This essay prods moral philosophy towards more explicit attention to the political constructions of injustice. I do not appeal to practical or political relevance, but advance a particular kind of constructivist interpretation of moral argumentation (constructivism+) in which our interpretive horizons are extended to include the implicit views of social action, broadly construed—from the macro- to the micro-social, and from the past to the present and the possible—built into philosophical arguments. Prosecutorial Misconduct In Presenting Evidence: "Backdooring" Hearsay, Bennett L. Gershman

Rules of evidence are designed to bring about just and informed decisions. One of these rules, the hearsay rule, is designed to ensure that juries receive reliable evidence, and that out-of-court statements ordinarily are inadmissible. Prosecutors are well aware of these evidentiary restrictions, but occasionally seek to circumvent them. The author describes methods used by some prosecutors to manipulate the hearsay rule and thereby distort the truth-finding process of the trial.

This Article is a case study of the California State Bar lawyer discipline system in crisis. The Bar's lawyer discipline system is the official state mechanism for regulating the professional conduct of California's more than 100,000 lawyers. The State Bar in California self-regulates as an adjunct of the judicial branch of government. The State Bar operates in this capacity as a quasi-governmental body while at the same time functioning as a professional organization, of which one role is to represent the collective interests of California lawyers. Metaphors Matter: How Images Of Battle, Sports And Sex Shape The Adversary System, Elizabeth G. Thornburg

Metaphors are not pretty figures of speech; they affect the way people within cultures perceive reality. It is therefore significant that the metaphors most commonly used for the adversary system center on war and sports. This tends to over-emphasize the competitive aspects of litigation and disguise opportunities for more cooperative behavior. This article collects and analyzes those metaphors, and discusses the reasons for their powerful hold on legal culture. It also considers some of the negative effects of the metaphorical system and speculates about whether we could find and nurture alternative metaphors.

In conceptualizing animal welfare, it is useful to distinguish among three types of concepts. 'Type l' are single, measurable attributes. 'Type 2' are single attributes that cannot be measured directly but can be estimated by correctly combining various contributing attributes. 'Type 3' are concepts involving multiple attributes which are grouped together because they serve some common function, and whose relative importance cannot be established in an entirely objective way. Individuals who treat animal welfare as a type 1 concept may propose single, objective measures of welfare, such as longevity or levels of stress-related hormones; however, this approach rests on judgements, …

This is the report of the eleventh of a series of workshops organised by the European Centre for the Validation of Alternative Methods (ECVAM), which was established in 1991 by the European Commission. ECVAM's main goal, as defined in 1993 by its Scientific Advisory Committee, is to promote the scientific and regulatory acceptance of alternative methods which are of importance to the biosciences and which reduce, refine or replace the use of laboratory animals. The Old Testament book of Proverbs supplied foundational moral values for our nation's legal ethics. With the adoption and revision of formal codes, moral teaching has virtually disappeared from legal ethics. This essay suggests that the wisdom of Proverbs offers a timely challenge to the character of the legal profession by advocating values which include justice, purity, mercy, humility, honesty, candor, truthful testimony, and civility.

The creation of embryos for research use has drawn a great deal of criticism. It is difficult to defend an ethical distinction between what one can do to "spare" embryos and what one can do to "research" embryos. The strongest ground on which to argue against the creation of embryos for research is a symbolic one, having to do with respect for human life. Using Spiritual Interventions In Psychotherapy: Practices, Successes, Failures, And Ethical Concerns Of Mormon Psychotherapists, P. Scott Richards, Richard W. Potts

Two hundred and fifteen (out of 300) randomly selected Mormon psychotherapists were surveyed and asked to indicate how frequently they use various spiritual interventions in psychotherapy and to describe successful and unsuccessful spiritual intervention case examples. The therapists indi- cated that they use a wide variety of spiritual interventions, including praying silently for clients, teaching spiritual concepts, encouraging forgiveness, and using the religious community as a sup- port. Many spiritual interventions were perceived by the therapists as potentially therapeutic. Pro- cess guidelines for using spiritual interventions were offered by the therapists, and ethical concerns (e.g., dual relationships, imposing values) were …

This article discusses the tension between the lawyer's duty to her client and her duty to the legal system as an officer of the court. It concludes that, in a situation in which those two duties conflict, the lawyer's duty to the system as a whole should trump the duty to the client.
