting rules and explanation of the evolution of the current rules is presented. The economic and social consequences of the current rules which require R&D costs to be expressed are examined. The paper explores possible alternative treatment of R&D costs. As a contrast to U.S. practice, the accounting treatment of R&D costs in other countries is discussed. Given the findings of this paper, a …

The Ethical Judgment Of Animal Research, Shelley L. Galvin, Harold A. Herzog Jan 1992

The Ethical Judgment Of Animal Research, Shelley L. Galvin, Harold A. Herzog

Experimentation Collection

One hundred sixty subjects acted as members of a hypothetical Institutional Animal Care and Use Committee and evaluated five proposals in which animals were to be used for research or educational purposes. They were asked to approve or reject the proposals and to indicate what factors were important in reaching their ethical decisions. Gender and differences in personal moral philosophy were related to approval decisions. The reasons given for the decisions fell into three main categories: metacognitive statements, factors related to the animal, and factors related to the design of the experiment.

Mp92-64 The Stable Fly: A Pest Of Humans And Domestic Animals, Gustave D. Thomas, Steven R. Skoda

University of Nebraska-Lincoln Extension: Historical Materials

Many species of flies are pests. Many people, if you were to ask them about flies, would be at least vaguely aware of the potential to flies to transmit disease organisms. But yet, for the most part, a fly is a fly is a fly. Sayings like "It must be about to rain, the house flies are biting" are still common and show a general need for more, readily accessible information, particularly about some of the pest flies.

Stable flies, obligate blood-feeders, are very important pests to the cattle industry and, at times, are pests to other groups (they're most …
