Command And Control: Operationalizing The Unitary Executive, Gary S. Lawson

The concept of the unitary executive is written into the Constitution by virtue of Article II’s vesting of the “executive Power” in the President and not in executive officers created by Congress. Defenders and opponents alike of the “unitary executive” often equate the idea of presidential control of executive action with the power to remove executive personnel. But an unlimitable presidential removal power cannot be derived from the vesting of executive power in the President for the simple reason that it would not actually result in full presidential control of executive action, as the actions of now-fired subordinates would still …

Movement On Removal: An Emerging Consensus On The First Congress, Jed Handelsman Shugerman

What did the “Decision of 1789” decide about presidential removal power, if anything? It turns out that an emerging consensus of scholars agrees that there was not much consensus in the First Congress.
Two more questions follow: Is the “unitary executive theory” based on originalism, and if so, is originalism a reliable method of interpretation based on historical evidence?
The unitary executive theory posits that a president has exclusive and “indefeasible” executive powers (i.e., powers beyond congressional and judicial checks and balances). Major Questions About Presidentialism: Untangling The “Chain Of Dependence” Across Administrative Law, Jed Handelsman Shugerman, Jodi L. Short

A contradiction about the role of the president has emerged between the Roberts Court’s Article II jurisprudence and its Major Questions Doctrine jurisprudence. In its appointment and removal decisions, the Roberts Court claims that the president is the “most democratic and politically accountable official in Government” because the president is “directly accountable to the people through regular elections,” an audacious new interpretation of Article II; and it argues that tight presidential control of agency officials lends democratic legitimacy to the administrative state. Creating A Feminist Religious Counterpublic:Rlds Feminists And Women's Ordination Advocacy In America, 1970–1985, David Howlett, Nancy Ross

The 1970s witnessed an efflorescence of religious feminism in the Reorganized Church of Jesus Christ of Latter Day Saints, particularly around the issue of women's ordination. We pose a model for understanding this development—the formation of publics/counterpublics—and explore how it illuminates our case study. Drawing upon oral history interviews and archival sources, we document how RLDS women created independent publications, grassroots consciousness-raising groups, feminist classes and conferences, and Women-Church–inspired worship to reimagine priesthood within their church. We conclude that the lens of a counterpublic offers a capacious view of our topic, one capable of integrating both social movement theory and …

Papers include correspondence, photographs, publications, and ephemera documenting the beginning of the gay liberation movement in Maine and Steve Bull's participation in the movement both in Maine and nationally, especially through his involvement with the founding of the Wilde-Stein Club at University of Maine Orono in 1973 and his chairmanship of the first Maine Gay Symposium in 1974. Letters received by Bull and his friends, both personally and as Wilde-Stein Club officials, are evidence of the attitudes of both supporters of gay liberation and its opponents in the 1970s. When Uruguay and Argentina first gained their respective independence in the early 1800s, they appeared to be following the same path of development As countries that came from the same Spanish colonization, share almost identical agricultural economies, and retain a close relationship, it is logical that they would follow similar trajectories. This assumption proves to be inaccurate in more ways than one, but most prominently within the environmental sphere. One way to analyze this difference in policy implementation lies in compliance with international environmental treaties which contain specific goals and limits for all parties involved. Sacred Sexuality explores the intersections of religion and sexuality. I worked with Dr. Birthisel, Director of the Wilson Center, and Kate Dawson, co-facilitator of the sex education class, to survey the sex education class participants on how the experience has been for them. I surveyed the sex education class participants after the class to analyze their opinions of the sex education class, interfaith dialogue, and how their spirituality or religious perspectives inform their beliefs around sexuality. Overall, the sex education class was highly recommended and gave an interesting look into how faith and sexuality interact. While the sex education class …

A Century Of Critical Buddhism In Japan, James Mark Shields

This chapter introduces the central arguments of Critical Buddhism as a lens by which to view the course of “modern” Buddhism in Japan, particularly as it relates to politics. It traces philosophical and political precedents for Critical Buddhism in the context of Japanese modernity, by focusing on several progressive Buddhist figures movements from mid-Meiji through early Shōwa, including the New Buddhist Fellowship and the Youth League for Revitalizing Buddhism. I argue that previous attempts to centralize criticism as a basic Buddhist precept were unsuccessful in part do to an inability to distinguish the Buddhistic components of their thought and practice, …

The Supreme Court’s 2022 decision in Federal Bureau of Investigation v. Fazaga heralds a worrying trend. Over the past 15 years, as more information about how the government wields its foreign intelligence collection authorities on U.S. soil has become available, it has become clear that the government has repeatedly acted outside its constitutional and statutory limits, and at times, in flagrant disregard for judicial orders. As a result, dozens of cases challenging surveillance have been making their way through the courts. Contrary to the beliefs of New Left historians seeking to revive the once discredited theory that American territorial expansion was driven by a motivation to expand the institution of slavery, a position that I have dubbed the Neo-Abolitionist view, rather that Manifest Destiny developed as an early national security strategy and primitive strategic doctrine, what might be termed in today’s vernacular as a kind of preemptive threat displacement theory. On February 11, 1990, Nelson Mandela walked out of prison a free man after being held captive for over 27 years. Crowds roared with joyfulness as their beacon of hope pumped his right fist in the air triumphantly. The international community watched the occasion with hope and a feeling of success after the assistance in the struggle to bring down the brutal regime of apartheid. This inspiring movement took decades of unified activism from both South Africans and local, grassroots organizations to bring the system down. Pacifism And The Science Of War: Jane Addams And Bertrand Russell On World War I, Marilyn Fischer

In July 1915, after hearing Jane Addams speak in London on her efforts for peace during wartime, Bertrand Russell wrote to an American friend, “You can gather what I think and feel by talking to Miss Addams. She seemed to me to have exactly the same outlook as I have.” In this paper I compare how Russell and Addams used the era’s scientific theories in formulating their pacifism. After recounting Addams’s and Russell’s experiences during the war, I show how Addams and Russell accounted for civilization’s “descent into barbarism” in parallel ways. A mystery of faith is a truth of religion that escapes human understanding. The mysteries of religion are not truths that human beings happen not to know, or truths that they could know with sufficient study and application, but instead truths that they cannot know in the nature of things. In the Letter to the Colossians, St. Paul writes that as a Christian apostle, his holy office is to “bring to completion for you the word of God, the mystery hidden from ages and from generations past.” Note that Paul does not say that his task is to make …

Lawyers have sworn an oath to be admitted to the Bar since the beginnings of the Anglo-American legal profession. The oath serves several extremely important purposes. First, it is the formal act that admits an individual into the Bar and confers upon the oath taker the right to perform the duties of an attorney in the jurisdiction in which the oath is given. Second, the oath admits the new attorney to the broader world of the legal profession and signifies that the new attorney has been judged by the oath giver as worthy of the right to practice law.
