This special issue explores the conceptions of the human that emerge out of the form and the design of information and communications technologies (ICTs). Geographically, our focus compares two countries with a relatively high level of ICT penetration—South Korea and Singapore—and two countries with a relatively low level—India and Vietnam. In each country we see how different forms of the human emerge, in part out of the ways in which technological infrastructure develop and intertwine with social order. In this introduction we reflect on the long genealogy of “human” and “humanity” and the more recent history of ICTs in Asia.

This project explores the creation of alternative transitional justice spaces in post-conflict contexts, particularly concentrating on the role of art and the impact of social movements to address human rights abuses. Drawing from post-authoritarian Tunisia, it scrutinizes the work of contemporary youth activists and artists to deal with the past and foster sociopolitical change. Although these vanguard protesters provoked the overthrow of President Zine El Abidine Ben Ali in 2011, the power vacuum was quickly filled by old elites. Religious and cultural values have been used as a yardstick to disregard the rights and freedoms of people in non-normative sexual relationships in many African countries. However, little is known about the extent to which this assertion is empirically buttressed by public opinion in the Kumasi Metropolis in Ghana. Employing in-depth interviews and a focus group discussion, this study sought public opinion on how religious and cultural precepts informed attitudes and perception on same-sex sexuality. This article discusses critical comparisons between the human and nonhuman abolitionist movements in the United States. The modern nonhuman abolitionist movement is, in some ways, an extension of the anti-slavery movement of the eighteenth and nineteenth centuries and the ongoing human Civil Rights movement. As such, there is considerable overlap between the two movements, specifically in the need to simultaneously address property status and oppressive ideology. Despite intentional appropriation of terminology and numerous similarities in mobilization efforts, there has been disappointingly little academic discussion on this relationship. Sex, race, gender, sexuality, color, religion, language, nationality, ethnicity, culture, poverty - socially constructed categories, social tropes that relegate "others" to subordinated positions in the varied and various cultural and economic marketplaces of both global and local societies. Richard Delgado's transformational work engages all of these tropes insightfully, disturbingly, and illuminatingly. His rich literature conceptualizes persons as multidimensional, complex beings and exposes society as the pre-fabricated stage in which diverse interactions evolve. In this paper I argue that the discourse theoretic account of human rights defended by Jürgen Habermas contains a fruitful tension that is obscured by its dominant tendency to identify rights with legal claims. This weakness in Habermas’s account becomes manifest when we examine how sweatshops diminish the secure enjoyment of subsistence, which Habermas himself (in recognition of the UDHR) recognizes as a human right. Discourse theories of human rights are unique in tying the legitimacy of human rights to democratic deliberation and consensus. These cases of China, Occupy, and Gandhi suggest the value of the sociology of culture for understanding human rights. Since human rights is a cultural construct, human rights issues are in-flected by the same set of semantic tensions as the culture concept itself. The sociology of culture thus recommends a method for studying human rights: to explicate--indeed, to weave into an exegetical deep structure--those various tensions. This helps to see beneath the distortions that power and other forms of domination introduce into the discourse of human rights, and to recognize the full multiplicity of interests and voices.

Law disciplines technology, though it does so in a partial and incomplete way as reflected in the old adage that technology outstrips the capacity of law to regulate it. The rise of new technologies poses a significant threat to human rights – the pervasive use of CCTV (and now mobile CCTV), telecommunications interception, and low-cost audio-visual recording and tracking devices (some of these discreetly wearable), extend the power of the state and corporations significantly to intrude into the lives of citizens.

Human rights declarations provide the right for any person to leave their country, yet do not provide the right to enter another country, stopping halfway in asserting a right to mobility. In this article we provide evidence that 1) state policies and actions create migration flows; 2) migrants often travel to fulfil their human rights; and 3) current restrictions on immigration curtail migrants’ human rights. We argue, based on sociological evidence, that the right to mobility is a fundamental human right, and deserves a place in human rights doctrine.

This Response argues that as ATS jurisprudence “matures” or becomes more sophisticated, the legitimate limits of the law regress. The further expansion within the corporate defendant pool – attempting to pin liability on parent, great grandparent corporations and up to the top – raises the stakes and complexity of ATS litigation. The Portuguese Constitution (1976) came after a period of 48 years of authoritarianism and a closed society, in which some happy few enjoyed great privileges while the great majority of people were charged with heavy duties So, by a very understandable "law of human nature", the constituent law givers could not reasonably impose constitutionally many obligations, in an autonomous way. As rights and duties are the twin sides of the same coin, the juridical formulation under the sign of rights also implies obligations, related to those same rights. Torture was formally abolished by European governments in the nineteenth century, and the actual practice of torture decreased as well during that period. In the twentieth century, however, torture became much more common. None of the theories that explain the reduction of torture in the nineteenth century can explain its resurgence in the twentieth. This paper argues that the use of torture follows the same patterns in contemporary times as it has in earlier historical periods.
