Sponsored by Senator Larry E. Craig (R.-Idaho), S. 1484 is a bill to amend the Education Amendments of 1972, called Title IX (which guarantee equal access to the benefits of federally funded education without discrimination) in order to outlaw so-called speech codes at institutions of higher education that receive federal funds. The Craig bill prohibits "discrimination" or "official sanction"-such as expulsion, suspension, probation, censure, or reprimand- based on "protected speech" -i.e., "speech which is protected under the First and Fourteenth Amendments to the U.S. Constitution, or would be so protected if the institution of higher education …

An Asymmetrical Approach To The Problem Of Peremptories, Richard D. Friedman

The Supreme Court's decision in Batson v. Kentucky, and the extension of Batson to parties other than prosecutors, may be expected to put pressure on the insitution of peremptory challenges. In this article, Professor Richard Friedman contends that peremptories for criminal defendants serve important values of our criminal justice system. He then argues that peremptories for prosecutors are not as important, and that it may no longer be worthwhile to maintain them in a system of peremptories consistent with Batson. Friedman concludes that the asymmetry of allowing peremptories in a criminal case only for the accused is not troublesome.

While strategists struggle with the dilemmas of health care, they seem to overlook a practive that might simultaneously relive the suffering of elder patients and limit the costs of their treatment. To serve their clients' fully, health care providers and insurers need to provide not only means of maximizing health, but also means of minimizing misery and the dread of misery. They can provide these means by distributing acceptable forms of advance directives to their elder patients.

This piece was originally presented November 7, 1992 as the keynote address for the Eighth Annual Juan Luis Tienda Scholarship Banquet presented by the Hispanic Law Students Association (HLSA). The author is now Professor of Sociology at Michigan State University. He also holds appointments at MSU's Insitute of Public Policy and Social Research and at The University of Michigan's Center for Research on Social Organization. At the time of this presentation, he was Professor of Sociology at San Diego State University and Senior Research Fellow at the Center for U.S.-Mexican Studies at The University of California, San Diego.

Recently I had the opportunity to apply an unused procedure in a shareholder derivative litigation. In 1989 Michigan amended its Business Corporation Act to allow a court under specified circumstances to appoint a "disinterested person" to perform fact gathering functions similar to those of a German investigative judge. In 1991 I was appointed to be the disinterested person in a derivative litigation involving Rospatch Corporation. The experience persuaded me that compared to litigation and the special litigation committee, the disinterested person approach may often have significant advantages in terms of reduction of litigation costs, procedual fairness, and protection of shareholders.
