The study and impact of the globalisation of crime control policy and related products have recently begun to receive significant attention from critical Indigenous scholars. The reasons for the increasing focus on this issue include the restorative justice industry's increasing utilisation of so-called 'Indigenous' philosophies and practices in the design of its various products; and the increasing global popularity of supposedly 'Indigenousinspired1 restorative justice initiatives, not only in settler colonial contexts, but throughout Western jurisdictions, as a response to crime control issues relating to minorities. The idea that governments should protect citizens against the excesses of free enterprise has been replaced with the idea that government should protect business activities against the excesses of democratic regulation. What business leaders seek, and to a large extent have achieved, are »business-managed democracies«, that is, democracies where the politics and cultural life of nations are managed in the interests of business.

This paper looks at the growing trend of calls for reform, under the guise of globalisation. Such calls are/have been made by the current Australian Federal Government (AFG) in their national policy setting role. What is relevant to this paper is the AFG’s involvement in accounting standard setting, and their push for International Harmonisation (IH) of Australian Accounting Standards (AAS), through full adoption of international accounting standards set by an international standard setting body. The world is now characterised by extensive and rapid movements of people. An increasingly important issue for industrialised countries, such as Australia, is the rising number of people who are becoming displaced within their homelands as a result of a multitude of interconnected factors. The majority of displaced persons and refugees in our region are women and children. Yet, they are severely underrepresented in refugee determination processes, claims for asylum and settlement. Globalisation has set in motion large-scale population movements that render meaningless distinct categories of displacements. Yet, in recent years nation states have increasingly emphasized the distinction between ‘economic’ migrants and political refugees. This paper interrogates the overlapping processes of cross -border and internal displacements in postcolonial states. In particular, I argue that gendered complexities of internal and international displacement require urgent attention. Based on recent and ongoing ethnographic research among poverty induced internally displaced women in India and cross-border forced migrants, this paper considers the context of their experiences. Reviews Bill Ashcroft's 'Postcolonial Transformations' arguing for a postcolonial consideration of spaces of negotiation beyond the textual in an era of globalisation. Taking the figure of textiles, this argument is illustrated using Amitav Ghosh's 'The Circle of Reason', Raja Rao's 'Kanthapura', and Rohinton Mistry's 'A Fine Balance'. Mention is also made of K.S. This paper will analyse the tensions between the harmonisation of law and the maintenance of sovereignty of member states in federal systems. Australia has recently had to address the structure of corporate law and regulation as a result of decisions in two High Court cases, namely Re Wakim; Ex Parte McNally (1999) 198 CLR 511 and R v Hughes (2000) 171 ALR 155. The constitutional problems posed by these two cases have currently been resolved using a referral of powers by the states to the Commonwealth. However, this agreement was not reached without difficulty, and uncertainty persists due to a five year sunset clause.
