Public Policy On Alcohol In The United Kingdom: Towards A Safety Net For The Alcohol-Dependent, Laura Williamson
Public Policy On Alcohol In The United Kingdom: Towards A Safety Net For The Alcohol-Dependent, Laura Williamson
Dr Laura Williamson
Public policy on alcohol in the United Kingdom fails to support, and may even undermine, the wellbeing of those with the worst alcohol misuse problems, the alcohol-dependent. This is partly because it evades the thorny issue of impaired control that characterises dependence. In addition, until recently, all United Kingdom alcohol policy focused on improving individualised treatment for the dependent, rather than attending to the wider social and environmental factors that influence the condition. The efforts of policy to normalise "sensible" drinking, while stigmatising drunkenness, also risk exacerbating the social vulnerability of the alcohol-dependent. The article examines these issues and concludes …
La Libertad De Conciencia En Miguel De Unamuno, Kevin Fagan
La Libertad De Conciencia En Miguel De Unamuno, Kevin Fagan
Kevin T. Fagan
“Winning is not convincing” was the response of the Rector of the University of Salamanca, Miguel de Unamuno, when faced with the military arrogance of General Millán-Astray during the Spanish Civil War. Speaking truth to power, these last public words uttered by Unamuno rise up as the capstone of the courageous defense of freedom of conscience by an academic against despotism. Here we analyze his literary and philosophical thought throughout a life of writings consistent with his personal sufferings on behalf of conscience. His multiple witnesses in defense of freedom of thought, expression and action are based on deep meditation …
Negotiating The Right Of Return, Neophytos Loizides, Marcos Antoniades
Negotiating The Right Of Return, Neophytos Loizides, Marcos Antoniades
Neophytos Loizides
Negotiating the right of return is a central issue in post-conflict societies aiming to resolve tensions between human rights issues and security concerns. Peace proposals often fail to carefully balance these tensions or to identify incentives and linkages that enable refugee return. To address this gap, the article puts forward an alternative arrangement in negotiating refugee rights currently being considered in the bilateral negotiations in Cyprus. Previous peace plans for the reunification of the island emphasized security and stipulated a maximum number of Greek Cypriot refugees eligible to return under future Turkish Cypriot administration. The authors’ alternative suggests a minimum …
A Cheap Bill For Deviant Enclosures: Legal Change And The Eighteenth Century Enclosure Movement, Robert Tennyson
A Cheap Bill For Deviant Enclosures: Legal Change And The Eighteenth Century Enclosure Movement, Robert Tennyson
Robert Tennyson
This article considers the question of legal change in the context of the parliamentary enclosure movement of eighteenth century England. While the English court of Chancery had enabled late Tudor and early Stuart enclosures by inserting a controlled uncertainty into the enclosure process, it refused to enforce them where an individual with rights of common held out. The eighteenth century parliament overcame this difficulty by allowing bill suitors to obtain private enclosure legislation in the face of ever-greater numbers of dissenters. This dilution of the unanimous assent standard occurred through the efforts of suitors who were encouraged by parliamentary procedures …
Duplicative Foreign Litigation, Austen L. Parrish
Duplicative Foreign Litigation, Austen L. Parrish
Austen L. Parrish
What should a court do when a lawsuit involving the same parties and the same issues is already pending in the court of an-other country? With the growth of transnational litigation, the issue of reactive, duplicative proceedings – and the waste inherent in such duplication – becomes a more common problem. The future does not promise change. In a modern, globalized world, litigants are increasingly tempted to forum shop among countries to find courts and law more favorably inclined to them than their opponents. The federal courts, however, do not yet have a coherent response to the problem. They apply …
Scotland: Leading The Way For Alcohol Policy In The United Kingdom?, Laura Williamson
Scotland: Leading The Way For Alcohol Policy In The United Kingdom?, Laura Williamson
Dr Laura Williamson
In March 2009, the Scottish Government published a new strategy for addressing the harms associated with alcohol misuse entitled Changing Scotland’s Relationship with Alcohol: A Framework for Action. The document is important for health ethics because it signals a philosophical shift in the way countries in the United Kingdom address alcohol related harms.

The past twenty years have brought about a paradigm shift in higher education. During that time, we have changed our focus from what we want to teach to what students need to learn. The academy's position of unassailable authority has been usurped by public cries for transparency, accountability, quality assurance, and quality improvement. To cut expenses, and therefore deter the rising cost of postsecondary education, institutions have borrowed best business practices and started focusing on productivity, efficiency, and reallocating resources.
Spirituality And Subjective Well-Being: Empirical Evidences For A New Domain In The Personal Well-Being Index, Eduardo Wills-Herrera
Spirituality And Subjective Well-Being: Empirical Evidences For A New Domain In The Personal Well-Being Index, Eduardo Wills-Herrera
Eduardo Wills-Herrera
Subjective well-being explores the evaluations, both positive and negative, of how people experience their lives. Research in the field inquires how people perceive their well-being in different settings, including different cultures, regions and cities. A large number of different measures have been designed to capture subjective well-being. One of the most used SWB measure is the Personal Well-being Index (PWI), an evaluation of life developed by Cummins et al [(2003). Social Indicators Research, 64, 159–190] which proposes that satisfaction with life consists of seven different life-domains. Theoretical considerations of the contribution of spirituality and religiosity to life satisfaction, from a …

Elite Framing And Conflict Transformation In Turkey, Neophytos Loizides
Elite Framing And Conflict Transformation In Turkey, Neophytos Loizides
Neophytos Loizides
This article examines the effects of elite framing in conflict transformation. It utilizes debates from the Turkish Grand National Assembly (TBMM) as the main source of empirical evidence and demonstrates differences in the way Turkish parliamentarians framed national and foreign policy issues in the 1990s. For the most part, elite framing of Kurdish issues was predominantly monolithic and adversarial towards ‘ethnic others’ demonstrating few challenges to dominant nationalist narratives and discourses, while framing of Greek-Turkish disputes was diverse, with moderates cautiously challenging hardliners on the necessity of cooperating with Greece. The article unravels these elite framing strategies and illustrates how …
The Spirit Of Capitalism, Precautionary Savings, And Consumption, Yulei Luo, William Smith, Heng-Fu Zou
The Spirit Of Capitalism, Precautionary Savings, And Consumption, Yulei Luo, William Smith, Heng-Fu Zou
Yulei Luo
Recent research has shown that the “spirit of capitalism”—a preference for wealth itself, in addition to consumption—has important implications for growth and asset pricing. This paper explores how the spirit of capitalism affects saving and consumption behavior. We demonstrate that the spirit of capitalism may reduce the importance of precautionary savings. It can also explain the excess sensitivity puzzle: the spirit of capitalism causes dramatic deviations from a random walk. It may also offer a partial explanation of the excess smoothness puzzle.
The Wealth Distribution And The Demand For Status, Yulei Luo, Eric R. Young
The Wealth Distribution And The Demand For Status, Yulei Luo, Eric R. Young
Yulei Luo
Standard economic theories of asset markets assume that assets are valued entirely for the consumption streams they can finance. This paper examines the introduction of the demand for status (as a function of wealth) into a model of uninsurable idiosyncratic risk—the “spirit of capitalism” (“soc”) assumption. We find that soc preferences lead to less inequality in wealth; placing wealth into the utility function leads to a shrinking wealth distribution. The drop in wealth concentration is smaller if the utility function implies status is a luxury good, but no parametrization leads to higher wealth Gini coefficients than the benchmark case. We …
The Spirit Of Capitalism And Excess Smoothness, Yulei Luo, Williams Smith
The Spirit Of Capitalism And Excess Smoothness, Yulei Luo, Williams Smith
Yulei Luo
In a recent paper [Luo, Smith, and Zou (2009)] we showed that the spirit of capitalism could in theory resolve the two fundamental anomalies of modern consumption theory, excess sensitivity and excess smoothness. However, that basic model could not plausibly explain the empirical magnitude of excess smoothness. In this paper we develop two extensions of the model — one with transitory and permanent shocks to income, the other with a stochastic interest rate — that where the spirit of capitalism can explain excess smoothness.
Disparities In Level Of Amputation Among Minorities: Implications For Improved Preventative Care, Kristin M. Lefebvre, Stephen Metraux
Disparities In Level Of Amputation Among Minorities: Implications For Improved Preventative Care, Kristin M. Lefebvre, Stephen Metraux
Stephen Metraux
Objectives: The purpose of this study was to evaluate the relationship between race and level of amputation and to discuss the implications if a disparity was found. Methods: From the 2003 Healthcare Cost and Utilization Nationwide Inpatient Sample, 80 845 (weighted) discharges with a diagnosis of vascular disease and black or white race were evaluated for a disparity in level of amputation. Level of amputation was categorized using International Classification of Diseases, Ninth Revision, Clinical Modification procedure codes into above-knee and below-knee amputation. SPSS 15.0 complex samples software (SPSS Inc, Chicago, Illinois) was used for univariate and multivariate statistical analysis. …
The Prevalence Of Musculoskeletal Conditions Among The Adult U.S. Population: Considerations For Physical Therapists., Michael P. Johnson, Stephen Metraux
The Prevalence Of Musculoskeletal Conditions Among The Adult U.S. Population: Considerations For Physical Therapists., Michael P. Johnson, Stephen Metraux
Stephen Metraux
Study Design: Retrospective, Cross-sectional. Objectives: Identify the prevalence of musculoskeletal conditions (MSC) among the non-institutionalized U.S. population using an expanded set of ICD-9-CM codes that correspond to the range of conditions seen in Physical Therapist (PT) Practice. Examine prevalence rates among adults and older adults (65 years and older). Background: MSCs are the most common health problem in the U.S. and prevalence increases with age. Previous studies examining MSC prevalence were based on a limited set of conditions seen by physicians, therefore may not be representative of those who receive PT services. Disease prevalence is used to determine resource allocation …
Us Attacks Inside Pakistan Territory: An Insight On International Law And Use Of Force, Ahmad Ali Ghouri
Us Attacks Inside Pakistan Territory: An Insight On International Law And Use Of Force, Ahmad Ali Ghouri
Ahmad Ali Ghouri
Post September 11, 2001 era gave new dimensions to the use of force under international law. New interpretations of the doctrine of self-defence emerged alongside the invention of the doctrine of pre-emptive strike devising legitimacy for the use of force. Where there are increasing concerns of international community for fully reliable evidence, as opposed to assumptions and probabilities, which may provide basis for a pre-emptive military action, there is fundamental jurisprudential divide among international lawyers over the circumstances that may give a legitimate right to pre-emptive use of force. Although the issue of pre-emptive use of force is equally important …

Francis E. Howard
The purpose of this paper is to present a virtual library plan created by library directors of the 23 California State University (CSU) system campuses. The information literacy portion of the project offers a repository of high quality interactive digital learning objects (DLOs) in the MERLOT repository. Therefore, DLOs created locally at the Dr Martin Luther King, Jr Library at San José State University (SJSU) focus on topics that supplement the “core” DLO collection.

Addressing The Needs Of The Homeless: A San José Library Partnership Approach, Lydia N. Collins, Francis E. Howard, Angie Miraflor
Francis E. Howard
Describes an urban joint-use library's approaches to library programs for homeless children, teens, and adults as well as agencies the library could partner with. Proposes that libraries put more effort into reaching out to the homeless community instead of assuming the normal expectation that people will come to the library.

Meeting The Need For K-8 Teachers For Classrooms With Culturally And Linguistically Diverse Students: The Promise And Challenge Of Early Field Experiences, Amy Strage, Susan Gomez, Kari Knutson-Miller, Ana Garcia-Nevarez
Amy Strage
The writers present the findings of their study focused on teacher learning through early fieldwork experiences to address the problem of teachers working with a culturally and linguistically diverse student population. Data were analyzed from an archive collected from approximately 500 students enrolled in six undergraduate child development courses at three state university campuses located in urban areas of California. Findings suggest that early field experiences provide participants with opportunities for career goal clarification, and the context of field experience is significant and may lead to outcomes beyond the initial goal of the experience.
