Feminist Consciousness And Social Capital: Bonds, Breaks, And Bridges, Beverly A. Beyer

Master's Theses - Sociology and Anthropology

Through in-depth qualitative interviews with five current or former members of a midwestern National Organization for Women (NOW) chapter, this thesis explores four related research questions regarding: growth of feminist consciousness; how feminist ideology affects the evolution of social networks, and vice versa; the impact of intersecting social hierarchies; and feminism as a force for bonding and bridging social capital in the local community context. Analytical tools include feminist methodology, the articulation model, an understanding of intersecting social hierarchies, and grounded theory.

This article critiques the feminist view Ute Gerhard offers in “Debating Women's Equality: Toward a Feminist Theory of Law from a European Perspective”. Throughout Debating Women's Equality, Gerhard appears to have three ambitious objectives in mind: (1) to decry the paucity of research into women's legal history while beginning to do the needed work, focusing primarily on Germany but also broadly exploring European trends, (2) to demonstrate that German/European women's legal history ultimately vindicates reliance on “equal rights” as a political strategy for women, and (3) to develop an understanding of legal equality that can serve as a meaningful tool …

Although feminism, of course, emerged out of the actual personal experiences of discrimination and other forms of subordination, ameliorating such obstacles required and requires a collective politics, most identifiable in liberal feminism’s focus on equality of opportunity in the public domain, such as Title IX or the push for the ERA I described. Whatever Debra Barnes’s individual achievements, those obviously neither did have nor could have had bearing on the eventual opportunity of young women to participate in intercollegiate athletics, as I did, or to make the legal reproductive decisions occasioned by Roe v.Wade. Practicing Politics With Foucault And Kant: Toward A Critical Life, Dianna Taylor

Philosophy

This paper problematizes the claim that Michel Foucault’s work is normatively lacking and therefore possesses only limited political relevance. While Foucault does not articulate a traditional normative framework for political activity, I argue that his work nonetheless reflects certain normative commitments to, for example, practicing freedom and improving the state of the world. I elucidate these commitments by sketching out Foucault’s notion of critique as a mode of existence charac- terized by practices of the self, arguing that such practices possess political significance within the context of what Foucault refers to as a way of life, and analyzing points of …

Why The Model Penal Code's Sexual Offense Provisions Should Be Pulled And Replaced, Deborah W. Denno

By all accounts, the Model Penal Code is enormously respected and influential. Yet, relatively soon after the Code's 1962 publication, the Code's sexual offense provisions and even its 1980 revised Commentaries were already considered outdated. The rapid onslaught of the sexual and feminist revolutions of the 1960s and 1970s brought an intense momentum to change rape laws that the Code had, in part, either mirrored or inspired. Only because of the passage of time, the Code's sexual offense provisions and Commentaries now misrepresent the progressive thinking of the Code's reporters. This article offers an analysis of a struggle for control of a women’s development project in Nepal. The story of this struggle is worth telling, for it is rife with the gender politics and neo-colonial context that underscore much of what goes on in contemporary Nepal. In particular, my analysis helps to unravel some of the powerful discourses, threads of interest, and yet unintended effects inevitable under a regime of development aid. Among the many strands of political and intellectual dissidence during the July Monarchy, socialism and feminism must be counted as two of the most ephemeral and, paradoxically, the most enduring. Romantic socialism of the 1830s and 1840s saw a profusion of fantastical aspirations crushed by the failure of the revolution of 1848, and the brief flowering of feminism during the period was cut short by the social and political repression of the Second Empire. Their influence is still felt, though these original incarnations were short lived. For the duration of the July Monarchy and the Second Republic, however, both socialism …

This is a critique by two non-white law professors in the form of a conversation about the relevance offeminist law journals on their lives and scholarship. We conclude that the impression that feministscholarship now is accepted in mainstream law reviews may be illusory and thus there is a continuing need for feminist law journals. In the past rather than creating a new type of journal, feminist law journals tend to replicate the traditional law journal model. Only the focus is different.
