Summary Of Carrigan V. Nevada Comm’N On Ethics, 129 Nev. Adv. Op. 95, Edward Wynder
Nevada Supreme Court Summaries
Upon remand from the U.S. Supreme Court, the Supreme Court of Nevada reviewed de novo two issues regarding the Nevada Commission on Ethic’s censure of a city councilmember: (1) whether a recusal provision in the Nevada Ethics in Government Act (NRS 281A.420 ) was void for vagueness and (2) whether it violated public officers’ constitutional right to associate .
Redefining Professionalism? Florida's Code Mandating The Aspirational Raises Challenging Questions, Keith W. Rizzardi
Redefining Professionalism? Florida's Code Mandating The Aspirational Raises Challenging Questions, Keith W. Rizzardi
Professionalism Research Library
Responding to continued criticism of the legal profession, Florida recently adopted a new Code for Resolving Professionalism Complaints (professionalism code). The new requirements transform the aspiration of professionalism into a mandate, but important questions remain as to the meaning of key terms and the methods of implementation. In its opinion approving the professionalism code, the Florida Supreme Court stated that Florida lawyers had “traditionally followed a more passive, academic approach to enhance and improve professionalism.” In other words, the combination of continuing legal education programs, speeches, contests, and meetings — methods once called “procedural professionalism” in a 2005 Florida Bar …
Ethical Issues In Knowledge Management: Conflict Of Knowledge Ownership, Isabel D. W. Rechberg, Jawad Syed
Ethical Issues In Knowledge Management: Conflict Of Knowledge Ownership, Isabel D. W. Rechberg, Jawad Syed
Publications and Research
Purpose: This paper reviews ethical issues inherent in the theorisation and practice of knowledge management (KM) with specific attention to the conflict of knowledge ownership between organisations and individual employees.
Design/methodology/approach: Relevant literature was identified and reviewed via EBSCO host and ISIWeb.
Findings: The paper notes that knowledge, although rooted in individuals, is often claimed or treated as owned by organisations, creating a conflict of knowledge ownership. The paper argues that such an approach to appropriation and management of knowledge leads to tension in knowledge processes between organisations and individuals, and also among individuals. This situation may, in turn, jeopardise …
Drug Firms, The Codification Of Diagnostic Categories, And Bias In Clinical Guidelines, Lisa Cosgrove, Emily E. Wheeler
Drug Firms, The Codification Of Diagnostic Categories, And Bias In Clinical Guidelines, Lisa Cosgrove, Emily E. Wheeler
Counseling and School Psychology Faculty Publication Series
The profession of medicine is predicated upon an ethical mandate: first do no harm. However, critics charge that the medical profession’s culture and its public health mission are being undermined by the pharmaceutical industry’s wide-ranging influence. In this article, we analyze how drug firms influence psychiatric taxonomy and treatment guidelines such that these resources may serve commercial rather than public health interests. Moving beyond a conflict-of-interest model, we use the conceptual and normative framework of institutional corruption to examine how organized psychiatry’s dependence on drug firms has distorted science. We suggest that academic-industry relationships have led to the corruption of …

Case study in which Bernadette was heading the corporate acquisitions team. It was important for Bernadette to be certain that there was no unethical behavior on the part of the project and management team responsible for the acquisition and integration of these companies. The pressures to achieve synergies can often result in people problems, cultural value, and ethical differences that impede the smooth integration of companies. For each acquisition, Bernadette needed to ensure that the newly acquired assets were secure. In addition, she had to ensure that the acquired companies were not employing inappropriate accounting practices in order to inflate …

Something Bad In Your Briefs, Richard H. Underwood
Law Faculty Scholarly Articles
In a profession heavily driven by writing, plagiarism is an ethical issue that plagues the legal community. The legal profession generally views plagiarism as unethical, but often sends mixed messages by condemning it in some settings, but not others. In this short Commentary, Professor Underwood discusses the ethical implications of plagiarism in legal writing.

Ethical Decision Making And Leadership: Merging Social Role And Self-Construal Perspectives, Crystal L. Hoyt, Terry L. Price
Jepson School of Leadership Studies articles, book chapters and other publications
This research extends our understanding of ethical decision making on the part of leaders by merging social role and self-construal perspectives. Interdependent self-construal is generally seen as enhancing concern for justice and moral values. Across two studies we tested the prediction that non-leading group members’ interdependent self-construal would be associated with lower levels of unethical decision making on behalf of their group but that, in contrast, this relationship would be weaker for leaders, given their social role. These predictions were experimentally tested by assigning participants to the role of leader or non-leading group member and assessing the association between their …

Preserving Moral Recognition In The Face Of Aggression: Aikido As A Practice Of Physical Intersubjectivity, Charles W. Wright
Philosophy Faculty Publications
Practitioners of Aikido advance the claim, peculiar to many, that martial training can support moral action. This essay examines the claim by exploring communicative structures implicit in the response to attack made possible by this art's techniques. This exploration reveals three dimensions of intersubjectivity embedded in the practice of Aikido, dimensions that explicate the ethical imperative of the art.

Ethics Readiness: An Analysis Of Community College Students' Moral Sensitivity Scores, Julie Wallace
Doctoral Dissertations and Projects
In this retrospective causal-comparative study, the readiness of Virginia community college students to receive an accounting ethics curriculum was analyzed by measuring and comparing their moral sensitivity scores to the moral sensitivity scores of a group of four year university students. A sample of college students attending community college principles of accounting courses and a sample of college students attending four year university principles of accounting courses were administered a nationally recognized moral sensitivity survey instrument, the Defining Issues Test 2 (DIT2). The survey results were analyzed using a t-test for differences between means. It was found that there was …

Research Papers, Working Papers, Conference Papers
It is not unusual for patients and their families when confronted with difficult medical choices to ask their physicians for advice This paper outlines the shades of meaning of two questions frequently put to physicians What should I do and What would you do It is argued that these are not questions about objective matters of fact Hence any response to such questions requires an understanding appreciation and disclosure of the personal context and values that inform the recommendation A framework for considering and articulating a response to these questions is suggested using as a heuristic the phrasing If I …

The Buddhist Coleridge: Creating Space For The Rime Of The Ancient Mariner Within Buddhist Romantic Studies, Katie Pacheco
The Buddhist Coleridge: Creating Space For The Rime Of The Ancient Mariner Within Buddhist Romantic Studies, Katie Pacheco
FIU Electronic Theses and Dissertations
The popularization of academic spaces that combine Buddhist philosophy with the literature of the Romantic period – a discipline I refer to as Buddhist Romantic Studies – have exposed the lack of scholarly attention Samuel Taylor Coleridge and The Rime of the Ancient Mariner have received within such studies. Validating Coleridge’s right to exist within Buddhist Romantic spheres, my thesis argues that Coleridge was cognizant of Buddhism through historical and textual encounters. To create a space for The Rime within Buddhist Romantic Studies, my thesis provides an interpretation of the poem that centers on the concept of prajna, or wisdom, …
The Future Of Military Virtue: Autonomous Systems And The Moral Deskilling Of The Military, Shannon Vallor
The Future Of Military Virtue: Autonomous Systems And The Moral Deskilling Of The Military, Shannon Vallor
Philosophy
Autonomous systems, including unmanned aerial vehicles (UAVs), anti-munitions systems, armed robots, cyber attack and cyber defense systems, are projected to become the centerpiece of 21st century military and counter-terrorism operations. This trend has challenged legal experts, policymakers and military ethicists to make sense of these developments within existing normative frameworks of international law and just war theory. This paper highlights a different yet equally profound ethical challenge: understanding how this trend may lead to a moral deskilling of the military profession, potentially destabilizing traditional norms of military virtue and their power to motivate ethical restraint in the conduct of war. …
Euphemisms And Ethics: A Language-Centered Analysis Of Penn State’S Sexual Abuse Scandal, Jeremy Fyke, Kristen Lucas
Euphemisms And Ethics: A Language-Centered Analysis Of Penn State’S Sexual Abuse Scandal, Jeremy Fyke, Kristen Lucas

For 15 years, former assistant football coach Jerry Sandusky used his Penn State University perquisites to lure young and fatherless boys by offering them special access to one of the most revered football programs in the country. He repeatedly used the football locker room as a space to groom, molest, and rape his victims. In February 2001, an eye-witness alerted Penn State's top leaders that Sandusky was caught sexually assaulting a young boy in the showers. Instead of taking swift action against Sandusky, leaders began a cover-up that is considered one of the worst scandals in sports history. While public …

Jesus, I Trust In You: St. Thomas Aquinas' Jubilee, John A. Sohl
Mahurin Honors College Capstone Experience/Thesis Projects
The concept of “Life Reporting” is a completely new idea, at least in terms of how I have experienced it. In today’s world of blogs and social networking, it is essential for broadcast journalists to embrace their own lives in the same world of professional and ethical reporting. As I describe my experience of St. Thomas Aquinas’ Jubilee, I have no choice but to provide the context and build-up of this intense passion toward my overarching point. Working through all the communities of which I have been a part, from attending St. Luke Catholic Church all the way to the …
The Ethics Of Conscious Capitalism: Wicked Problems In Leading Change And Changing Leaders, Jeremy P. Fyke, Patrice M. Buzzanell
The Ethics Of Conscious Capitalism: Wicked Problems In Leading Change And Changing Leaders, Jeremy P. Fyke, Patrice M. Buzzanell
College of Communication Faculty Research and Publications
Given corporate scandals, organizational crises, and accounting irregularities (e.g. Citigroup, BP oil spill, Enron, Arthur Andersen), leadership ethics has grown in relevance. The current study takes a discursive approach to engage in a multimethod case study of a consulting and leadership development firm that takes Conscious Capitalism as the impetus for, and target of, leader development. Using constructivist grounded theory and critical discourse analysis, we reveal themes and ‘best practices’ voiced by consultants and clients for cultivating mindfulness and developing ethical leaders, as well as micro- and macro-level paradoxes, tensions, and challenges: structuring-releasing; expanding-contracting; opening up-closing; and collaborating-competing. Our critical …

Blackwell Companions, and instalments from similar series, should be initially sized up according to their purpose and audience. Such hefty tomes present themselves first as reference books—as collections of articles by scholarly experts that treat the key methods, topics, historical developments, etc., in the field. Second, each Companion is addressed to students and teachers as a state-of-the-field resource that provides several benefits: a sound picture of the field, assessment of various theories and methods used in the field, a sense of the innovative developments and open questions, and plenty of information to follow up on. Finally, some Companions give primacy …

Just Because You're Offended Doesn't Mean You're In The Right: A Perspective On Language, Comedy, And Ethics, James H. Garrett

Some humor is offensive, but does this convey a moral constraint on what comedians can include in their jokes? Using stand up bits and reflections on comedy from George Carlin, Louis C.K., and Doug Stanhope, various philosophies of humor, and the linguistic philosophy of H.P. Grice, I explore the given question and attempt to settle the disputes about when it is prudent to be offended, in what ways comedians should be allowed to offend, and whether or not words can hurt just as much as sticks and stones.

When Kashrut Is Not "Kosher": The Post Postville Struggle Over Eating, Ethics And American Jewish Identity, Rebecca Z. Hornstein
Religious Studies Honors Projects
On May 12, 2008, the United States Government conducted a massive immigration raid within the country’s largest kosher meatpacking plant. The raid and ensuing revelation of worker’s rights violations within the plant sparked an intense intra-Jewish debate over the extent to which unethically produced food could be considered kosher. This thesis analyzes the perspectives and actions of the debate’s major participants and argues that the discourse surrounding ethical kashrut in the context of the Postville immigration raid revealed that American Jewish communities have entered into a period of flux. Through this instability, many American Jews are challenging the once …
Cultural Influences On Accounting And Its Practices, Meredith Young
Cultural Influences On Accounting And Its Practices, Meredith Young
Senior Honors Theses
This thesis discusses various cultural aspects that have influenced accounting. Hofestede (1984) and Gray (1988) conducted studies and observations of the cultural dimensions and values that have contributed to culture and accounting research. National culture is broad in its influences, but affects the smallest aspects of society-even accounting. Accounting is also influenced by organizational culture, the overall environment in which a company functions. Next is ethics, an integral aspect of accounting, persuaded by the culture in which it is derived. Religion is more than a belief; it constitutes a way of life, involving unique practices and perspectives in accounting. Last, …

Understanding The Complexities Of The Gay Marriage Issue, Kevin Twain Lowery
Understanding The Complexities Of The Gay Marriage Issue, Kevin Twain Lowery
Faculty Scholarship – Theology
The goal of this paper is to help frame the issue of gay marriage in a constructive way, without the rhetoric and the oversimplifications that are too often prevalent. It is the author’s contention that this issue is not ultimately about legal rights; it is about legitimation. In order to support this claim, it is first necessary to clarify the various aspects of the issue, namely, homosexuality itself, the role of marriage in society, and the hermeneutical challenge of formulating a Christian response. The paper also briefly considers some of the more common arguments that are made for or against …
