Mexican Money Laundering In The United States: Analysis And Proposals For Reform, Guadalupe Correa-Cabrera, Charles Lewis, William R. Yaworsky
Anthropology Faculty Publications and Presentations
This article explains some of the mechanisms through which corruption by high-level Mexican politicians and other organized crime members is facilitated in the United States through money laundering operations. The analysis is based on information contained in court records related to key money laundering cases, as well as in news articles and reports from law enforcement agencies. These materials highlight the interrelationships among U.S. drug use, cartel activities in Mexico, human rights abuses, Mexican political corruption, and money laundering in the United States. This work demonstrates the pervasive use of legitimate businesses and fronts in the United States as a …

Money Laundering In The United States: A Review Of Current Regulations And Threats, Grace Hutchinson
Senior Honors Theses
Money laundering is the act of hiding illegally obtained money in the financial system. There are three stages of money laundering: placing, layering, and integration. In the United States, the Bank Secrecy Act, monitored by the Financial Crimes Enforcement Network (FinCEN), requires companies to establish an anti-money laundering (AML) compliance program and to exercise customer due diligence as preventative measures. The US government can detect money laundering through Suspicious Activity Reports, Currency Transaction Reports, and whistleblower tips. However, AML threats and vulnerabilities such as Professional Money Launderers, cryptocurrency, and the global art market allow criminals to continue to launder money …

Purpose: This paper aims to determine the types of legal mechanisms that authorities can use to recover stolen assets for and from China. Design/methodology/approach: Newspaper articles and books are examined as are relevant reports by various regulatory authorities and academic institutions. Findings: The effectiveness of legal mechanisms in the recovery of stolen assets may be affected by issues such as the difficulties in tracing illicit funds, the ambiguous nature of “value” as well as the rise in technology. Research limitations/implications: There are limited data available in relation to the prevalence of corrupt officials along the Belt and Road Initiative and …

Purpose: This paper aims to determine the adaptability of China’s legal system in recognizing and enforcing foreign judgements in China. Design/methodology/approach: Academic articles, case law and books are examined as are relevant reports by various regulatory authorities and organizations. Findings: Historically, Chinese courts have strictly adhered to “de facto reciprocity”, which made it difficult for foreign judgements to be recognized and enforced in China. Fortunately, Chinese courts have since abandoned their rigid adherence to de facto reciprocity, and have instead, used flexible tests of reciprocity such as de jure reciprocity, reciprocal commitment and reciprocal understand/consensus. Accordingly, this would facilitate the …
Political Regimes And Firms' Decisions To Pay Bribes: Theory And Evidence From Firm-Level Surveys, Shuichiro Nishioka, Sumi Sharma, Tuan Le
Political Regimes And Firms' Decisions To Pay Bribes: Theory And Evidence From Firm-Level Surveys, Shuichiro Nishioka, Sumi Sharma, Tuan Le
Economics Faculty Working Papers Series
This paper makes the most of the observed actions of bribe takers and givers from the World Bank Enterprise Surveys and studies how a taker’s action influences a giver's decision to pay bribes. To motivate our empirical study, we consider Kaufmann and Wei's (1999) Stackelberg game between a tax authority and a firm that undergoes tax inspection. The model predicts that, when the authority can use its action as a credible threat for the firm's profitability, the authority disturbs the firm by inspecting more, and the firm is more likely to pay bribes. Consistent with the theoretical prediction, we find …
Federal Law Enforcement Reform: Depoliticization Into A Constitutional Framework To Restore Public Confidence, Christopher J. Boosey
Federal Law Enforcement Reform: Depoliticization Into A Constitutional Framework To Restore Public Confidence, Christopher J. Boosey
Senior Honors Theses
This thesis proposes that there is a lack of public confidence in federal law enforcement agencies and that this is because these agencies have become political weapons, investigating individuals rather than crimes, in violation of the U.S. Constitution. Following multiple scandals, from the historical targeting of the Civil Rights movement to present attempts to designate parents critical of school administrators as domestic terrorists, wholesale reform of these agencies is urgent. Therefore, this thesis will address the issue of politicization, political corruption, and the lack of adherence to constitutional principles through the problem, significance, and solution method. This thesis will first …
Tracking The Donor Dollar: A Critical Examination Of Ngo Impact, Joshua Werth
Tracking The Donor Dollar: A Critical Examination Of Ngo Impact, Joshua Werth
Senior Honors Theses
Non-governmental organizations (NGOs) comprise the backbone of civilization. Whether intended or not, governments fail to improve social situations, financial standings, and spirituality comprehensively. NGOs attempt to cover these areas. From Angola to Zambia, countless NGOs exist around the world; however, many fail due to a misplaced focus internally on the annual donations received rather than externally on the disenfranchised. Additionally, even if NGOs manage to stay afloat, they will need help procuring funds and then distributing those resources with the most effective impact for the impoverished. The honors thesis proposed will attempt to determine more effective impact measurements for NGOs, …

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level …

The Effect Of Corruption Control On Efficiency Spillovers, Levent Kutlu, Xi Mao
Economics and Finance Faculty Publications and Presentations
We examine the effect of corruption control on efficiency and its implications for efficiency spillovers by a stochastic frontier model. Our dataset covers 102 countries from 1996 to 2014. We find a positive relationship between corruption control and efficiency. If neighboring countries have difficulty in handling corruption, the country would be negatively affected by its neighbors' corruption through efficiency spillovers. We then compare the efficiency differences across countries for three time periods: 1996–2002, 2002–2008, and 2008–2014. On average, technical efficiencies slightly increased in the second period compared to the first period. In the third period, the efficiencies declined, particularly in …

Blockchain technology originally finding applications in Fintech and supply chain management is rapidly expanding applications to other industries as well as the public sector. “Blockchain has been compared to the invention of the internet and its comprehensive impact on almost every industry.” R. Beck and B. Markey-Towler (2017) A recent study by PWC (2020) found that, “Blockchain technology has the potential to boost global gross domestic product by $1.76 trillion USD over this decade.” It has been argued that the digital revolution has favored more developed nations and that has helped create a “digital divide” with less developed nations. Compulsory Voting And Corruption In Latin America, Jonathan Dumdei
Compulsory Voting And Corruption In Latin America, Jonathan Dumdei
Senior Honors Theses
Among modern democracies, compulsory voting (CV) is institutionalized most prevalently in Latin America. Latin American politics have a long, turbulent history, and governments in the region have some of the highest rates of political corruption in the world among democracies, especially electoral fraud. This study investigates the connection between these two phenomena. Secondary empirical quantitative and qualitative research of political and cultural behavior are analyzed according to a rational choice theory decision paradigm. Demographic, experimental, and theoretical data regarding the effects of CV laws are considered in light of possible incentives and disincentives for engaging in vote-buying. This study inductively …

Modeling The Effects Of Dated Medical Supplies Donation On Recipient Countries, Quan Zhou, Tava Lennon Olsen
Scopus Harvesting Series
Most developed countries hold significant quantities of medical supplies in reserve for emergency response. Due to high handling costs and remote storage locations, such stocks are typically not used for day-to-day operations. In consequence, the expiry of reserve supplies (without use) is a significant problem. One possible remedy for such wastage is to donate large batches of dated supplies to developing nations, which often do without adequate medical supplies in their health systems. Here, we focus on personal protective equipment (PPE) and similar products, which have low risks associated with aging and safety. However, the international community is cautious about …

A recent, high-profile investigation involving McKinsey & Company (McKinsey) and its contracts with the Food and Drug Administration (FDA) has reminded us that organizational conflicts of interest (OCIs) are an integrity issue that never should be written off as a check-the-box exercise during the procurement process. This incident highlighted the need to address critical gaps in this area of the law. This article appeared in the August 2022 issue of Contract Management magazine published by the National Contract Management Association. Used with permission.

Does Fear Of Government Corruption Affect Voter Turnout?, Ryan Nahmias
Student Scholar Symposium Abstracts and Posters
According to the Survey of American Fears (2020-2021) fear of corrupt government officials is the number one thing Americans fear: 79.6 % of them in fact. In addition, voter turnout is one of the quintessential pillars that allows a democracy to function properly. In this paper I will examine the extent to which fear of government officials’ corruption affects voter turnout. Using the data from the Chapman Survey of American Fears and variables from the American National Election Study between 2020 and 2021, I expect to find a moderately strong relationship between fear of government corruption and voter turnout. Moreover, …

We investigate whether judicial decisions are affected by career concerns of judges by analyzing two questions: Do judges respond to incentives to pander by ruling in favor of the government in the hope of receiving jobs after retiring from the Supreme Court? Does the government reward judges who rule in its favor with prestigious jobs? We construct a data set of Supreme Court of India cases involving the government for 1999–2014. We find that incentives to pander have a causal effect on judicial decision-making, and they are jointly determined by the importance of the case and whether the judge retires …

Concomitant with an increase in the global illegal wildlife trade has been a substantial increase in research within traditional conservation-based sciences and conservation and green criminology. While the integration of criminological theories and methods into the wildlife conservation context has advanced our understanding of and practical responses to illegal wildlife trade, there remain discrepancies between the number of empirical vs. conceptual studies and a disproportionate focus on a few select theories, geographical contexts, and taxonomic groups. We present three understudied or novel applications of criminology and criminal justice research within the fields of fisheries, forestry, and wildlife conservation. First, we …

Anticipating Elite Capture: The Social Devaluation Of Municipal Tap Water Users In The Phoenix Metropolitan Area, Alexandra Brewis, Katie Meehan, Melissa Beresford, Amber Wutich
Faculty Research, Scholarly, and Creative Activity
Characterizing subcultural models of tap water derived from interviews from 154 respondents in four neighbourhoods in the urban Southwestern United States, we identify sources of public discourses that support and anticipate passive elite capture. In accord with predictions, social devaluation of those who use tap water is situated with residents of a privileged exclusive community sector. This suggests the value of a broader conceptualization and an empirical model of elite capture in water resources: not just as a physical deviation of resources, but also as a discursive devaluation of public resources by specifically elite populations.

This exploratory study investigates how nine London-based civil engineers have enacted ‘global responsibility’ and how their efforts involve ethics and professionalism. The study assesses moral philosophies related to ethics, as well as professional engineering bodies’ visions, accreditation standards, and requirements for continuing professional development. Regarding ethics, the study questions where the line falls between what an engineer ‘must do’ and what ‘would be good to do’. Although the term ethics did not spring to mind when participants were asked about making decisions related to global responsibility, participants’ concern for protecting the environment and making life better for people did, nonetheless, …

English Department: Research for Change - Wicked Problems in Our World
In this paper, I convey the serious need for change within the American police departments. In America, law enforcement has been systematically oppressed minorities for decades with no repercussions and has been protected by the corrupted system. It is time for new tactics to be implemented in America for dealing with civilians because the cops are not fulfilling their duty to protect the people anymore, they're hurting the people. Everyone in America now either hates the police or are terrified of them making a huge divide between everyone in the country. After seeing all the controversy that has transpired it's …

Previous studies have found a correlation between gender inequality and corruption, but much debate still exists about the cause of this correlation. A common theory is that any country with little corruption and low gender inequality is a democracy and that the relationship is a spurious one that comes from the nature of democracies. Others contest that this is a reflection of women having a higher moral standard. This study measures the correlation between sexist attitudes and corruption. Measuring the attitude toward gender inequality rather than institutions, laws, or the behavior of individuals helps us better understand the culture and …

The Christian megachurch is a relatively recent phenomenon, championing new ideals and theological practices for faith communities around the world. Megachurches, by definition, are Christian churches that consist of over a thousand attendees. Most megachurches are independent from a denomination – a characteristic that brings a multitude of advantages as well as challenges. One specific challenge for megachurches is the problem of potential abuse by pastors that are characterized by toxic and destructive leadership. In recent years, many Christians, as well as non-Christians, have been shocked by the number of megachurch pastors revealed as bullies, narcissists, or sexual assailants. Although …

This paper provides a systematic and bibliometric review of 80 research articles on corruption in healthcare published in peer-reviewed journals between 2006 and 2017. Findings suggest that the number of studies has increased over time with a focus on low- and middle-income countries; academic researchers have published papers in a large variety of journals and have investigated different types of corruption with various methodologies. The interest is especially focused on low- and middle-income countries where corrupt behaviors are more common. The paper suggests future research directions to a dynamic research community to facilitate anticorruption actions by public authorities.

In the midst of dramatic corruption scandals, South American countries have passed some of the most noteworthy anticorruption legislation in the region’s history. This Article examines the wave of anticorruption reforms and how international law, and in particular anticorruption treaties, has had an important influence on the content of these reforms. Specifically, this Article argues that that the OECD Anti-Bribery Working Group has acted as a political entrepreneur, advocating for specific and meaningful reforms. The influence of international law was critical in ensuring that the reforms adopted during these corruption scandals were robust and that the opportunity presented by these …

Be it bribery, embezzlement, or the abuse of public trust, corruption poses a major challenge to global security and democratic governance, along with undermining the rule of law, especially within the Global South. Key to this phenomenon is understanding how lawyers are enabling but also disrupting this epidemic. Unfortunately, the literature on this subject is lacking. This study, therefore, offers a nuanced story of globalization and the complicated role that lawyers play in corruption, by relying on the case study of Nigeria—a crucial Global South market that has the largest population on the African continent. While Nigeria has been able …

Over the past decade, the anti-corruption, ethics, and compliance landscape has changed dramatically. This is a direct consequence of a global anti-corruption enforcement effort led by the United States through its enforcement of the Foreign Corrupt Practices Act. The increase in enforcement has also been spurred by the adoption of several multilateral anti-corruption agreements, such as the Organization for Economic Co-operation and Development (OECD) Anti-Bribery Convention and the United Nations Convention Against Corruption (UNCAC). These agreements have spurred several countries to enact anti-corruption laws, such as the U.K. Bribery Act, Brazil’s Clean Company Act, and France’s Loi Sapin II. The …
