Up to 26% of adults and 4.3% of children (nearly 70.6 million people) in the US have at least one disability. This is the largest population with consistent health disparities and intersects with all races, ethnicities, genders, ages, and sexual orientations. Equity is at the core of public health practice. Health data linked with disability data provide accountability and a basis for trust in leaders who seek meaningful health progress for people with disabilities (PWD). The Individuals with Disabilities Education Act (IDEA), our nation’s special education law, ensures special education and related services to children with disabilities. The Education for All Handicapped Children Act (PL 94-142) was created in 1975 to ensure that children with disabilities are able to access free and appropriate public education (FAPE) in the least restrictive environment (LRE). This act was reauthorized as IDEA in 1990. One in every seven students in the United States receives special education services through the IDEA, requiring a large, highly qualified special education workforce to support students’ rights to FAPE. Medicaid is a federal-state partnership that provides health care coverage to low-income children, senior citizens, and people with disabilities. More than 39 million children 0-18 years old were enrolled in Medicaid and CHIP by December 2021. Among Black, Hispanic, and American Indian/Alaska Native (AI/AN) infants under one year, more than 6 in 10 rely on Medicaid coverage. Children of color are disproportionately poor and, as a result, more likely to have Medicaid coverage. More than half of all Black, Hispanic, and AI/AN children under 18 are covered by Medicaid.

Medicaid plays a critical role in protecting the health and well-being of US children, covering half of infants and toddlers as well as two-thirds of children with special health care needs and disabilities. Since its inception in 1965, Medicaid has provided health coverage for low-income children. Protecting health coverage and access to care for children with disabilities and special needs must be a priority for our nation, states, and communities. Medicaid provides coverage for almost half of all children with disabilities and other special health care needs and is the sole coverage for almost one third of these children. The use of restraint and seclusion for managing children’s behaviors in schools has led to physical and psychological harm, and, in the most extreme cases, even death. For more than a decade, the level of research and concern regarding restraint and seclusion in schools has grown. The experience of being restrained and secluded in school can be traumatizing and life-altering, particularly for children with developmental, mental health, or intellectual disabilities. While adults and children in mental health and correctional facilities are protected by law from the unnecessary use of restraints and seclusion, no federal law protects our children in schools. …

Changes to Medicaid financing structure should be carefully considered because any change could have a potentially negative impact on children with disabilities and special health care needs (hereafter referred to as children with disabilities) and limit their access to critically needed health care services and community supports. Currently, Medicaid funding operates through a state and federal partnership, with the federal government providing 60% of funding on average. Medicaid funds vital services for children and youth with special health care needs and disabilities (CYSHCN). Proposed changes to the structure of Medicaid would significantly reduce federal funding for this important program. The most concerning are the proposed structural changes including per capita caps and block grants, as well as threats to Early and Periodic Screening, Diagnostic and Treatment (EPSDT) and Medicaid Waiver services. Restructuring would have devastating effects on benefits for low-income children and individuals with disabilities, and their families, putting this very vulnerable population at additional risk.

The Lifespan Respite Care Act (PL 109-442) provides critical support for families caring for loved ones at home. Family caregivers in the United States provide an estimated $470 billion worth of uncompensated care—a figure that exceeds the total Medicaid budget for 2013 (NAC Task Force, 2016). According to the National Respite Coalition, access to respite care helps protect caregiver health, strengthens families, keeps marriages intact, and prevents the need for expensive institutional long-term care.
