What I wish to do, however, is to call attention to the manner in which Hegel speaks of Minerva's owl and to juxtapose both the manner and the substance of his thought about the twilight of philosophy and civilization with some of Hölderlin's dichterisch and Heidegger's denkerisch meditations on similar themes. For if Hegel has announced the coming of the night, Hölderlin and Heidegger have sought to make the night their very own territory and to comprehend it from within. Several years ago an article appeared in the pages of this journal which suggested that those attorneys who regularly focused on obtaining the maximum marital deduction in the wills they were drafting for their clients might be suffering from a form of estate planner's myopia. That is, they were losing sight of their ultimate goal of minimizing the total estate tax burden imposed on the husband's assets as they pass from him, through the wife, on to the ultimate beneficiaries. Tuning In The Boiler Room And The Cotton Patch: New Directions In The Study Of Afro-American Folklore, Daryl Cumber Dance

One of the first problems in the study of folklore is, of course, the collection of materials. In almost every area of Black folklore, the collecting was initiated by whites. As I have noted elsewhere, "Black folk forms seem to thrive quietly and abashedly in the Black community as items of private enjoyment and public shame until they are ' discovered ' by whites who legitimize them for the American public-Black and white. Such has been the case with the general folk tales (the animal tales, the etiological myths, the Slave John tales, etc.), the spirituals, and the blues. The …

Wit And Humor In The Slave Narratives, Daryl Cumber Dance

This passage suggests something of the nature of Black humor and the function it has served, not only in the slave narratives, but in the folk tales and throughout the history of recorded literature from William Wells Brown to Amiri Baraka. The life revealed in all of these sources is shown to often be alternately degrading and courageous, tragic and absurdly comic, hopeless and yet enduring; indeed that life could hardly ever be termed merely amusing. And the Black character, though he may be seen to laugh, can hardly be deemed carefree, unbothered, satisfied, even truly happy. Indeed the paradox …

Legal Malpractice: A Survey Of The Virginia Law, J. Rodney Johnson

A great deal has been written during the past several years about the increasing number of professional liability actions that are being brought against attorneys by their former clients. Indeed, some commentators have taken the position that a legal malpractice "crisis", similar to the medical malpractice crisis that has so adversely affected physicians in recent years, is imminent for the bar. This short note will turn away from the factual question concerning the existence of such a crisis and look instead at the legal issues that form the basis of an attorney's professional liability exposure in Virginia.
