For several years now, the question of “trademark use” has taken center stage in the debate over trademark liability of online intermediaries. Doctrinally, the debate addresses whether the Lanham Act places any limit on the types of “use” of trademarks that can subject one to a claim of infringement. The real conflict, however, has occurred at the normative level: whatever the Lanham Act says or does not say about trademark use, should trademark law limit the definition of infringement to situations in which the defendant has used the mark to brand its own products?

Myths and assumptions about creativity often lead us to believe that creativity is innate. Researchers find though, that we develop creative skills like any other ability, through opportunity, encouragement and practice. They also believe that most people fail to reach their creative potential, not because of lack of ability, but lack of opportunity. In this paper, I studied how creativity functions (specifically in terms of my own painting practice) and how it can be applied more flexibly. Certain factors, such as access to strong mentors, freedom to experiment, and readily available resources, help potentially exceptional minds find the passion to …

The University of Maine, the University of Southern Maine, several baccalaureate institutions in the state, along with other federal, state and local public, private, and non-profit institutions will collaborate to create the Forest Bioproducts Research Institute (FBRI) at the University of Maine. The vision of the FBRI is to advance understanding about the scientific underpinnings, system behavior, and policy implications for the production of forest-based bioproducts that meet societal needs for materials, chemicals, and fuels in an economically and ecologically sustainable manner.

Is the analysis of patron–client networks still important to the understanding of developing country politics or has it now been overtaken by a focus on ‘social capital’? Drawing on seventeen country studies of the political environment for livestock policy in poor countries, this article concludes that although the nature of patronage has changed significantly, it remains highly relevant to the ways peasant interests are treated. Peasant populations were found either to have no clear connection to their political leaders or to be controlled by political clientage. Furthermore, communities ‘free’ of patron–client ties to the centre generally are not better represented …

The focus of my Synthesis Project is the development of a Curriculum Guide that outlines the importance of building relationships with young people that are meaningful, supported, structured and collaborative. In developing this guide, I felt it was essential to create a framework that will support my work within youth development, for young people ages 9-19, in order to scaffold learning and foster opportunities for resilient thought. Electrical Impedance Imaging Of Corrosion On A Partially Accessible 2-Dimensional Region, Court Hoang, Katherine Osenbach
Mathematical Sciences Technical Reports (MSTR)
In this paper we examine the inverse problem of determining the amount of corrosion on an inaccessible surface of a two-dimensional region. Using numerical methods, we develop an algorithm for approximating corrosion profile using measurements of electrical potential along the accessible portion of the region. We also evaluate the effect of error on the problem, address the issue of ill-posedness, and develop a method of regularization to correct for this error. An examination of solution uniqueness is also presented.

Recent developments in cloaking, the ability to selectively bend electromagnetic waves so as to render an object invisible, have been abundant. Based on cloaking principles, we will describe several ways to mathematically disguise objects in the context of electrical impedance imaging. Through the use of a change-of-variables scheme we show how one can make an object appear enlarged, translated, or rotated by surrounding it with a suitable "metamaterial," a man-made material that selectively redirects current. Analysis of eigenvectors and eigenvalues, which describe how current flows, follow. We prove that in order to disguise an object, a metamaterial must encompass both …

Inflation, Quantum Fields, And Cmb Anisotropies, Iván Agulló, José Navarro-Salas, Gonzalo J. Olmo, Leonard Parker

Inflationary cosmology has proven to be the most successful at predicting the properties of the anisotropies observed in the cosmic microwave background (CMB). In this essay we show that quantum field renormalization significantly influences the generation of primordial perturbations and hence the expected measurable imprint of cosmological inflation on the CMB. However, the new predictions remain in agreement with observation, and in fact favor the simplest forms of inflation. In the near future, observations of the influence of gravitational waves from the early universe on the CMB will test our new predictions. © 2009 World Scientific Publishing Company.

Participants considered the PLA’s relationship with the Chinese Communist Party; trends in the PLA’s ongoing reforms to informationalize, mechanize, and adapt to China’s evolving defense needs; and the PLA’s role in tackling internal security challenges. PLA operations abroad were discussed, with participants assessing trends in the pace, scope, goals, and success of logistics reform and the impact of these reforms on PLA capabilities. Deficiencies are well-documented, but significant progress is being made. The exact pace, scale, and success of the PLA’s modernization efforts must be assessed. Participants were tasked to address how the PLA is determining what types of missions …
