Spending a night at a typical big city shelter for the homeless has reminded the author of the massive and regimented environment in institutions that she had mistakenly believed no longer existed after the much acclaimed "deinstitutionalization" of America. St. Mary's is run by a religious order attempting to provide charitable care in a nondemanding environment. Many demands are made, however. The lack of privacy and respect for individuality inherent in institutional life tends to erode the "inmate's" very conception of self. It controls their activities, time, and choices, and thus creates barriers to exit. Providing "shelter" for the homeless …

Fixing The Wheel: A Critical Analysis Of The Immigrant Investor Visa, Ronald R. Rose

In 1990, Congress attempted to fill a long-standing void in the United States immigration laws by providing an updated immigrant investor visa codified as section 203(b)(5) of the Immigration and Nationality Act. The old, obsolete immigrant investor visa had only required a $40,000 investment. The new visa generally requires a $1,000,000 investment. The demand for this new higher priced version has, however, been exceedingly low. Although this immigrant investor visa category allows for 10,000 visa issuances per year, only 78 were issued in fiscal 1992 and no more than 500 are expected to be issued in fiscal 1993. Members of the Congregation are not to seek the Church’s honors. For this reason, the nineteenth general assembly (1843) declared that Vincentians who assumed episcopal positions without the superior general’s consent would be deprived of suffrages for the dead. Vincentian John Joseph Lynch was the third bishop and first archbishop of Toronto. Although he wrote to Superior General Jean-Baptiste Etienne about his appointment to the bishopric, he did not receive a reply. His well-known dedication to the community, an assurance from his predecessor that Etienne had consented to his elevation, and the fact that he wrote to Etienne had led …

The "Family" In The Work Of Madame Justice Wilson, Mary Jane Mossman

Susan Moller Okin's assertion about the need for justice in families offers a challenging starting point for an assessment of the family in the work of Justice Wilson. Her assertion challenges us for a number of reasons. First, in claiming that justice in the family is a prerequisite to a just society, Okin compels us to focus careful attention on our family relationships if we aspire to a just resolution of our public and political debates. For her, a satisfactory theory of justice can be developed only if it takes account of the structures and power in family relationships, and …

In this Article, Professor Cane discusses the problems of United States banking regulations in the new global financial system. These problems include antiquated legislation, the deposit insurance system, the dual federal-state banking system, and restrictive branching laws. Part II discusses the current deposit insurance system and options for reform. Part III poses the question of whether the United States should have "national" treatment or "reciprocal national" treatment for financial institutions. Part IV discusses the limitations the United States has put on its financial institutions and the disadvantage these limitations have caused globally. Finally, in Part V, Professor Cane discusses a …

An analysis of O'Brien v. Cunard Steamship Co. readily demonstrates how economic concepts can help enlighten legal thought, enable judges and lawmakers to select optimal legal rules, and assist law students and others to understand the implications of alternative legal decisions. Because O'Brien has several aspects that can be explained quite well through the economic approach, the case also could be used to teach a number of important economic insights that often provide useful aids to legal analysis. The goal of our program on "Ideology in the Classroom" initially was to explore the proper role of ideology in the classroom with the help of representatives of critical race theory, law and economics, feminist legal thought, and critical legal studies. From the perspective of the original planners of the program, the discussion of a case like O'Brien v. Cunard Steamship Co., were viewed simply as a means to that end.
