A Community Of Practice For Chinese Ngos, Reza Hasmath, Jennifer Yj Hsu
Reza Hasmath
A community of practice represents an important resource for the sharing of sector-specific knowledge. It is a mechanism for Chinese NGOs to learn from each other, and collaborate. Drawing upon original data elicited from over 100 NGOs, this article examines the organizational capacity for Chinese NGOs to cultivate a mature community of practice. We find that there are inherent headwinds that Chinese NGOs will have to navigate to accomplish this goal. On the one hand, the majority of NGOs in our sample do not see themselves as part of a community of experts, which presents a huge challenge for the …
International Legal Protection Of Trademarks In China, Robert H. Hu
International Legal Protection Of Trademarks In China, Robert H. Hu
Robert Hu
In China, the concept of intellectual property is relatively new. Chinese officials began taking steps towards trademark regulations in the 1950s, but it was not until 1982 that the first Chinese Trademark Law was enacted. Today, because of the growing global economy, China has had the highest number of trademark requests in the world for the fifth year in a row. In response to domestic and international pressures, Chinese trademark law and courts have had to adapt to the ever-changing landscape. This article first examines the development of Chinese intellectual property law through the international trademark agreements where China is …

Reassessing The Quality Of Government In China, Margaret Boittin, Greg Distelhorst, Francis Fukuyama
Margaret Boittin
How should the quality of government be measured across disparate national contexts? This study develops a new approach using an original survey of Chinese civil servants and a comparison to the United States. We surveyed over 2,500 Chinese officials on two organizational features of their bureaucracies: meritocracy and individual autonomy. They report greater meritocracy than U.S. federal employees in almost all American agencies. China's edge is smaller in autonomy. Differences between the U.S. and China diminish, but do not disappear, after adjusting for respondent demographics. The meritocracy gap is also robust to excluding the Chinese respondents most likely to be …

Cui Jian: Extolling Idealism Yet Advocating For Freedom Through Rock Music In China, Zhaoxi Liu
Zhaoxi Liu
Examining Cui Jian's songs as text, this study attempted to provide a reading of its political meaning that is different from many previous studies. Through a textual analysis of the revolutionary symbols in four of Cui's hits, this study found that the political meaning of Cui's songs is much more nuanced than a simple oppositional message, as he simultaneously endorses the Communist rule for its idealism and disavows it for its political suppression. Being China's first rocker, Cui Jian is politicized by the social discourse surrounding him as well as his own expressions, as he pursues his idealism and identity …

How A Latecomer Company Used It To Redeploy Slack Resources, Wenyu Du, Shan L. Pan, Jinsong Huang
Humayun Zafar
Many companies slow in adopting modern enterprise systems are catching up. An important agenda of CIOs of these latecomer companies is to redeploy slack resources into productive use. IS research, however, has not previously studied how to use IT to redeploy slack resources. Based on an in-depth case study of the digital transformation completed by a latecomer - XCMG, the largest construction machinery manufacturer in China - we derive a four-phase process model of IT-enabled slack redeployment and provide six recommendations for CIOs. These findings and recommendations are timely because, as the economy slows, slack resources are becoming commonplace in …

The New-Breed, “Die-Hard” Chinese Lawyer: A Comparison With American Civil Rights Cause Lawyers, James E. Moliterno, Rongjie Lan
James E. Moliterno
In times of social upheaval, lawyers can mark the way toward social change. In particular, when lawyers become more aggressive than traditional lawyers in the cause of fighting injustice, they face backlash from multiple sources, including government and their own profession. Such was the case during the U.S. civil rights movement. Unusually aggressive behavior by cause lawyers was met with hostility from their own profession and from government action. Those lawyers, while battered at times with physical violence, bar ethics charges, contempt of court, and state hostility, survived and changed social conditions at the same time they altered the culture …

The Rise And Decline Of The Intellectual Property Powers, Peter K. Yu

Since its reopening to foreign trade in the late 1990s, China has been the poster child of intellectual property piracy and counterfeiting. Virtually every year, the Office of the United States Trade Representative (USTR) lists China on its watch list or priority watch list. The country’s piracy and counterfeiting problems have also been frequently mentioned in connection with international intellectual property enforcement initiatives, such as the highly controversial Anti-Counterfeiting Trade Agreement (ACTA) and the equally problematic domestic legislative proposals for heightened copyright enforcement. In a recent report, the International Trade Commission estimated that “firms in the U.S. [intellectual property]–intensive economy …

International Intellectual Property Scholars Series: Intellectual Property And Asian Values, Peter K. Yu, Peter K. Yu

From Niall Ferguson to Fareed Zakaria, commentators have paid growing attention to the rise of Asia and its implications for the West. Recent years have also seen the emergence of a growing volume of literature on intellectual property developments in Asia, in particular China and India. Few commentators, however, have explored whether Asian countries will take unified positions on international intellectual property law and policy.
Commissioned for the Inaugural International Intellectual Property Scholars Series, this article fills the void by examining intellectual property developments in relation to the decades-old 'Asian values' debate. Drawing on the region's diversity in economic and …

When The Chinese Intellectual Property System Hits 35, Peter K. Yu
Peter K. Yu
This article explores what it means for the Chinese intellectual property system to hit 35. It begins by briefly recapturing the system’s three phases of development. It discusses the system’s evolution from its birth all the way to the present. The article then explores three different meanings of a middle-aged Chinese intellectual property system – one for intellectual property reform, one for China, and one for the TRIPS Agreement and the global intellectual property community.

This study was undertaken to develop a model to predict the incidence of typhoid in children based on adults’ perception of prevalence of enteric fever in the wider community. Typhoid cases among children, aged 5-15 years, from epidemic regions in five Asian countries were confirmed with a positive Salmonella Typhi culture of the blood sample. Estimates of the prevalence of enteric fever were obtained from random samples of adults in the same study sites. Regression models were used for establishing the prediction equation. The percentages of enteric fever reported by adults and cases of typhoid incidence per 100,000, detected through …
What Could Tourism Do To A Small Fishing Village: A Case Study Of The City Of Weihai, China, Babu P. George
What Could Tourism Do To A Small Fishing Village: A Case Study Of The City Of Weihai, China, Babu P. George
Babu George
Weihai City, located on the east end of Shandong Peninsula in Northeastern China was once a small and remote fishing village. In recent years Weihai City has become one of the most popular tourism destinations in China. The tremendous development of tourism has had a significant impact on Weihai’s economy, physical environment, and culture. Weihai is now famous for the beautiful coastal scenery, high quality leisure living, and a strong Korean and increasingly Russian influence. This study examines the perception of Weihai residents on the position of Weihai as a tourist destination and also their vision of Weihai’s future tourism …
Modern Chinese Defence Strategy: Present Developments, Future Directions, Rosita Dellios
Modern Chinese Defence Strategy: Present Developments, Future Directions, Rosita Dellios
Rosita Dellios
The author argues that the Chinese believe in the strategy of "people's war under modern conditions", and are confident that middle-range technology and unconventional warfare and the combination of the "human" and "weapon" factors represent a successful application of the strategy. Extract: A new era in Chinese defence policy followed the ascent in 1977 of China's most powerful political and military leader since Mao. After being disgraced in 1966 and again in 1976, Deng Xiaoping (Teng Hsiao-ping) returned to the ruling ranks for the third time in July 1977. A decade of self-strengthening and reform would result. The objective of …
Mapping Researcher Mobility: Measuring Research Collaboration Among Apec Economies, Ali Radloff
Mapping Researcher Mobility: Measuring Research Collaboration Among Apec Economies, Ali Radloff
Ali Radloff
Researcher mobility is an important form of cross-border education (CBE). It has the potential to generate significant benefits for economies as expert scholars and scientists come together to solve some of the most pressing challenges in the contemporary world. Among members of the Asia-Pacific Economic Community (APEC) researcher mobility can strengthen ties between economies and enable the minimisation of barriers to economic growth and sustainability. There are not currently any comparable or rigorous data available on researcher mobility among APEC economies. Proxy measures are needed to gain a sense of the extent to which researchers in APEC economies are collaborating …

Mulan And Filial Piety: Lesson Plan, Kitty Lam
Kitty Lam
In this lesson, students will examine the relationship between gender roles and Confucian principles in pre-modern China by considering the extent to which the Mulan legend is compatible with the Confucian concept of filial piety. Students will read and discuss texts on filial piety by Confucian scholars, as well as three different works of Chinese literature based on the Mulan legend from three distinct time periods.
