In two cases decided in the mid-sixties, Estes v. Texas and Sheppard v. Maxwell, the Supreme Court of the United States held that extensive media coverage of these criminal trials denied the defendants due process of the law. In 1979, in In re Post-Newsweek Stations, Florida, Inc., the Supreme Court of Florida adopted rules that allowed the televising of trials. This note analyzes both the Post-Newsweek case and the recent decision in Chandler v. Florida, in which the Supreme Court of the United States reviewed an application of Florida's rules on the televising of trials, recognized that such …

Sentencing A Defendant To Death: Procedural Review Of The Use Of Testimony From Compelled Psychiatric Examinations, Lori Ann Weiner

In this casenote, the author critically examines the recent decision of Smith v. Estelle, in which the Fifth Circuit used a dual rationale for vacating a death sentence. The court held that Texas violated the defendant's due process rights by producing a surprise psychiatric witness at sentencing. The court held also that the defendant had a fifth amendment right to refuse a court-compelled psychiatric examination because he had not waived that right by raising an insanity defense. Discussing this decision in the context of the constitutionality of death sentencing procedures, the author argues that the Supreme Court should uphold …

Foreign Attachment Power Constrained-An End To Quasi In Rem Jurisdiction?, James S. Carmichael

Pennsylvania's foreign attachment procedures were held to be an unconstitutional violation of due process by the United States Court of Appeals for the Third Circuit. This note analyzes the evolving concept of due process in its relation to summary seizures and places the instant decision within that framework. The author attempts to evaluate the court's attack of the attachment statute's constitutionality based on a balancing test for procedural due process as well as the concurring opinion's contention that a minimum contacts test should replace quasi in rem jurisdiction.
