Marbury In Mexico: Judicial Review's Precocious Southern Migration, M. C. Mirow
M. C. Mirow
Scholars agree that the United States Supreme Court did not "discover" the general judicial review aspects of Marbury v. Madison (1803) until nearly a century later in 1895. This article reveals that the Mexican Supreme Court, relying heavily on U.S. constitutional sources and actually quoting Marbury, discovered this aspect of the case more than a dozen years earlier than the United States Supreme Court.
In attempting to construct United States-style judicial review for the Mexican Supreme Court in the 1880s, Ignacio Vallarta, president of the court, read Marbury in a way that preceded this use of the case in the …

Patient Self-Management: Tools And Barriers, Dennis J. Baumgardner
Patient Self-Management: Tools And Barriers, Dennis J. Baumgardner
Dennis J. Baumgardner, MD
In his issue introduction, the editor-in-chief of the Journal of Patient-Centered Research and Reviews comments on the theme of patient self-management of chronic diseases and the related articles published therein. Illnesses such as cardiovascular disease, diabetes, epilepsy, arthritis, asthma, and obesity often require patients to administer their own medication daily or adhere to strict dietary restrictions. Progress is being made on the process of implementation and evaluation of patient self-management tools in primary care practices. Barriers to self-management tool implementations in clinics, as well as their use by individual patients, must be understood and addressed.

JMU Libraries & Educational Technologies participated in a 2017 pilot project with VIVA to present special collections records through a BIBFRAME discovery platform. This poster describes the project's goals, the steps we took to prepare our records for conversion into linked data by Zepheira, and our observations on usability of the discovery layer and the effects on search engine optimization.

OBJECTIVE: To discover what factors influence librarians to publish or present their work. The study aims to determine what type of publications and presentations are most prevalent, what external factors impact the decision to publish or present, what internal factors affect the decision, and why one chooses to do one rather than the other or both.

Social Norms Approach In Secondary Schools: Literature Review, Syeda Kashfee Ahmed, Pru Mitchell, Jenny Trevitt
Pru Mitchell
Life Education Australia commissioned the Australian Council for Educational Research to provide a summary of research related to interventions that used a social norms approach (SNA). The review focused on interventions aimed at reducing risky behaviours in secondary school students, particularly related to use of alcohol, tobacco and other drugs. Research questions There were two key questions guiding this literature review: Question 1: If we make more realistic the perceptions of young people about the levels of risky behaviour, and attitudes towards these risky behaviours, amongst their peers, is that likely to reduce the likelihood of them engaging in such …

A Self‐Adaptive Energy Dissipation Structure For Low Speed Impact And Pedestrian Protection, James Wu
A Self‐Adaptive Energy Dissipation Structure For Low Speed Impact And Pedestrian Protection, James Wu
James K. Wu, M.D.
Bumper design regulations for low-speed vehicular impacts (Part 581, Bumper Standard, formerly FMVSS 215) and high-speed pedestrian impacts (ECE 127/GTR 9) possess a contradictory set of requirements. Essentially, an ideal bumper structure should be stiff under low-velocity vehicular impacts while exhibiting a softer response when impacting pedestrians at elevated velocities to satisfy both regulations. A series of energy absorbing structures capable of passively adapting their mechanical responses based on the loading conditions were investigated using finite element modelling tools which were validated to a series of experimental testing observations. The preferred structure consisted of a rectangular array of trapezoidal cells …

Context: Hispanic adults experience disparities in rates of colorectal cancer (CRC) screening. This RE-AIM analysis encompassed a multilevel decision support and navigation intervention (DSNI) for CRC screening. Interim findings were previously presented; we now aim to share the final analysis, particularly for effectiveness and implementation. Objective: Apply RE-AIM framework to a completed randomized controlled trial of a CRC screening intervention for Hispanic adults Setting: Five primary care practices Patients or Other Participants: Potential participants included a sampling frame of 2,720 screening-eligible patients, ages 50-75, Hispanic ethnicity, without history of CRC and polyps. 400 participants were enrolled. Intervention/Instrument: Decision support and …

Smoke But No Fire: When Innocent People Are Wrongly Convicted Of Crimes That Never Happened, Jessica S. Henry
Smoke But No Fire: When Innocent People Are Wrongly Convicted Of Crimes That Never Happened, Jessica S. Henry
Jessica S. Henry
Nearly one-third of exonerations involve the wrongful conviction of an innocent person for a crime that never actually happened, such as when the police plant drugs on an innocent person, a scorned lover invents a false accusation, or an expert mislabels a suicide as a murder. Despite the frequency with which no-crime convictions take place, little scholarship has been devoted to the subject. This Article seeks to fill that gap in the literature by exploring no-crime wrongful convictions as a discrete and unique phenomenon within the wrongful convictions universe. This Article considers three main factors that contribute to no-crime wrongful …

The Australian Council for Educational Research (ACER) conducted an online survey of members on behalf of the Tasmanian Branch of the Australian Education Union (AEU). The survey, which was open to teachers, school leaders (principals and assistant principals) and education support staff working in Tasmanian government schools and offices, was available to the majority of members of the Union in August 2017, and remained open for four weeks during Term 3. The survey was based on one conducted for the Victorian branch of the AEU in 2016. The survey of the work of union members in Tasmanian government schools focussed …
